HomeMy Public PortalAbout00690 O R D I N A N C E NO. 690 AN ORDINANCE calling and providing for the holding of a Special Election in the Mattese Creek watershed of St. Louis County, Missouri, for the purpose of submitting to the qualified electors thereof a proposal for the annexation of the herein described area to The Metropolitan St. Louis Sewer District, with an emergency clause. WHEREAS, petitions to the Board of Trustees of The Metropolitan St. Louis Sewer District praying for annexation have been received from and signed by more than one hundred of the owners of the land in said hereinafter described area, but such signers do not constitute a majority of owners of land in said area owning more than one-half of the land area therein; and WHEREAS, the Board of Trustees is of the opinion that such area could be annexed and the facilities of the District extended to it, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Board of Trustees of The Metropolitan St. Louis Sewer District hereby grants the petitions for annexation to The Metropolitan St. Louis Sewer District of the area within the Mattese Creek watershed area of St. Louis County, Missouri, as more particularly described in the Notice of Special Election as contained in Section 5 of this Ordinance. Section Two. A special election be and the same is hereby called and ordered to be held within the boundaries of the 2 Mattese Creek area of St. Louis County as described in Section One hereof on Wednesday the 14th day of February, 1962, for the purpose of submitting to the qualified electors of said area the following proposition: PROPOSITION Shall there be annexed to The Metropolitan St. Louis Sewer District that area of the Mattese Creek watershed of St. Louis County, Missouri, as more particularly described in the Notice of Special Election contained in Section 5 of Ordinance No.690 of said The Metropolitan St. Louis Sewer District, adopted January 8, 1962? Section Three. That said special election shall be held at the polling places in said area as set forth and described in the notice of election as contained in Section Five of this ordinance. The polls of said election shall be opened at the hour of 6:00 o'clock A.M. Central Standard Time and shall remain open until the hour of 7:00 o'clock P.M. Central Standard Time on the aforesaid date. Section Four. That the ballots to be used at said special election shall be in substantially the following form, to wit: OFFICIAL BALLOT MATTESE CREEK WATERSHED OF ST. LOUIS COUNTY STATE OF MISSOURI 3 SPECIAL ELECTION Wednesday, the 14th day of February, 1962 PROPOSITION Shall there be annexed to The Metropolitan St. Louis Sewer District that area of the Mattese Creek watershed of St. Louis County, Missouri, as more particularly described in the Notice of Special Election contained in Section 5 of Ordinance No.690 of said The Metropolitan St. Louis Sewer District, adopted January 8, 1962? FOR THE ANNEXATION OF THE AREA Yes ..... ..... No ..... ..... (Instructions to voters: to cast a vote in favor of the annexation of area, place a cross (X) mark in the square opposite the word "Yes"; to cast a vote against annexation of area place a cross (X) mark in the square opposite the word "No.") Section Five. That the Secretary-Treasurer be and he is hereby directed to give notice of said special election by advertisement published once a week for at least three (3) consecutive weeks in the St. Louis Globe-Democrat and in the St. Louis Post-Dispatch, newspapers of general circulation in The Metropolitan St. Louis Sewer District, and in the area proposed to be annexed, the first publication in each of said newspapers to be made at least twenty-one (21) days prior to the date of the election and the last publication to be made not more than seven (7) days prior to the date of said election. LOUIS COUNTY STATE OF MISSOURI Notice is hereby given to the qualified electors of the Mattese Creek watershed of St. Louis County, State of Missouri, more particularly described as follows: Beginning at a point in the southwestern boundary line of The Metropolitan St. Louis Sewer District, where it intersects the northwestern line of Block 64 of the Carondelet Commons South of River des Peres, said point of beginning being 200 feet south- west of the southwestern line of Lindbergh Boulevard, thence running southwestwardly along the northwestern line of said Block 64 and its prolongation southwestwardly to the northernmost corner of Block 65 of said Carondelet Commons; thence southeastwardly 183.71 feet along the northeastern line of said Block 65 to a point; thence southwestwardly and parallel with the northwestern line of said Block.65 to a point 290.40 feet northeast of the northeastern line of Forder Road; thence southeastwardly and parallel with northeast line of Forder Road to a point 200 feet northwest of the southeastern line of said Block 65; thence southwestwardly and parallel with the southeastern line of said block 65 to the southwestern line of said Forder Road; thence southeastwardly along the southwestern line of Forder Road to the northernmost corner of property in Block 67 of the Carondelet 5 Commons, described in deed to Alvin H. That, as provided by Section 10.010 of the Plan of The Metropolitan St. Louis Sewer District, the said special election shall be held and conducted and the returns thereof made, examined, and cast up in the same manner and in all respects as provided by law for the election of state and county officers. All registered voters residing within said area shall be entitled to vote at said election. Section Seven. That the Secretary-Treasurer of this Board shall be and he is hereby directed to file a certified copy of this ordinance with the Board of Election Commissioners for St. Louis County, Missouri, as and for the warrant and authority of the said Board to hold and conduct the special election herein provided for; and the said Board of Election Commissioners is hereby requested to do all things and take all proceedings necessary to the holding and conducting of the said special election. Section Eight. That all ordinances or parts of ordinances which in any manner conflict with the provisions of this ordinance shall be and the same are hereby repealed, insofar as they may so conflict. 24 Section Nine. That because no adequate sanitary trunk sewer system now serves the Mattese Creek area, as described in the Notice of Special Election contained in Section Five hereof, and because the health of the inhabitants of said area is endangered by existing conditions resulting from the absence of an adequate sanitary sewer system, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its enactment. 25 The foregoing Ordinance was adopted January 8, 1962.
