AN ORDINANCE, receiving into the Operating Funds of the
Maline Creek Trunk Subdistrict the sum of Eighty-five Thousand Six
Hundred Dollars ($85,600.00); authorizing the acceptance for such
funds of the additional sum of Three Thousand Seven Hundred and
Fifty Dollars ($3,750.00); and appropriating the sum of One
Hundred One Thousand Five Hundred Dollars ($101,500.00) from the
unappropriated balance in the Operating Funds of the Maline Creek
Trunk Subdistrict to the construction account therein, to be used
for the construction of a storm water sewer known as Northland
Hills No. 2 Storm Sewer Extension.
WHEREAS, thirty-two or more owners of property situated in a
watershed of the Maline Creek Trunk Subdistrict have requested
assistance in the construction of a public storm sewer to drain
their lands, and
WHEREAS, such proposal has been investigated, it has been
determined to be feasible from an engineering viewpoint to
construct an enclosed drain of adequate capacity, and it is
estimated that the cost of such improvement will not exceed One
Hundred One Thousand Five Hundred Dollars ($101,500.00), and
WHEREAS, said landowners have tendered the sum of Eighty-Five
Thousand Six Hundred Dollars ($85.600.00) and have agreed to
tender an additional sum of Three Thousand Seven Hundred and Fifty
Dollars ($3,750.00), conditioned on and as consideration for the
agreement that the project be constructed as a public improvement
and that the remainder of the estimated cost (estimated to be
$12,150.00) be paid by the Maline Creek Trunk Subdistrict, and
WHEREAS, the Board finds that such improvement is necessary
and that the acceptance of said landowner's offer is in the public
interest,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The aforesaid sum of Eighty-five Thousand Six
Hundred Dollars ($85,600.00) is hereby accepted into the Operating
Funds of the Maline Creek Trunk Subdistrict.
Section Two. The Secretary-Treasurer is hereby authorized to
accept said additional sum of Three Thousand Seven Hundred and
Fifty Dollars ($3,750.00) into the Operating Funds of the Maline
Creek Trunk Subdistrict.
Section Three. The sum of One Hundred One Thousand Five
Hundred Dollars ($10,1,500.00) is hereby set apart out of the
Operating Funds of the Maline Creek Trunk Subdistrict and
appropriated to the construction account therein to be used for
said improvement known as the Northland Hills No. 2 Storm Sewer
Extension.
Section Four. This ordinance being an appropriation
ordinance, shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted February 7, 1963.
