HomeMy Public PortalAbout00600 O R D I N A N C E NO. 600 AN ORDINANCE declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District, for the purpose of permitting construction of sewers therein to serve the needs of residents on adjacent lands and authorizing the institution of condemnation proceedings in connection therewith, with an emergency clause. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area in the Gravois Creek Trunk Subdistrict of The Metropolitan St. Louis Sewer District in which there work and live numerous people; and WHEREAS, sanitary sewage gathered from such area will have no alternative means of disposition to crossing said property and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metro- politan St. Louis Sewer District to protect the public health by relieving and alleviating these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve the aforesaid insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise, easements for the use of sewers as 2 hereinafter set forth, together with such working space adjacent to the right-of-way as obtained as may be required for working room during the construction period, and the right of ingress and egress over the premises sought to be condemned for the access to such easements: An easement twenty (20) feet wide across property now or formerly of Samuel F. Burnet and Warren A. Burnet which property lies in Block 35 of Carondelet Commons South of the River des Peres in U. S. Survey No. 3102, T44N, R6E, St. Louis County, Missouri. The centerline of aforesaid easement is described as follows: Beginning at a point in the northwestern line of Avenue "H", 20.46' wide, distant 389.64' southwestwardly from the most eastern corner of said Block 35, thence northwestwardly in a straight line 863.94' to the point of ending in the northeastern line of Block 35, which point of ending is distant 770.06' northwestwardly along said northeastern line of Block 35 from its most eastern corner. An easement twenty (20) feet wide across property now or formerly of Kennoy Company, Inc., a corporation, which property is a parcel of land lying in the northwestern part of Lot 55 of Carondelet Commons South of River des Peres, St. Louis County, Missouri, said parcel of land being bounded westwardly by the eastern line of the land or road 20.46 feet in width running between Lot 55 and Lot 33 of Carondelet Commons South of the River des Peres bounded northwardly by Lot 54 of said Carondelet Commons 3 bounded eastwardly by Lot 76 of said Carondelet Commons bounded southwardly by the northern line of Greene Park Road and containing 8.10 acres more or less exclusive of the right of way of the Missouri Pacific Railroad Company and of Reavis Barracks Road both of which extend through the parcel described. The centerline of aforesaid easement is described as follows: Beginning at a point in the northern line of Greene Park Road, 40 feet wide, distant 33.27' eastwardly from its intersection with the northeastern line of Reavis Barracks Road, 40 feet wide, thence northeastwardly in a straight line 239.14 feet to the point of ending in the northeastern line of said Block 55, which point of ending is distant 477.21 feet southeastwardly along said northeastern line of Block 55 from its intersection with the southeastern line of the Missouri Pacific Railroad Co. right-of-way 100 feet wide. Easements twenty (20) feet and ten (10) feet wide across property now or formerly of Rachel Taslichky is and Emil Sandi, which property/part of the northwest half of Lot 13 and part of Lot 14 of Carondelet Commons South of the River des Peres, being more particularly described as follows: Beginning at a point in the south east line of Union Road 40 feet wide being the most western corner of tract conveyed to Edward C. Schneider by deed recorded in Book 2035 Page 201; thence South 53 degrees 30 minutes east along the southwest line of said Schneider 4 tract 278.26 feet to the most southern corner thereof; thence north 36 degrees 30 minutes east along the southeast line of said Schneider tract and its direct prolongation northeast 169.36 feet to the center line of Missouri Pacific Railroad right-of-way 100 feet wide thence southeast along the center line of said right-of- way 100 feet wide thence southeast along the center line of said right-of-way along a curve to the left having a chord of south 41 degrees 56 minutes east a distance of 225 feet thence continuing along said center line along a curve to the left having a chord of south 45 degrees 58 minutes east a distance of 177.22 feet to a point in the southeast line of said northwest half of lot 13 thence south 36 degrees 30 minutes west along the southeast line of said northwest half of Lot 13 and its direct prolongation southwest 725.22 feet to a point in the center line of Gravois Creek thence along the meanderings of the average center line of said creek the following courses and distances; North 57 degrees 06 minutes west 89.23 feet north 79 degrees 25 minutes west 220.25 feet north 8 degrees 53 minutes west 106 feet north 15 degrees 22 minutes east 80 feet north 36 degrees 21 minutes east 48.71 feet north 47 degrees 19 minutes west 208.68 feet, north 36 degrees 37 minutes west 70.29 feet to the most southern corner of parcel conveyed to the County of St. Louis by deed recorded in Book 1585 page 379, thence north 36 degrees 30 minutes east along the southeast line of said County of St. Louis Parcels 41.6 feet more or less to the most eastern corner thereof; thence north 53 5 degrees 30 minutes west along the northeast line of said County of St. Louis parcel 8 feet to a point in the southeast line of Union Road; thence north 36 degrees 30 minutes east 393.72 feet to the point of beginning, EXCEPTING THEREFROM that portion lying within the right-of-way of the Missouri Pacific Railroad right-of-way containing 9.224 acres according to survey thereof made by Elbring Surveying Company during October 1954 and revised December 2, 1954 and February 16, 1955. The centerline of said easements are described as follows: (1) Twenty feet wide easement beginning at the point of intersection of the northeast line of said Block 14 with the southeast line of Union Road 40 feet wide, thence southwestwardly along said southeastern line of Union Road 226.72 feet to the point of beginning, thence southeastwardly at a deflection angle to the left of 72o 15' 30" from the preceding course and in a straight line 530.57 feet to a point of curve, thence continuing southeastwardly and along a curve with a radius of 300 feet to the left 136.79 feet to a point of tangency, thence continuing in a southeastwardly direction and on a tangent to the immediately preceding curve a distance of 52.8 more or less to the point of ending in the southwestern prolongation of the southeastern line of the northwest half of Block 13 of Carondelet Commons south of the River des Peres, which point of ending is distance 394.37 feet southwestwardly from and along said southwestern prolongation from 6 the northeastern line of said Block 14. (2) Ten foot wide easement beginning at the point of intersection of the northeast line of said Block 14 with the southeast line of Union Road, 40 feet wide, thence southwestwardly along said southeastern line of Union Road 226.72 feet, thence southeastwardly at a deflection angle to the left of 72o 15' 30" from the immediately preceding course a distance of 530.57', thence southwestwardly at a deflection angle to the right of 93o 30' from the preceding course a distance of 10 feet more or less to a point in the southwestern line of the 20 foot wide easement described in (1), above, being the point of beginning for the centerline of the 10 foot wide easement herein described, thence continuing southwestwardly along the immediately preceding course 175 feet more or less to its termination at the centerline of Gravois Creek. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri, for the appropriation of private property as hereinbefore set out. Section Three. The immediate construction of sewers being necessary in order to protect the public health within the District constitutes an emergency within the meaning of the Plan of The Metropolitan St. Louis Sewer District and this Ordinance 7 shall take effect immediately upon its adoption. The foregoing Ordinance was adopted July 10, 1961.
