AN ORDINANCE, authorizing and directing the Executive
Director to grant to the State of Missouri, for the use of the
State Highway Commission of Missouri, the right to cross certain
sewer Rights of Way in St. Louis County, Missouri, as hereinafter
described, with a highway, and to execute an instrument giving
effect thereto upon the conditions hereinafter set out.
WHEREAS, pursuant to the Plan of The Metropolitan St.
Louis Sewer
District and by
Resolution No.
6 of the
District,
adopted July 1,
1954 and
recorded in
Book 3286, page
90 of the St.
Louis County
Records, the
District took
title for its
use and
possession to
all public
easements for

sewer and
drainage
purposes within
its area,
including those
in the County
ofSt. Louis;
and
WHEREAS, the State Highway Commission of the State of
Missouri wishes to cross certain Rights of way and sewers of this
District with a highway; and
WHEREAS, the State Highway Commission of the State of
Missouri has requested the District grant the right to so use such
Rights of Way, and the District is willing so to do;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District
does hereby grant to the State of Missouri, for the use of the
State Highway Commission the right to construct, reconstruct,
repair and maintain a highway across the following described
Rights of Way according to plans approved by District's
Engineering Department and as hereinafter set forth, subject,
however, to the following terms and reservations:
The Metropolitan St. Louis Sewer District reserves the right
to the full access to and use of such Rights of Way for sewer and

drainage purposes, including the right to construct new sewers and
appurtenances therein and to use, maintain and reconstruct the new
and existing sewers and appurtenances therein.
The State Highway Commission will, if considered reasonably
necessary by District's engineers, protect the existing sewers and
appurtenances at its cost, or, if necessary to reconstruct,
relocate or repair because of such highway use, such work will be
done at the cost of the State Highway Commission. Those portions
of Rights of Way which are involved in this grant are those
portions thereof described as follows:
A strip of land 30 feet wide, in the Northeast quarter of the
Southwest quarter of Section 3, Township 44 North, Range 5 East,
St. Louis County, Missouri, described as bounded on the North by a
line radial to the hereinafter described centerline of Interstate
Route 244 at its Station 632/70, on the South by a line 30 feet
South of and parallel to the last mentioned line, on the East by
the East right-of-way line of Interstate Route 244, described as
beginning at a point 215 feet radially East of Station 634/00 on
said centerline of Interstate Route 244, and extending Northerly
to a point 270 feet radially East of said centerline of Interstate
Route 244 at its Station 631/70, and on the West by a line
parallel to and 200 feet radially West of said centerline of
Interstate Route 244.
The above mentioned centerline is described as follows:
Beginning at Station 651/37.17 on the centerline of Interstate

Route 244, said point being the point of intersection of said
centerline with the North and South centerline of Section 33
Township 44 North, Range 5 East, St. Louis County, Missouri, and
being North 1 degree 30 minutes East 218.32 feet from the
Southeast corner of the Southwest quarter of Section 3, as
measured along the North and South centerline of Section 3; thence
North 34 degrees 08 minutes West along the centerline of
Interstate Route 244, 361.09 feet to P. T. Station 647/76.08;
thence Northwesterly along the arc of a curve to the right having
a radius of 5,729.65 feet, a distance of 664.03 feet to centerline
Station 641/12.05, being the point of intersection with the South
line of ROWE HEIGHTS, a subdivision in St. Louis County, Missouri,
according to the plat thereof recorded in Plat Book 50, page 43 of
the St. Louis County Records; thence continuing Northwesterly
along said curve to the left 842.05 feet to centerline Station
632/70 as above mentioned; thence continuing Northerly along the
arc of said curve 742.57 feet to the intersection with the
relocated centerline of Dougherty Ferry Road at Station 625/27.43.
Also a strip of land 25 feet wide, (access to the adjoining
portion of which is not restricted) in the Northeast quarter of
the Southwest quarter of said Section 3, bounded on the North by a
line perpendicular to the relocated centerline of Highland Avenue,
as hereinafter described, at its Station 7/65, on the South by a
line perpendicular to said centerline at its Station 7/90, on the
West by the existing East line of Highland Avenue, 40 feet wide,

and on the East by a line described as beginning at a point 30
feet perpendicularly East of said centerline of Highland Avenue,
at its Station 8/00 and extending Northeasterly to a point 75 feet
perpendicularly East of said centerline at its Station 6/00.
The above mentioned relocated centerline of Highland Avenue
is described as follows: From the Northeast corner of the
Northwest quarter of the Southwest quarter of Section 3, Township
44 North, Range 5 East; thence South 1 degree 09 minutes West
along the East line of said quarter section, 994 feet to Station
8/00 on the centerline of Highland Avenue; thence North 1 degree
09 minutes East on said centerline 202.98 feet to P. T. Station
5/97.02; thence Northerly along the arc of a curve to the left
having a radius of 478.34 feet, a distance of 372.64 feet to P. C.
Station 2/24.38.
Also a strip of land 25 feet wide, (access to the
adjoining portion of which is not restricted) in the Northwest
quarter of the Southwest quarter of said Section 3, bounded on the
North by a line perpendicular to the above described centerline
of Highland Avenue at its Station 7/65, on the South by a line
perpendicular to said centerline of Highland Avenue at its Station
7/90, on the East by the existing West line of Highland Avenue, 40
feet wide, and on the West by a line described as beginning at a
point 30 feet perpendicularly West of Station 8/00 on said
centerline of Highland Avenue, and extending Northwesterly to a
point 55 feet perpendicularly West of Station 7/20 on the

centerline of Highland Avenue.
A tract of land in the East half of the Southwest
quarter of said Section 3, bounded on the Southeast by a line
radial to the above described centerline of Interstate Route 244
at its Station 642/00, on the Northwest by a line radial to said
centerline of Interstate Route 244 at its Station 635/85, on the
Northeast by lines described as beginning at a point 125 feet
radially East of Station 634/90 on said centerline, and extending
Southerly and parallel to said centerline to a point 125 feet
radially East of centerline Station 637/00; thence Easterly and
radial to said centerline 25 feet to a point; thence Southerly,
parallel to said centerline, to a point 150 feet radially East of
centerline Station 639/75; thence Easterly and radial to said
centerline 20 feet to a point; thence Southerly, parallel to and
170 feet radially East of said centerline, to a point opposite Po
To Station 647/76.08, and bounded on the Southwest by lines
described as beginning at a point 200 feet radially West of
Station 632/00 on the above described centerline of Interstate
Route 244 and extending Southerly and parallel to said centerline,
to a point 200 feet radially Southwest of Station 638/00 on said
centerline of Interstate Route 244; thence Southwesterly and
radial to said centerline to a point on the existing Northeast
line of Highland Avenue, 40 feet wide; thence Southeasterly along
said existing Northeast line of Highland Avenue to a point, said
point being radially Southwest of Station 641/00 on said

centerline of Interstate Route 244; thence Northeasterly and
radial to said centerline to a point 180 feet radially Southwest
of said Station 641/00; thence Southeasterly and parallel to said
Εcenterline, to a point 180 feet radially Southwest of centerline
Station 644/50.
A tract of land in the Northeast quarter of Section 10,
Township 44 North, Range 5 East, St. Louis County, Missouri, and
described as being bounded on the Northwest by a line
perpendicular to Station 662/30 on the hereinafter described
centerline of Interstate Route 244, on the South by a line
described as beginning at a point 170 feet radially East of
Station 673/00 on said centerline, and extending Westerly to a
point 170 feet radially West of centerline Station 672/50, bounded
on the Northeast by a line parallel to and 170 feet Northeast of
said centerline, and bounded on the Southwest by lines described
as beginning at a point 150 feet perpendicularly Southwest of
centerline Station 662/30, and extending Southeasterly and
parallel to said centerline, to a point 150 feet perpendicularly
Southwest of P. C. Station 663/69.95; thence Southeasterly to a
point 140 feet radially Southwest of centerline Station 664/00;
thence Southeasterly and parallel to said centerline to a point
140 feet Southwest of centerline Station 665/50; thence Southerly
to a point 170 feet radially Southwest of centerline Station
667/00; thence Southerly and parallel to said centerline, to said
point 170 feet radially Southwest of centerline Station 672/50.

The last above mentioned centerline of Interstate Route
244 is described as beginning at Station 651/37.17, said point
being the point of intersection of the centerline of Interstate
Route 244 with the North and South centerline of Section 3,
Township 44 North, Range 5 East, St. Louis County, Missouri, and
being North 1 degree 30 minutes East 218.32 feet from the
Southeast corner of the Southwest quarter of Section 3, being also
the Northwest corner of the Northeast quarter of Section 10, as
measured along the North and South centerline of Section 3; thence
South 34 degrees 08 minutes, East along said centerline 266.26
feet to the intersection with the South line of Section 3, being
the North line of Section 10, Township, 44 North, Range 5 East at
Station 654/03.43; thence continuing South 34 degrees 08 minutes
East along said centerline 208.14 feet to the intersection with
the existing Southeast line of the Missouri Pacific Railroad
right-of-way, 100 feet wide, at Station 656/11.57; thence
continuing South 34 degrees 08 minutes East 758.38 feet to P. C.
Station 663/69.95; thence Southeasterly along the arc of a curve
to the, right having a radius of 2864.93 feet, a distance of
1,582.50 feet to P. T. Station 679/52.45.
Section Two. The Executive Director is hereby
authorized and directed to execute in behalf of the District an
instrument giving effect to Section One hereof.
