HomeMy Public PortalAbout00744 O R D I N A N C E NO. 744 AN ORDINANCE authorizing and directing the Executive Director to grant to the City of St. Louis, Missouri, for the use of the Lambert-St. Louis Municipal Airport, the right to use certain sewer and drainage easements in St. Louis County for airport purposes, and to execute an instrument giving effect thereto upon the conditions hereinafter set out. WHEREAS, the Lambert-St. Louis Municipal Airport of the City of St. Louis wishes to cross certain easements now of this District with additional airport facilities; and WHEREAS, the City of St. Louis, Missouri, has requested the District grant the right to so use said easements, and the District is willing so to do; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to the City of St. Louis, Missouri, for the use of the Lambert St. Louis Municipal Airport, the right to construct, reconstruct, repair and maintain airport facilities across easements owned by the District in St. Louis County, Missouri, as hereinafter set forth, subject, however to the following terms and reservations: The Metropolitan St. Louis Sewer District reserves the right to the full access to and use of such easements for sewer and drainage purposes, including the right to construct new sewers and appurtenances therein and to use, maintain and reconstruct the 2 new and existing sewers and appurtenances therein. The Lambert St. Louis Municipal Airport of the City of St. Louis will, if considered reasonably necessary by District's engineers, protect the existing sewers and appurtenances at its cost, or, if necessary to reconstruct, relocate or repair because of such airport use, such work will be done at the cost of the Lambert St. Louis Municipal Airport of the City of St. Louis. Those easements held by the Metropolitan St. Louis Sewer District and which are involved in this grant are located in the following described property: Part of Lots 8 and 9 of COOK'S ADDITION TO BRIDGETON, according to the plat thereof recorded in Plat Book 14 page 74 of the St. Louis County Records, and described as follows: Beginning at the most northern corner of Lot 8; thence along the Northeast line of Lot 8, South 39 degrees 12 minutes East 394.16 feet to the center line of St. Thomas Street; thence along said center line, South 46 degrees 36 minutes West 498.35 feet, more or less, to the Northeast line of a 1.00 acre tract conveyed to Charles E. Beuer by deed recorded in Book 568 page 286 of St. Louis County Records; thence along said northeast line North 43 degrees 6 minutes West 224 feet; thence North 46 degrees 36 minutes East 210 feet; thence North 52 degrees 10-1/2 minutes West 171.14 feet to the Northwest line of Lot 8; thence North 46 degrees 36 minutes East 342.49 feet to the point of beginning. Part of Lot 8 and part of Lot 9 of COOK'S ADDITION TO 3 BRIDGETON, according to the plat thereof recorded in Plat Book 14 Page 74 of the St. Louis County Records, and described as follows: Beginning at a point in the Northwest line of Lot 9 of Cook's Addition to Bridgeton, distant South 46 degrees 36 minutes West 525.49 feet from the Northwest corner of Lot 8, said beginning point being also the Northwest corner of a 1.00 acre tract conveyed to Charles E. Beuer and wife, by Deed recorded in Book 568 Page 286 of the St. Louis County Records; thence South 43 degrees 6 minutes East along said Beuer's Northeast line 169.14 feet to a point; thence North 46 degrees 36 minutes East 210.00 feet to a point in a creek; thence Northwest 172 feet, more or less, to a point in the Northwest line of Lot 8 of said Cook's Addition, distant North 46 degrees 36 minutes East 183.00 feet from the point of beginning; thence South 46 degrees 36 minutes West, 183.00 feet to the point of beginning. Section Two. The Executive Director is hereby authorized and directed to execute in behalf of the District an instrument giving effect to Section One hereof.
