HomeMy Public PortalAbout00679 O R D I N A N C E NO. 679 AN ORDINANCE authorizing and directing the Executive Director to convey a portion of certain real estate in St. Louis County, Missouri, being a part of the land containing a sewage disposal plant known as the "Sugar Creek Plant'', formerly of the City of Kirkwood, to the State of Missouri for the use of the State Highway Commission of Missouri and to execute a quit claim deed upon the conditions herein set out. WHEREAS, pursuant to the Plan of The Metropolitan St. Louis Sewer District and by Resolution No. 6 of the District, adopted July 1, 1954 and recorded in Book 3286, Page 90 of the St. Louis County Records, the District took title for its use and possession to a sewage treatment plant tract formerly of the City of Kirkwood, situated in St. Louis County, and known as the "Sugar Creek Treatment Plant", and which was more particularly described in an instrument recorded in Book 4440, page 409 of the St. Louis County Records; and WHEREAS, the State Highway Commission wishes to cross a portion of such property with a highway and has offered the District a fair price for the same, and such highway will not interfere with the operation of such treatment plant; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The District does hereby Remise, Release and forever Quit Claim any right, title or interest in or to the following described portion of real estate, situated in the County 2 of St. Louis and State of Missouri, to wit: A parcel of land in the Northwest quarter of the Southwest quarter of Section 3, Town 44 North, Range 5 East, St. Louis County, Missouri, described as follows: Bounded East by Highland Avenue, North by Grantor's North property line, being a line parallel with and 629.78 feet North of the South line of the Northwest quarter of the Southwest quarter and bounded South and West by a line beginning at a point on the existing West right-of-way line of Highland Avenue, being a point 20 feet West of Station 8/00 on the hereinafter described centerline of Highland Avenue; thence North 88 degrees 51 minutes West, 20 feet to a point; thence North 16 degrees 12 minutes West, 83.81 feet to a point 55 feet West of Station 7/20 on said centerline of Highland Avenue, as measured at right angles thereto; thence North 1 degree 09 minutes East parallel with the centerline of Highland Avenue and 55 feet therefrom a distance of 122.98 feet to a point opposite P.T. Station 5/97.02; thence Northerly on the arc of a curve to the left having a radius of 423.34 feet being parallel with the centerline of Highland Avenue and 55 feet therefrom, a distance of 23.91 feet to a point opposite centerline Station 5/70; thence South 87 degrees 55 minutes West, 15 feet to a point 70 feet West of said centerline Station 5/70, and being a point on the arc of a curve having a radius of 408.34 feet and tangent to a line bearing North 2 degrees 05 minutes West; thence Northwesterly on the arc of said 3 curve to the left, parallel with the centerline of Highland Avenue and 70 feet therefrom, a distance of 61 feet more or less, to Grantor's North property line, containing 0.238 of an acre, more or less, exclusive of land in Highland Avenue. The centerline of Highland Avenue is described as follows: From the Northeast corner of the Northwest quarter of the South west quarter of Section 3, Township 44 North, Range 5 East; thence South 1 degree 09 minutes West along the East line of said quarter section, 994 feet to Station 8/00 on the centerline of Highland Avenue; thence North 1 degree 09 minutes East on said centerline 202.98 feet to P.T. Station 5/97.02; thence Northerly on the arc of a curve to the left having a radius of 478.34 feet a distance of 56 feet to the intersection with Grantor's North property line at Station 5/13. Section Two. The Executive Director is hereby authorized and directed to execute in behalf of the District a Deed giving effect to Section One hereof.
