HomeMy Public PortalAbout00848 O R D I N A N C E NO. 848 AN ORDINANCE, repealing Ordinance No. 821 as adopted August 24, 1962, and enacting a new ordinance in lieu thereof amending Section Two of Ordinance No. 593 and thereby revising the boundaries of Subdistrict No. 149 (Mimosa and Teakwood) of The Metropolitan St. Louis Sewer District. WHEREAS, through clerical error a lot of ground which is benefited by the sewer improvement in Subdistrict No. 149 (Mimosa and Teakwood) was inadvertently eliminated by Ordinance No. 821, amending Section Two of Ordinance No. 593, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. Ordinance No. 821, as adopted August 24, 1962, is hereby repealed. Section Two. Ordinance No. 593, adopted July 10, 1961, is hereby amended by eliminating from the boundaries of Subdistrict No. 149 (Mimosa and Teakwood), as set forth in Section Two thereof, the area described as follows: 1. Beginning at a point, said point being the northwest corner of Lot 57 in Sappington Acres Estates as recorded in Plat Book 63 on Pages 4 and 5 of the St. Louis County Records; thence southwardly along the west line of said Lot 57 and continuing along the southern prolongation of said west line to the center- line of Teakwood Drive; thence westwardly and southwestwardly along said centerline of Teakwood Drive to its intersection with the southeastern prolongation of the southwestern line of Lot 63 2 in said Sappington Acres Estates; thence northwestwardly along said prolongation and along the southwest line of said Lot 63 to the southwest corner thereof; thence northwardly along the west line of said Lot 63 to the northwest corner thereof; thence eastwardly along the north line of Lots 63, 62, 61, 60, 59 and 58 in said Sappington Acres Estates to the point of beginning; 2. Beginning at a point, said point being 110 feet south of the northeast corner of Section 29, Township 44 North, Range 6 East of the 5th principle meridian, and on the east line of said Section 29 in St. Louis County, Missouri; thence southwestwardly to a point being 375 feet south of the north line and 312 feet west of the east line of said Section 29; thence westwardly on a line 375 feet south of and parallel to the north line of said Section 29 to a point 681 feet west of the east line of said Section 29; thence southwardly on a line parallel to and 681 feet west of the east line of said Section 29 to its intersection with the centerline of Lindbergh Boulevard; thence along said center- line of Lindbergh Boulevard N 75o 46' W. to its intersection with the southward projection of the east line of property now or formerly owned by John P. Schmitt as recorded in Deed Book 4435 on Page 432 of the St. Louis County Records; thence northwardly along said projection and along said east line of Schmitt property to the northeast corner thereof; thence eastwardly along the eastern prolongation of the north line of said Schmitt property to its intersection with a line parallel with and 175 feet east of the 3 east line of Sappington Acres Estates as recorded in Plat Book 63, Pages 4 and 5 of the St. Louis County Records; thence northwardly along said parallel line to its intersection with a line parallel with and 175 feet south of the north line of said Section 29; thence eastwardly along said parallel line to a point 150 feet west of the east line of said Section 29; thence northeastwardly along a straight line to the point of beginning, for the reason that the Board of Trustees finds that such property would not be benefited by the proposed sewer facilities to be constructed in such subdistrict. Section Three. Section Two of said Ordinance No. 593, as hereby amended, shall read as follows: "Section Two. The boundaries of Subdistrict No. 149 (Mimosa and Teakwood) shall be as follows: (SEE NEXT PAGE) 4 MIMOSA & TEAKWOOD Beginning at a point, said point being 110 feet south of the northeast corner of Section 29, Township 44 North, Range 6 East of the 5th principle meridian, and on the east line of said Section 29 in St. Louis County, Missouri; thence southwestwardly to a point being 175 feet south of the north line and 150 feet west of the east line of said Section 29; thence westwardly on a line 175 feet south of and parallel to the north line of said Section 29 to a point 175 feet east of the east line of Sappington Acres Estates, as recorded in Plat Book 63 on Pages 4 and 5 of the St. Louis County Records; thence southwardly on a line parallel to and 175 feet east of the east line of said Sappington Acres Estates to its intersection with the eastern prolongation of the north line of property now or formerly owned by John P. Schmitt, as recorded in Deed Book 4435 on Page 432 of the St. Louis County Records; thence westwardly along said prolongation to the northeast corner of said Schmitt property; thence southwardly along the east line of said Schmitt property and continuing along the southern prolongation of said east line to the centerline of Lindbergh Boulevard; thence along the centerline of Lindbergh Boulevard N 75o 46' W to its intersection with the southward projection of the west line of said Sappington Acres Estates Subdivision; thence northwardly along said projection and along said west line to its intersection with the south line of Lot 35 of Sappington Acres 5 Subdivision, as recorded in Plat Book 33 on Page 36 of the St. Louis County Records; thence eastwardly along said south line to the southeast corner of said Lot 35; thence northwardly along the east line of said Sappington Acres Subdivision to the northeast corner of Lot 33 in said subdivision; thence northeastwardly in a straight line to a point, said point being the intersection of the northern prolongation of the west line of Lot 70 in said Sappington Acres Estates Subdivision with a line parallel with and 150 feet north of the north line of said Sappington Acres Estates Subdivision; thence eastwardly along said parallel line to its intersection with the northern prolongation of the west line of Lot 67 in said subdivision; thence southwardly along said prolongation to the north line of said Sappington Acres Estates Subdivision; thence eastwardly along the north line of said subdivision to the southwest corner of Lot 63 in said Sappington Acres Estates; thence southeastwardly along the southwest line of said Lot 63 and continuing along the southeastern prolongation of said southwest line to the centerline of Teakwood Drive; thence northeastwardly and eastwardly along said centerline of Teakwood Drive to its intersection with the southern prolongation of the west line of Lot 57 in said subdivision; thence northwardly along said prolongation and along the west line of said Lot 57 to the northwest corner thereof; thence eastwardly along the north line of Lot 57 to its intersection with a line parallel with and 265 feet west of the east line of Section 20 of said Township 44 6 North, Range 6 East, said 265 feet being measured perpendicular to said east line; thence northwardly along said parallel line to its intersection with a line parallel with and 150 feet north of the north line of said Sappington Acres Estates Subdivision, said 150 feet being measured perpendicular to said north line; thence eastwardly along the last mentioned parallel line and along the eastern prolongation of said parallel line to the east line of said Section 20; thence southwardly along the east line of said Section 20 and along the east line of said Section 29 to the point of beginning. The foregoing Ordinance was adopted September 27, 1962.
