HomeMy Public PortalAbout00724 O R D I N A N C E NO. 724 AN ORDINANCE authorizing and directing the Executive Director to Quit-Claim certain parcels of real estate in St. Louis County, Missouri, one parcel containing a sewage disposal plant formerly of the St. Johns-Overland Sanitary Sewer District and the other parcels being two lots formerly of the South Lackland Sanitary Sewer District, and to execute quit-claim deeds upon the conditions herein set out. WHEREAS, pursuant to the Plan of The Metropolitan St. Louis Sewer District and by Resolution No. 6 of the District, adopted July 1, 1954 and recorded in Book 3286, Page 90 of The St. Louis County Records, the District took title for its use and possession to a sewage treatment plant tract formerly of the St. Johns- Overland Sanitary Sewer District and of two lots then containing pumping or lift stations formerly of the South Lackland Sanitary Sewer District, all situated in St. Louis County, Missouri; and WHEREAS, the District has been authorized to sell bonds to construct the Coldwater Creek Trunk Sewer and treatment plant, which will eventually render such St. Johns-Overland treatment plant and property unnecessary and surplus, and the two lots formerly containing lift stations are not now being used for sewer purposes; and WHEREAS, the District wishes to have these properties retain their public purpose, and has agreed with the officers and trustees of the St. Johns-Overland and South Lackland Sanitary Sewer Districts, which formerly owned such properties, as to their 2 future use and ownership, which provisions are that said two lots formerly of the South Lackland Sanitary Sewer District shall be quit-claimed by that District and The Metropolitan St. Louis Sewer District, to the City of Overland for public use, and that this District and the St. Johns-Overland Sanitary Sewer District shall simultaneously execute quit-claim deeds to the aforesaid treatment plant property to the Athletic Boys Club of St. Louis County, Missouri, a non-profit corporation, such deeds to be held by Title Company of mutual selection as agent for each such District, respectively, until (90) days after such treatment plant located thereon is abandoned and by-passed, when it will be notified in writing by this District that such deeds may be delivered to said Club; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The District does hereby Remise, Release and forever Quit-Claim to the City of Overland for public use any right, title or interest in or to the following described two parcels of real estate, situated in the County of St. Louis and State of Missouri, to wit: A parcel of land in the southeast fractional 1/4 of Section 29 Township 46 North, Range 6 East, being the Southern 1/4 of an arpent of a tract of 8.47 arpents conveyed to Johann Philip Gemmer, by deed recorded in Book 350 page 174 of the Records of the City (former County) of St. Louis, and fronting 28-4/12 feet, 3 more or less, on the center line of Woodson Road, by a depth eastwardly of 325 feet, more or less, to the east line of said property conveyed to Johann Philip Gemmer by deed recorded in Book 350 page 174. Lot 31 in Block 24 of Pagewood Subdivision situated in U. S. Survey 2966, Township 46 North Range 6 East, St. Louis County, Missouri. Section Two. The District does hereby Remise, Release and forever Quit-Claim to the Athletic Boys Club of St. Louis County, Missouri, a non-profit corporation, any right, title or interest in or to the following described real estate, situated in the County of St. Louis and State of Missouri, subject to the provisions set out in Section Three of this Ordinance, to wit: Property former]y of Mary Frame conveyed to the St. Johns- Overland Sanitary Sewer District by deed dated on or about the 26th day of June, 1939, and recorded in Book 1583, page 266 of the St. Louis County Records. A tract of land in U. S. Surveys 166 and 167 in Township 46 North Range 6 East in St. Louis County, Missouri and more particularly described as follows, to-wit: Beginning at the intersection of the eastern line of Wright Ave. 30' wide, a plat of which dedication is recorded in Plat Book 15, page 38 of the St. Louis County Records, with the South line of a 15' road known as Livingston Avenue; thence along the eastern line of Wright Avenue South 7 degrees 49 minutes west 320 feet to the center of 4 an easement of the Coldwater Creek Drainage District; thence along the center line of said easement South 26 degrees 21-1/2 minutes east, 806.42 feet to a point; thence leaving said easement line and running North 7 degrees 49 minutes east 945 feet to an old stone in the South line of said Livingston Avenue 15 feet wide; thence along the South line of said Avenue North 76 degrees 52 minutes West 454.92 feet to the place of beginning, containing 6.577 acres, according to a survey made by Elbring Surveying Co. on 6/23/39, subject to building line, conditions, easements and restrictions of record, if any. Section Three. The Quit-Claim deed of such treatment plant property as described in Section Two hereof shall be deposited simultaneously with a similar deed from the St. Johns-Overland Sanitary Sewer District to the Athletic Boys Club of St. Louis County, Missouri as aforesaid, with a Title Company of mutual selection by The Metropolitan St. Louis Sewer District and the St. Johns-Overland Sanitary Sewer District, said title company to act as agent for each district respectively in holding such deeds, such title company to hold such deeds until ninety (90) days after the aforesaid treatment plant located thereon is abandoned and by- passed, at which time The Metropolitan St. Louis Sewer District shall notify such title company to make delivery of both such deeds to the aforesaid Boys Club. Section Four. The Executive Director is hereby authorized and directed to execute in behalf of the District deeds giving 5 effect to Sections One and Two hereof. The foregoing Ordinance was adopted March 19, 1962.
