HomeMy Public PortalAbout00845 O R D I N A N C E NO. 845 AN ORDINANCE calling and providing for the holding of a Special Election in the Mississippi River Subdistrict of The Metropolitan St. Louis Sewer District, for the purpose of submitting to the qualified electors thereof a proposal for the issuance of general obligation bonds of said Subdistrict to provide funds for the construction of a system of sanitary interceptor sewers and sewage disposal and treatment plants and works within and for said Subdistrict, with an emergency clause. WHEREAS, it has become necessary to provide a system of sanitary interceptor sewers and sewage disposal and treatment plants and works within and for the Mississippi River Subdistrict of The Metropolitan St. Louis Sewer District; and WHEREAS, the Board of Trustees of the said Metropolitan St. Louis Sewer District has heretofore caused a hearing to be held on the aforesaid proposed improvements and has caused an estimated cost thereof to be prepared by competent engineers; and WHEREAS, the said Board does now find and determine that the cost of constructing the contemplated improvements, as shown by the estimate made by competent engineers, as aforesaid, is Ninety-Five Million, ($95,000,000) Dollars; and WHEREAS, under the plan of The Metropolitan St. Louis Sewer District, the funds required as aforesaid may be obtained through the issuance of general obligation bonds of the aforesaid Subdistrict, provided the proposition to issue such bonds be assented to by two-thirds of the qualified electors of said Subdistrict voting thereon at an election held for that purpose, and provided the amount of indebtedness so incurred, together with all other indebtedness of the Subdistrict, does not exceed the constitutional limit of five per centum (5%) of the assessed valuation of taxable, tangible property within the subdistrict, as ascertained by the last completed assessment for state and county purposes on the date of such election; and WHEREAS, the assessed valuation for state and county purposes of the taxable, tangible property within said Subdistrict, as ascertained by the last completed assessment, made as of January 1, 1961, is Two Billion, Nine Hundred Sixty-seven Million, Seven Hundred Ninety-two Thousand, Two Hundred Three ($2,967,792,203) Dollars; and WHEREAS, the aforesaid Subdistrict at this time has no outstanding indebtedness of any kind or character; and WHEREAS, the amount of indebtedness hereinafter proposed to be incurred will not exceed five per centum (5%) of the assessed valuation of taxable, tangible property in the said Subdistrict, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. That a special election be and the same is hereby called and ordered to be held within the boundaries of the Mississippi River Subdistrict of The Metropolitan St. Louis Sewer District on Tuesday, the 6th day of November, 1962, for the purpose of submitting to the qualified electors of said Subdistrict the following proposition: PROPOSITION Shall the general obligation bonds of the Mississippi River Subdistrict of The Metropolitan St. Louis Sewer District 2 be issued in the amount of Ninety-Five Million ($95, 000, 000.00) Dollars to provide funds for the purpose of constructing a system of sanitary interceptor sewers and sewage disposal and treatment plants and works for said Subdistrict, including all expenses necessarily incidental thereto? Section Two. That said special election shall be held and conducted by the Boards of Election Commissioners for the City of St. Louis and for St. Louis County, within their respective jurisdictions, under the General Election laws governing the election of State and County officers. The polls of said election shall be opened at the hour of 6:00 o' clock A.M. Central Standard Time and shall remain open until the hour of 7:00, o'clock P.M. Central Standard Time on the aforesaid date. Section Three. That the ballots to be used at said special election shall be in substantially the following form, with appropriate adaptations for use on voting machines where such machines may be used, to wit: OFFICIAL BALLOT MISSISSIPPI RIVER SUBDISTRICT OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT, STATE OF MISSOURI SPECIAL BOND ELECTION Tuesday, November 6, 1962 PROPOSITION Shall the general obligation bonds of the Mississippi River Subdistrict of The Metropolitan St. Louis Sewer District be issued in the amount of Ninety-Five Million ($95,000,000.00) Dollars to provide funds for the purpose of constructing a system of sanitary interceptor sewers and sewage disposal and treatment plants and works for said Subdistrict, including all expenses necessarily incidental thereto? . . . . . . FOR THE BOND ISSUE . . . . . . . . . . . . AGAINST THE BOND ISSUE . . . . . . 3 (Voters shall vote by placing a cross mark (x) opposite their choice. A cross mark (x) in the square before the words "FOR THE BOND ISSUE" shall be counted as a vote for the issuance of the bonds, and a cross mark (x) in the square before the words "AGAINST THE BOND ISSUE" shall be counted as a vote against the issuance of the bonds.) Section Four. That the Secretary-.Treasurer be and he is hereby directed to give notice of said special election by advertisement published once a week for at least three (3) consecutive weeks in the St. Louis Globe-Democrat and in the St. Louis Post-Dispatch, newspapers of general circulation in The Metropolitan St. Louis Sewer District, the first publication in each of said newspapers to be made at least twenty-one (21) days prior to the date of the election and the last publication to be made not more than seven (7) days prior to the date of said election. The said notice shall be in substantially the following form, to wit: NOTICE OF SPECIAL ELECTION MISSISSIPPI RIVER SUBDISTRICT OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT, STATE OF MISSOURI Notice is hereby given to the qualified electors of the Mississip-pi River Subdistrict of The Metropolitan St. Louis Sewer District, State of Missouri, that a special election will be held in said Subdistrict on Tuesday, the 6th day of November, 1962, commencing at 6:00 o'clock A. M. Central Standard Time and closing at 7:00 o'clock P. M. Central Standard Time on said date, and that at said special election the following proposition will be submitted to the qualified electors of said Subdistrict: PROPOSITION Shall the general obligation bonds of the Mississippi River Subdistrict of The Metropolitan St. Louis Sewer District be issued in the amount of Ninety-Five Million ($95,000,000.00) Dollars to provide funds for the purpose of constructing a system of sanitary interceptor sewers and sewage disposal and treatment plants and works for said Subdistrict, including all expenses necessarily incidental thereto? The qualified electors of the Mississippi River Subdistrict of The Metropolitan St. Louis Sewer District shall vote on the aforesaid proposition at the same polling places as designated by the Boards 4 of Election Commissioners for the City of St. Louis and for St. Louis County, within their respective jurisdictions, for the holding of the General Election in said City and County on aforesaid date. By order of the Board of Trustees of The Metropolitan St. Louis Sewer District, this 27th day of September, 1962. Charles Clardy Secretary-Treasurer Section Five. That, as provided by Section 10.010 of the Plan of The Metropolitan St. Louis Sewer District, the said special election shall be held and conducted and the returns thereof made, examined, and cast up in the same manner and in all respects as provided by law for the election of state and county officers. All registered voters residing within said Subdistrict shall be entitled to vote at said election. Section Six. That the Secretary-Treasurer of this Board shall be and he is hereby directed to file a certified copy of this ordinance with the Boards of Election Commissioners for the City of St. Louis and for St. Louis County, Missouri, as and for the warrant and authority of the said Boards to hold and conduct the special election herein provided for; and the said Boards of Election Commissioners are hereby requested to do all things and take all proceedings necessary to the holding and conducting of the said special election. Section Seven. That all ordinances or parts of ordinances which in any manner conflict with the provisions of this ordinance shall be and the same are hereby repealed, insofar as they may so conflict. Section Eight. That because no adequate system of sanitary interceptor sewers and sewage disposal and treatment plants and works now serves the Mississippi River Subdistrict, as established by Ordinance No. 775, and because the health of the inhabitants of said Subdistrict is endangered by existing conditions resulting from the absence of an adequate system of sanitary interceptor sewers and sewage disposal and treatment plants and works, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its enactment. The foregoing Ordinance was adopted September 27, 1962.
