HomeMy Public PortalAbout00813 O R D I N A N C E NO. 813 AN ORDINANCE declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District, for the purpose of permitting construction of sewers therein to serve the needs of residents on adjacent lands and authorizing the institution of condemnation proceedings in connection therewith, with an emergency clause. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area in Subdistrict No. Seven of the River des Peres Watershed (Wellston area) of The Metropolitan St. Louis Sewer District in which there work and live numerous people; and WHEREAS, sanitary sewage gathered from such area will have no alternative means of disposition to crossing said property and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District, and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health by relieving and alleviating these conditions: NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve the aforesaid insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise, easements for the use of sewers as hereinafter set forth, together with such working space adjacent 2 to the right-of-way as obtained as may be required for working room during the construction period, and the right of ingress and egress over the premises sought to be condemned for the access to such easements: An easement fifteen (15) feet wide over property now or formerly of Mack A. Alligood, et al, and which property is described as follows: PARCEL 1: The West part of Lot 10 in Block 8 of WATSON FRUIT HILL, a Subdivision in St.Louis County, Missouri, according to plat thereof recorded in Plat Book 8 page 103 of the records of the City (former County) of St. Louis, described as follows: Beginning at a point in the South line of Wagner Avenue 60 feet wide, distant 53 feet 6 inches West from the Northeast corner of said Lot 10; thence South and parallel to the East line of said Lot 10, to the Southwest line of said Lot 10; thence Northwest along said Southwest line to the Northwest corner of said Lot 10 and thence East along the South line of Wagner Avenue 56 feet 3 inches to the point of beginning. PARCEL 2: Part of Lot 10 in Block 8 of WATSON FRUIT HILL, a Subdivision in St. Louis County, Missouri, according to plat thereof recorded in Plat Book 8 page 103 of the records of the City (former County) of St. Louis, described as follows: Beginning at a point in the South line of Wagner Avenue distant 21 feet 6 inches West from the Northeast corner of said Lot 10; thence South and parallel to the East line of said Lot 10 to the 3 Southwest line of Lot 10, aforesaid; thence Northwest along the Southwest line of Lot 10, aforesaid to the South corner of tract conveyed to Thomas McKinney by deed recorded in Book 567 page 587 of the St. Louis County records; thence North along the East line of tract conveyed to Thomas McKinney aforesaid to the Northeast corner thereof; thence East along the South line of Wagner Avenue 32 feet to the point of beginning. The centerline of aforesaid fifteen (15) foot wide easement is described as follows: Beginning at the northwest corner of aforesaid Lot 10; thence southeastwardly in a straight line, crossing the east line of aforesaid Parcel 1 at a point of intersection 66.33 feet south of the south line of Wagner Avenue (60 feet wide) measured along said east line, to its point of intersection with the east line of aforesaid Parcel 2, which point of intersection is 104.08 feet south of the said south line of Wagner Avenue, measured along said east line of Parcel 2. An easement fifteen (15) feet wide over property now or formerly of Beehler Steel Products Company, which property is described as follows: A tract of land situated in United States Survey 2033, in Township 46 North, Range 6 East of St. Louis County, Missouri, more particularly described as follows: Beginning at a stone set in the Eastern line of Kingsland Avenue, at the Northwest corner of the parcel of ground in said 4 Survey allotted to Charles M. T., Emma Louisa and William Chapman in the Subdivision of the Chapman Estate a plat of which subdi- vision is recorded in Book 391 page 437, of the St. Louis City Recorder's Office; thence running Southwardly with the Eastern line of Kingsland Avenue 200 feet to a stone; thence Eastwardly and parallel to the North line of said parcel of said Chapman Estate Subdivision 949 feet 1-3/4 inches to a stone set at the intersection with the Western line of the Right of Way of the Wabash Railway; thence Northwardly with said Western line of the Right of Way of the Wabash Railway 207 feet 10-3/4 inches to a stone set at the intersection with the Northern line of said parcel allotted to Charles M. T., Emma Louisa and William Chapman in said Chapman Estate Subdivision; thence Westwardly with said last mentioned line 894 feet 1-1/2 inches to the point of beginning, said Tract so described containing 4.23 acres, excepting however, a triangular strip 0.19 acres out of the Northeast corner conveyed to Charles S. Ruffner by Deed dated April 26, 1912, and recorded in Book 297 page 42 of the St. Louis County Recorder's Office. The centerline of aforesaid fifteen (15) foot wide easement is described as follows: Beginning at a point on the south line of aforesaid property 62.54 feet west of the southeast corner of said property; thence northwardly a distance of 193.57 feet to its intersection with a northern line of said property, which is also the southern line of 5 the Union Electric Company Right of Way 100 feet wide, which point of intersection is 116 feet eastwardly of the most northerly/northeastwardly corner of aforesaid Beehler Steel Products Company property. Two easements each fifteen (15) feet wide and an easement ten (10) feet wide, across property now or formerly of Bertha Ellis, and which property is described as follows: Part of Lot 4 of CHAPMAN PLACE in U. S. Surveys 2033 and 2775 in St. Louis County, Missouri, and described as follows: Beginning at an iron pipe in the East line of Kingsland Avenue at its intersection with the South line of property conveyed to William Rishe by deed recorded in Book 389 page 316 of the Records of the City (former County) of St. Louis; thence East along the South line of property conveyed to William Rishe 851.77 feet to the West line of the Wabash Railroad Right of Way; thence South along said Right of Way line, 352.71 feet to the North line of the Union Electric Company of Missouri Right of Way; thence West along the last mentioned line 344.33 feet to the Southeast corner of property conveyed to Merritt D. Taylor and wife by deed recorded in Book 3421 page 436 of the St. Louis County records; thence North along the East line of property conveyed to Taylor and wife, 175 feet to the Northeast corner thereof; thence West along the North line of property conveyed to said Taylor and wife, 590.92 feet to the East line of Kingsland Avenue; thence North 6 along the East line of Kingsland Avenue, 175.17 feet to the point of beginning. The southern line of one of such fifteen (15) foot wide easements is described as follows: Beginning at a point on the south line of said property, which point is 775 feet east of the east line of Kingsland Avenue (40 feet wide), measured along said south line; thence westwardly along said south line a distance of approximately 170 feet to the east line of property now or formerly of Merritt D. Taylor and Lillian Taylor, his wife. The centerline of the remaining fifteen (15) foot wide easement is described as follows: Beginning at a point on a south line of aforesaid Bertha Ellis property, which south line is also the northern line of property now or formerly of aforesaid Merritt D. Taylor and Lillian Taylor, his wife, which point is 190.74 feet eastwardly, measured along aforesaid south line, from the west line of aforesaid Ellis property and also the east line of Kingsland Avenue (40 feet wide); thence northwardly, a distance of 184 feet more or less to its intersection with the north line of said Ellis property at a point 154.02 feet from the northwest corner of said property, measured along said northern line thereof. The centerline of the aforesaid ten (10) foot wide easement is described as follows: Beginning at a point on the centerline of last above 7 described easement over said Ellis property, which point is 50 feet northwardly from the previously described north line of Taylor and south line of Ellis, measured along said centerline; thence at an angle to the left of 30 degrees a distance of 35 feet to a point. Two easements each fifteen (15) feet wide and an easement ten (10) feet wide over property now or formerly of Merritt D. Taylor and Lillian Taylor, his wife, which property is described as follows: Part of Lot 4 of CHAPMAN PLACE in U. S. Surveys 2033 and 2775 in St. Louis County, Missouri, and described as follows: Beginning at a point in the Eastern line of Kingsland Avenue 40 feet wide and the Northern line of Union Electric Light and Power Company right of way 100 feet wide, thence Eastwardly and along the Northern line of said Union Electric right of way 590.92 feet to a point said point being the Southwest corner of property leased to Ray E. Pickrel by lease recorded in Book 3388 page 419 of the St. Louis County records; thence Northwardly and parallel with the Eastern line of Kingsland Avenue 175.00 feet to a point, thence Westwardly and parallel with the North line of said Union Electric right of way 590.92 feet to a point in the Eastern line of said Kingsland Avenue, thence Southwardly and along the East line of Kingsland Avenue 175.00 feet to the point of beginning, and containing 2.24 acres, more or less. The southern line of one of such fifteen (15) foot wide 8 easements is described as follows: Beginning at the southeast corner of said Taylor property; thence westwardly a distance of approximately 380 feet to a point on the southern line of such Taylor property, which point is 232.5 feet eastwardly, measured along said southerly line, from the east line of Kingsland Avenue (40 feet wide). The centerline of the remaining fifteen (15) foot wide easement is described as follows: Beginning at a point on the southern line of aforesaid Taylor property, which point is 232.5 feet eastwardly, measured along said southern line, from the east line of Kingsland Avenue (40 feet wide); thence northwardly along a line 194 feet more or less to its intersection with the north line of aforesaid Taylor property, at a point 190.74 feet eastwardly from aforesaid east line of Kingsland Avenue, measured along said north line of Taylor property. The southern line of the easement ten (10) feet wide is described as follows: Beginning at a point on the southerly line of aforesaid property of Taylor 232.5 feet eastwardly from the east line of Kingsland Avenue (40 feet wide), measured along said southerly line; thence westwardly along said southerly line a distance of 232.5 feet to its intersection with said east line of Kingsland Avenue. An easement fifteen (15) feet wide and an easement ten (10) 9 feet wide over property now or formerly of Sachs Salvage and Supply Company, a corporation, which property is described as follows: Lot 14 of THOMAS HOKE's ESTATE, in U.S. Survey 2775, Township 45 North, Range 6 East, St. Louis County, Mo., containing 10 acres, according to the plat thereof recorded in Plat Book 5 page 46 of the City (former County) of St. Louis, Missouri records. The centerline of said fifteen (15) foot wide easement is described as follows: Beginning at a point in the southeast line of aforesaid Sachs Salvage and Supply Company property, which point is 332 feet southwestwardly, measured along said southeast line, from the eastern corner of such property; thence northwestwardly, at an angle to the right of 92 degrees 41 minutes, a distance of 185.9 feet to a point, which centerline is hereinafter designated "Line A"; thence northwardly a distance of 339.5 feet along line hereinafter designated "Line B", to its point of intersection with the northeast line of said property, which point is 300.5 feet northwestwardly from the aforesaid east corner of said property, measured along the northeast line of said property. The centerline of said ten (10) foot wide easement is described as follows: Beginning at the intersection of previously described "Line A" and "Line B"; thence northwestwardly along a line with the same bearing of previously described "Line A" a distance of 267 feet 10 more or less to its intersection with the northwest line of aforesaid property of Sachs Salvage and Supply Company property, which is also the southeast line of Engleholm Avenue 35 feet wide, which point of intersection is 304.2 feet southwestwardly the north corner of such property measured along the northwest line thereof. An easement five (5) feet wide over property now or formerly of Irma Moog, et al, which property is described as follows: A part of Lot 7 of HUTCHINSON'S SUBDIVISION in U. S. Survey 2684, Township 46 North, Range 6 East, St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 8 page 119 of the records of the City (former County) of St. Louis, Missouri, and described as follows: Beginning at the intersection of the Southwest line of St. Charles Rock Road with the dividing line between Lots 6 and 7 of said Subdivision, and running thence South 34 degrees 26 minutes West, along the Southeast line of said Lot 7, 575.30 feet to the most Southern corner thereof; thence North 64 degrees 25 minutes West, along the Southwest line of said Lot 7, 303.13 feet to the most Western corner thereof; thence Northeast along the Northwest line of said Lot 7, to its intersection of the Southeast line of the Right of Way of the St. Louis Terminal Railway Company; thence Northeast, along the Southeast line of said right of way, to its intersection of the Southwest line of St. Charles Rock Road; thence South 55 degrees 34 minutes East, along the Southwest line of St. Charles Rock 11 Road, 163.26 feet to the place of beginning, according to survey executed by Wm. E. Elbring, County Surveyor, on March 22, 1911. The said easement is described as follows: An easement five (5) feet wide over the northwestwardly five (5) feet of said property and extending from Wells Avenue a distance of 530 feet northeastwardly. An easement ten (10) feet wide over property now or formerly of Joseph F. Furlong and Anna E. Furlong, his wife, which property is described as follows: A tract of land in F. W. HAMBURGER'S SUBDIVISION of Lots 25, 26 and 27 of OAK GROVE SUBDIVISION in U. S. Survey 2684 in St. Louis County, Missouri, and described as follows: Beginning at a point in the East line of Salzmann Avenue at its intersection with the North line of an alley, 16 feet wide, said point being distant 127 feet 2 inches North of the North line of St. Charles Rock Road; thence North along the East line of Salzmann Avenue, 250 feet to a point; thence East and parallel with the North line of said 16 foot alley, 123 feet to a point; thence South and parallel to the East line of Salzmann Avenue, 250 feet to a point in the North line of said alley, 16 feet wide; thence West, along the North line of said alley, 123 feet to the beginning. (Said property being formerly known as Lots 16 to 25, both inclusive, of F. W. Hamburger's Subdivision. Such ten (10) foot wide easement is described as follows: 12 An easement ten (10) feet wide over the northeast ten (10) feet of aforesaid property. An easement ten (10) feet wide over property now or formerly of Joseph Pearlman and Lillian Pearlman, his wife, which property is described as follows: Part of Lot 9 of D. A. JANUARY'S SUBDIVISION in U. S. Survey 2684, Township 46 North, Range 6 East and part of Lot 16 of the Subdivision of Thomas Hoke's Estate in U. S. Survey 2775, Township 46 North, Range 6 East, in St. Louis County, Mo. and more particularly described as follows: Beginning at a point in the South line of St. Charles Road, distant South 55 degrees 57 minutes East, 38.36 feet from the intersection of said South line with the dividing line between U. S. Surveys 2684 and 2775, said beginning point being also the most Eastern corner of parcel of land conveyed to Emil Vadner and wife by deed recorded in Book 1533 page 54 of the St. Louis County Recorder's Office; thence along the South line of St. Charles Road, South 55 degrees 57 minutes East, 299.27 feet to an iron pipe; thence South 34 degrees 3 minutes West, 385 feet to an iron pipe; thence North 85 degrees 57 minutes West, 67.30 feet to a point; thence North 0 degrees 21 minutes East, 187.97 feet to an iron pipe set in the dividing line between U. S. Survey 2684 and U. S. Survey 2775; thence North 8 degrees West, 353.39 feet to the most Southern corner of parcel so conveyed to Vadner and wife, as aforesaid; thence Northeast along the Southeast line of said Vadner parcel to the beginning, 13 according to survey executed by Elbring Surveying Company on April 5, 1938. The centerline of such ten (10) foot wide easement is described as follows: Beginning at a point in the northeasterly line of aforesaid property, which northeasterly line is also the southwesterly line of St. Charles Rock Road (60 feet wide), which point is five (5) feet westwardly from the northeast corner of said property, measured along said northeasterly line; thence southwestwardly along a line parallel with and five (5) feet westwardly from the southeastwardly line of said property a distance of 113.4 feet to a point; thence at an angle to the right of 33 degrees 37 minutes a distance of 232 feet more or less to a point in the west line of said property, which is also the east line of Wabash Railroad Company Right-of-Way, said point being also 134.2 feet north of the most southerly corner of said property, measured along said west line. An easement ten (10) feet wide over property now or formerly of Barney Rosenthal and Dorothy Rosenthal, his wife, which property is described as follows: Part of Lot 13 of THOMAS HOKE ESTATE SUBDIVISION, a Subdivision of St. Louis County, Mo. according to the plat thereof recorded in Plat Book 5 page 46 of the St. Louis City (former County) records, fronting 149.15 feet on the South line of St. Charles Rock Road, by a depth Southwardly of 163 feet to the North 14 line of Lot 1 of Fourland Place Subdivision, on which there is a width of 149.06 feet. Bounded on the East by Ferguson Avenue, West by the West line of said Lot 13, or an alley 6 feet wide. The centerline of such ten (10) foot wide easement is 22 feet northeastwardly from, measured at right angles to and parallel with, the southwestwardly line of aforesaid property, said easement being 150 feet in length, more or less. An easement ten (10) feet wide over property now or formerly of Oliver C. Laue and Verna M. Laue, his wife, which property is described as follows: Lot 28 in Block 1 of ST. CHARLES ROCK ROAD TERRACE, a Subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 24 page 45 of the St. Louis County Records. Such ten (10) foot wide easement is over the northwest ten (10) feet of such property, being 105 feet in length, more or less. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri, for the appropriation of private property as hereinbefore set out. Section Three. The immediate construction of sewers being necessary in order to protect the public health within the District constitutes an emergency within the meaning of the Plan 15 of The Metropolitan St. Louis Sewer District and this Ordinance shall take effect immediately upon its adoption. The foregoing Ordinance was adopted August 24, 1962.
