INITIATION:
1. Mayor Tyrell called the adjourned meeting of the City
Council to order at 7:30 p.m.
2. ROLL CALL:
PRESENT: Councilmen- Beckley, Briggs, Harker, Merritt,
Tyrell
ABSENT: None
ALSO PRESENT: City Attorney Martin, Planning Director
Dragicevich and City Manager Koski
PUBLIC HEARING: 7:30 p.m. ZONE CASE #67 -209, 5839 -41 N.
ROWLAND, ZONE CHANGE REQUEST FROM R -1 to C -2.
Mayor Tyrell advised that this was the time and the place
for Public Hearing for zoning case #67 -209, 5839 -41 N.
Rowland, and declared the public hearing opened. Planning
Director Dragicevich explained that the subject property
had a frontage of 60' and a depth of 190' and that the zon-
ing change was being requested in order that this property
could become a part of the larger commercial property to
the north (fronting on Las Tunas Drive), and that the
entire property would then contain 41,000 sq. ft. The
surrounding area is developed with commercial and residen-
tial buildings, primarily single and two - family dwellings.
The Planning Commission, at its meeting of February 28,
1967, had recommended that the zone change request be
granted. The subject property is presently in escrow to
Mr. Maurice Orr, pending the zone change, in order that
an automobile sales agency might lease the property and
conduct sales and service at this location. City Attorney
Martin advised that in a zone change application that we
do not have the right to impose conditions, however it was
pointed out that the City does have ordinances restricting
use of property so that a nuisance could not be created.
Mayor Tyrell asked if anyone wished to speak in favor of
the zore change. Mr. Maurice 0rr, 3437 N Delta, Rosemead,
advised that his interests were as owner of the subject
property (now in escrow), and that negotiations will be
completed with one of the two automobile agencies. However,
that a franchise with either agency is contingent upon the
property being large enough to meet their requirements.
He provided a general layout as to the intended use of the
property, showing ingress and egress, general office, show
room, service department, service office, unit repair, and
parking. There was no one else who desired to speak in
favor of the zone change.
Mayor Tyrell asked if . anyone wished to speak in opposition
to the zone change. Mr. Richard S. Allen, 5816 N Rowland,
addressed the Council, stating that if any change is made
it should be done on an overall basis, not just a lot at a
time; that this was a drastic change from R -1 to C -2 and
that some progression should be provided for contiguous
property. It was explained that the ordinance provides
that contiguous area is automatically a buffer area, and
that the property in question is already in R -2 usage. No
one else came forward to speak in opposition.
It was moved by Mr. Briggs, seconded by Mr. Harker and unan
imously carried that the public hearing be closed.

Following lengthy discussion as to possible undesirable
use of the property if the franchise were not obtained
since conditions cannot be imposed; and alternative pro-
cedures such as the implementation of a deed restriction,
or zone variance in lieu of zoning change, it was moved
by Councilman Briggs that a petition for a zoning variance
be initiated, with a waiver of fees appropriate, and that
the matter be set for public hearing before the Planning
Commission on April 5, 1967. The motion was seconded by
Councilman Merritt and unanimously carried.
3. MATTERS FROM CITY OFFICIALS
City Manager Koski requested authorization to draw warrant
for the registration fee for the Eighth Annual Seminar,
California Contract Cities Association, May 4, 5 and 6, 1967,
It was moved by .Coun:dilinan..Harker, seconded :.by Councilman
Beckley, and unanimously carried, that authorization be granted
to draw warrant for the registration fee for the Eighth
Annual Seminar, California Contract Cities Association, to
be held in Palm Springs, California, May 4, 5 and 6, 1967.
ADJOURNMENT:
There being no further business, the meeting was adjourned
by the Mayor at 8:24 p.m., to the next regular meeting of the
City Council on April 4, 1967, at 7:30 p.m. in the Council
Chambers of the City Hall, 5938 N. Kauffman Avenue, Temple City.
