HomeMy Public PortalAbout00935 O R D I N A N C E NO. 935 AN ORDINANCE, repealing the proceedings for the construction of lateral sanitary sewers in Subdistrict No. 169 (Watson Woods) of The Metropolitan St. Louis Sewer District, with an emergency clause. WHEREAS, Subdistrict No. 169 (Watson Woods) was established by Ordinance No. 651, adopted November 20, 1961, and proceedings for the construction of lateral sanitary sewers therein were begun by the adoption of Resolution No. 498 on March 5, 1962 and such proceedings have progressed through the confirmation by Ordinance No. 926 of a contract for the construction of such improvement, and WHEREAS, said Resolution No. 498 provided for the holding of a public hearing within said subdistrict to afford all persons interested in such improvement an opportunity to be heard and it required further that notice of such hearing be given by publication of notice in at least one issue of a newspaper of general circulation within the District, and WHEREAS, notice of such hearing was given by other means, without publication as required, and such hearing was held on March 28, 1962, and WHEREAS, the Board of Trustees declines to ratify the proceedings taken subsequent to the adoption of said Resolution No. 498, having lost jurisdiction, and desires to reinstitute proceedings for the construction of said improvement, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. Resolution No. 498 of the Board of Trustees, adopted March 5, 1962, is hereby repealed. Section Two. All proceedings had since the adoption of said Resolution No. 498 pertaining to the construction of lateral sanitary sewers in Subdistrict No. 169 (Watson Woods) are hereby repealed, including: Resolution No. 511, adopted April 23, 1962; approval on January 11, 1963 by the Board of engineering plans and specifications for such construction; the invitation for bids published January 23, January 30, and February 6, 1963; the award of a construction contract executed February 20, 1963; Ordinance No. 926, adopted February 21, 1963, confirming said contract; and any subsequent notices on behalf of the District provided for in such contract. Section Three. An emergency is hereby declared to exist within the meaning of the Plan by reason of the necessity to reinstitute proceedings for the construction of sanitary sewers to protect the public health. Accordingly, this ordinance shall take effect immediately upon its enactment. The foregoing Ordinance was adopted April 5, 1963.
