HomeMy Public PortalAbout00780 O R D I N A N C E NO. 780 AN ORDINANCE declaring the necessity for the acquisition of easements within certain existing property within The MetropoLitan St. Louis Sewer District, for the purpose of permitting construction of sewers therein to serve the needs of residents on adjacent lands and authorizing the institution of condemnation proceedings in connection therewith, with an emergency clause. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area in the North Hills Homesites Trunk Subdistrict of The Metropolitan St. Louis Sewer District in which there work and live numerous people; and WHEREAS, sanitary sewage gathered from such area will have no alternative means of disposition to crossing said property and wilL constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public heaLth by relieving and alleviating these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve the aforesaid insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise, easements for the use of sewers as 2 hereinafter set forth, together with such working space adjacent to the right-of-way as obtained as may be required for working room during the construction period, and the right of ingress and egress over the premises sought to be condemned for the access to such easements: An easement ten (10) feet wide across property now or formerly of August F. Koedding, Jr. which property is described as follows: Part of Lots and 8 of the Partition of Owen Chambers Estate in U. S. Survey 393 and in fractional section 12, Township 46 North, Range 6 East in St. Louis County, Missouri, according to the plat attached to Commissioners Report recorded in Book 55 Page 398 of the St. Louis City (former County) Records and described as follows: Beginning at a point in the West line of said Lot 8 aforesaid at its intersection with the South line of the right of way of the St. Louis Belt and Terminal Railroad acquired by deed recorded in Book 133 Page 208 of the County Records, thence South 7 degrees 42 minutes East, a distance of 699 feet to the Southwest corner of said Lot 8 aforesaid, thence North 82 degrees 44 minutes East, a distance of 511.50 feet along the South line of said Lot 8 to an angle point; thence North 89 degrees 58 minutes East, a distance of 1425 feet along the South line of said Lots 7 and 8, to the Southeast corner of said Lot 7, thence North 7 degrees 47 minutes West, a distance of 198.35 feet along the East line of Lot 7 to an angle point, thence North 7 degrees 36-1/2 minutes West, a distance of 28.12 feet to the Southwest line of the Wabash Railroad right of way, thence North 63 degrees 25 minutes West, along the Southwest line of the Wabash Railroad right of way, 576.08 feet to the South line of the St. Louis Belt and Terminal Railroad right of way aforesaid; thence West along the arc of a curve to the right having a radius of 1482.70 feet, a distance of 307.73 feet to a point; thence South 79 degrees 06 minutes West, a distance of 328.68 feet to a point, said point being distant 100 feet South of the south line of said right of way as measured at right angles to said South line thence North 70 degrees 14 minutes West, a distance of 446.05 feet to the South line of the St. Louis Belt and Terminal Railroad right of way aforesaid, thence North 83 degrees 11-1/4 min. West along the South line of said right of way 433.78 feet to the place of beginning. 3 Part of Lots 7 and 8 of the Partition of Owen Chambers Estate in U. S. Survey 393 in St. Louis County, Missouri, according to the plat attached to Commissioners Report in Book 55 Page 398 of the St. Louis City (former County) Records and described as follows. Beginning at a point in the West line of said Lot 8 at its intersection with the South line of the Right of Way of the St. Louis Belt and Terminal Railroad acquired by deed recorded in Book 133 Page 208 of the County Records; thence South 83 degrees 11-1/4 minutes East along said right of way a distance of 433.78 feet to a point; thence South 70 degrees 14 minutes East, a distance of 446.05 feet to a point, said point being distance 100 feet South of the South line of said right of way as measured at right angles to said South line; thence North 79 degrees 06 minutes East, a distance of 328.68 feet to a point in the South line of said right of way, thence East along the arc of a curve to the left having a radius of 1482.70 feet a distance of 307.73 feet to a point in the Southwest line of the Wabash Railroad Right of Way; thence North 63 degrees 25 minutes West along the Southwest line of the Wabash Railroad aforesaid, a distance of 213.25 feet to its intersection with the North line of the St. Louis Belt and Terminal Railroad right of way aforesaid; thence West along the arc of a curve to the right having a radius of 1382.70 feet, a distance of 104.98 feet to a point; thence North 83 degrees 11-1/4 minutes West along the North line of the St. Louis Belt and Terminal Railroad Right of Way 1207.46 feet to the West line of Lot 8 aforesaid, thence South 7 degrees 42 minutes East along the West line of Lot 8 a distance of 103.30 feet to the place of beginning. The centerline of aforesaid easement is described as follows: Beginning at a point in the northern line of the former Terminal Railroad Right of Way 100 feet wide, which point is 732.74 feet eastwardly measured along said North line, from the intersection of said north line with the common boundary line of U.S. Surveys 393 and 2689; thence southeastwardly, at an angle to the right of 55 degrees 00 minutes a distance of 56.69 feet to a point; thence eastwardly, at an angle to the left of 55 degrees 00 minutes, a distance of 615.00 feet to a point; thence southeastwardly at an angle to the right of 50 degrees 00 minutes, along a straight line to its intersection with the south line of aforesaid Railroad Right of Way. Beginning at a point in the common lot line of Lots 3 and 7 of the Partition of the Owen chambers Estate, which point is 622.01 feet westwardly from the intersection of the common line of Lots 3 and 4 of said Estate with the south line of Lot 7 of said Estate, thence northwardly, at an angle to the right of 111 degrees 34 minutes a distance of 290.75 feet to 4 a point; thence continuing northwardly at an angle to the left of 54 degrees 46 minutes along a straight line to its intersection with the south line of the former Terminal Railroad Right of Way 100 feet wide, which point is also the terminal point of the previously described portion of subject easement. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri, for the appropriation of private property as hereinbefore set out. Section Three. The immediate construction of sewers being necessary in order to protect the public health within the District constitutes an emergency within the meaning of the Plan of The Metropolitan St. Louis Sewer District and this Ordinance shall take effect immediately upon its adoption. The foregoing Ordinance was adopted June 25, 1962.
