HomeMy Public PortalAbout00750 O R D I N A N C E NO. 750 AN ORDINANCE authorizing the District to use $175,000.00 from the funds in escrow in the City of Florissant, Missouri, to construct a sewer in the City of Florissant, Missouri, to be known as the "Brinwood Relief Sewer" and to assess a $100.00 per lot connection charge to the users thereof to repay such cost of construction. WHEREAS, under agreement between the City of Florissant and The Metropolitan St. Louis Sewer District, approved by the Circuit Court of St. Louis County, Missouri a $200.00 per lot escrow deposit was charged for lots connecting into the sewer formerly of the City of Florissant, the purpose of which escrow deposit was to guarantee complete sewage disposition, and which funds shall be used to pay for the Florissant homeowners' pro rata share of the cost of the Coldwater Creek Trunk Sewer and treatment plant; and WHEREAS, there exists an area outside the boundary of the City of Florissant and of The Metropolitan St. Louis Sewer District which has no trunk sewer, which flows by gravity into The Metropolitan St. Louis Sewer District which creates a menace to the public health of its own area and to the City of Florissant and a portion of The Metropolitan St. Louis Sewer District and which could be served by a proposed trunk sewer to be known as the "Brinwood Relief Sewer", the cost of which is estimated at $175,000.00; and WHEREAS, all of these aforesaid funds will not be used for several years, but a portion thereof could be advanced now to construct such Brinwood Relief Sewer to solve a menace to the public health of the citizens of the Florissant area, which funds could be repaid as property to be served by such relief sewer is connected thereto; and WHEREAS, subject to the approval of the Circuit Court of St. Louis County, the District and the City of Florissant are desirous of so using a portion of such funds; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. That the Executive Director be and is hereby authorized to use $175,000.00 of such escrow funds to pay a portion of the construction cost of said Brinwood Relief Sewer, subject to prior approval of the Circuit Court of St. Louis County. Section Two. The District is hereby authorized to make a connection charge of $100.00 per house, or the equivalent, to every house that connects into or uses said Brinwood Relief Sewer, prior to such connection, said sums to be repaid upon receipt into the aforesaid escrow funds. The foregoing Ordinance was adopted May 7, 1962.
