A SPECIAL ORDINANCE VACATING A PUBLIC WAY
WHEREAS, Robert J. and Wanda L. Smith and Donald Collins have petitioned Common Council of Richmond, Indiana, requesting the vacation of 25 feet of the right-of-way along the north side
Woodside Drive; and
WHEREAS, the petitioners are the only adjoining property owner, and
WHEREAS, the roadway proposed to be vacated is needed for commercial purposes; and
WHEREAS, said Council, pursuant to Indiana Code 36-7-3-12, conducted a public hearing on said petition April 25, 2002, after publishing legal notice thereof at least ten (10) days in
advance of said hearing as required by statute; and
WHEREAS, the Richmond Advisory Plan Commission, pursuant to Richmond Code 155.04(b), conducted a public hearing on said petition April 25, 2002 after publishing legal notice thereof
at least ten (10) days in advance of said hearing as required by ordinance; and
WHEREAS, it is desirable to vacate said public way.
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that, subject to the preservation of easements for existing utilities, the portion of public way
described in attached Exhibits A & B is hereby vacated and that ownership of such land heretofore dedicated as public way is indicated below shall be distributed as indicated, to wit:
Exhibit A - Robert J. & Wanda L. Smith
Exhibit B – Donald R. Collins
Passed and adopted this 20th day of May, 2002, by the Common Council of the City of Richmond, Indiana.
