AN ORDINANCE declaring the necessity for the
acquisition of easements within certain existing property within
The Metropolitan St. Louis Sewer District for the purpose of
permitting construction of sewers therein to serve the needs of
residents on adjacent lands and authorizing the institution of
condemnation proceedings in connection therewith, with an
emergency clause
WHEREAS, there exists within The Metropolitan St. Louis
Sewer District an area in the Lindbergh-Union Trunk Subdistrict of
The Metropolitan St. Louis Sewer District in which there work and
live numerous people, and
WHEREAS, sanitary sewage gathered from such area will
have no alternative means of disposition to crossing said property
and will constitute a menace to public health and welfare of the
general public and the residents of The Metropolitan St. Louis
Sewer District; and
WHEREAS, it is the purpose and design of The
Metropolitan St. Louis Sewer District to protect the public health
by relieving and alleviating these conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and
relieve the aforesaid insanitary and dangerous conditions, it is
necessary to appropriate and acquire by the exercise of eminent
domain or otherwise, easements for the use of sewers as

hereinafter set forth, together with such working space adjacent
to the right-of-way as obtained as may be required for working
room during the construction period, and the right of ingress and
egress over the premises sought to be condemned for the access to
such easements:
An easement ten (10) feet wide across property now or
formerly of Norman Guth, Edwin Guth, Vera Wohlschlaeger, Edward P.
Guth and Hilda C Guth, his wife, which property is described as
follows:
A tract of land being a part of fractional sections 26
and 27, Township 44 North, Range 6 East, a part of U. S. Survey
2995, all of Lot 67 of James S. Thomas' Addition in U. S. Survey
2994, a plat of which Addition is recorded in Plat Book 1 Volume 1
Page 46 of the records of the City (former County) of St. Louis,
Missouri, and also a strip 12 feet wide adjoining said Lot 67 on
the Northeast as shown on the plat of said James S. Thomas'
Addition, all in St Louis County, Missouri, and more particularly
described as follows, to wit: Beginning at a stone in the center
line of Green Parke Road, which is also the Northeast line of said
Survey 2994, where it is intersected by the Northwest line of said
Lot 67 projected; and running thence South 32 degrees 15 minutes
West 5.91 chains to a stone thence South 58 degrees 20 minutes
East 11.63 chains to a stone, thence North 49 degrees 40 minutes
East 6.39 chains to a stump, thence North 52 degrees 15 minutes
East 3.73 chains to a stone; thence East 9.08 chains to a stone,

thence North 3 degrees West 1.50 chains to a stone; thence North
77 degrees East 730 feet, more or less, to the Southwest corner of
tract conveyed to Theofiel Coonwels by deed recorded in Book 1265
page 458 of the St. Louis County records; thence North 19 degrees
33 minutes West along the West line of tract so conveyed to
Theofiel Coonwels aforesaid, 722 feet, more or less, to the center
line of Green Parke Road, thence along said center line South 69
degrees 12 minutes West 502.72 feet; South 68 degrees 53 minutes
West 320.24 feet; South 52-1/4 degrees West 14.75 chains to a
stone in the Northeast line of U S, Survey 2994 and thence North
58 degrees 20 minutes West 8.15 chains to the place of beginning.
EXCEPTING from said Lot 67 a strip of land 100 feet wide for
railroad Right of Way conveyed to St. Louis Memphis & Southeastern
Railroad Company by deed recorded in Book 134 page 342 of the St.
Louis County records, ALSO EXCEPTING THEREFROM that part conveyed
to the State of Missouri by deed recorded in Book 4357 page 205 of
the St. Louis County records.
The centerline of aforesaid ten (10) foot wide easement
is described as follows:
Beginning at the point of intersection of a northwest-
southeast boundary line between aforesaid Guth property and
property of the State of Missouri known as the Right-of-Way of
Highway I-55, and of a line parallel with and five (5) feet
southeastwardly from a northeast-southwest boundary of said Guth
property and Highway Right-of-Way, which point of intersection is

394.81 feet southwestwardly measured along said parallel line,
from the west boundary of property of Troy D. Stotler and wife
according to instrument recorded in Book 3298 page 113 of the St.
Louis County Records; thence southwestwardly, along a continuation
of said parallel line, a distance of 20.58 feet to a point; thence
southwestwardly at an angle to the right of 14 degrees 03 minutes
45 seconds a distance of 525.92 feet to its intersection with
another northwest-southeast common boundary line between property
of Guth and Highway Right -of -Way.
Section Two. Counsel for The Metropolitan St. Louis
Sewer District be and is hereby authorized to institute and
prosecute an action in condemnation pursuant to the provisions of
the Plan of The Metropolitan St. Louis Sewer District and the laws
of the State of Missouri for the appropriation of private property
as hereinbefore set out.
Section Three. The immediate construction of sewers
being necessary in order to protect the public health within the
District constitutes an emergency within the meaning of the Plan
of The Metropolitan St. Louis Sewer District and this Ordinance
shall take effect immediately upon its adoption.
