HomeMy Public PortalAbout00941 O R D I N A N C E NO. 941 AN ORDINANCE, amending Ordinance No. 702, adopted February 19, 1962, by adding thereto a new section designated Section Three of said ordinance, providing that certain strips of ground situated in Subdistrict No. 184 (General Grant Lateral) shall not be subject to special benefit assessments for the expense of constructing sanitary sewers in such subdistrict. WHEREAS, the Board of Trustees has found that three strips of ground within the boundaries of Subdistrict No. 184 (General Grant Lateral), as such boundaries are delineated in Section Two of Ordinance No. 702, are owned and used solely as a private way for ingress to and egress from lots or parcels of ground situated outside of said Subdistrict and that such strips of ground as so used are classifiable as property which will not be benefited by the construction of sanitary sewers in such subdistrict, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. Ordinance No. 702, adopted February 19, 1962, is hereby amended by adding thereto a new section, designated Section Three thereof, reading as follows: "Section Three. The strips of ground hereinafter des- cribed, and situated within the area described in Section Two of this ordinance, are hereby classified as property which will not be benefited by the construction of sanitary sewers and such strips shall not be subject to special benefit assessments for the expense of constructing sanitary sewers in Subdistrict No. 184 (General Grant Lateral). Such strips of ground are described as follows: Strip One: A 24 foot wide strip of property now or formerly owned by Winifred Mosby as recorded in Deed Books 2466 page 148 and 4510 page 80 of the St. Louis County Records situated between the south line of property now or formerly of S. Schmidt and the north line of property now or formerly of A. W. Januchowsky. Strip Two: A 15 foot wide strip of property now or formerly owned by Oliver A. Wirthlin as recorded in Deed Books 1915 page 102 and 2068 page 222 of the St. Louis County Records, situated between the south line of property now or formerly of A. W. Januchowsky and the north line of property now or formerly of Norman Paxton. Strip Three: A 20 foot wide strip of property now or formerly of Oliver A. Wirthlin as recorded in Deed Books 1915 page 102 and 2068 page 222 of the St. Louis County Records, situated between the south line of property now or formerly of Raymond O. Boettger and the north line of General Grant Place Subdivision." The foregoing Ordinance was adopted April 5, 1963.
