AN ORDINANCE, providing for inviting bids for
construction of the Coldwater Creek Sewage Treatment Plant and for
confirmation of a contract for construction thereof.
WHEREAS, the Coldwater Creek Sewage Treatment Plant is
to be paid for with the proceeds of bonds as yet unsold, and
WHEREAS, the Board of Trustees deems it necessary to
invite bids for such work before entering into a contract for the
sale of a sufficient amount of bonds and to confirm or reject a
contract for the work after the sale of bonds, and
WHEREAS, the Board of Trustees intends that time shall
be of the essence for completion of construction once the work is
undertaken,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In addition to the requirements of
Ordinance No. 164, the contract for construction of the Coldwater
Creek Sewage Treatment Plant shall be subject to the special
conditions hereinafter provided.
Section Two. The invitation for bids for this work shall
specify a period of ninety (90) days after the date of opening the
bids within which a contract for the work shall be confirmed or
rejected by ordinance adopted by the Board of Trustees pursuant to
Section 9.040 of the Plan.
Section Three. The invitation for bids and the contract
for this work shall specify that this work is to be fully per-

formed within twenty-four (24) consecutive months after the date
fixed for commencement or within said term as it may be duly
extended because of obstruction or delay of the contractor by the
District or its agents or for cause beyond the contractor's
control; and that the contractor shall agree to pay and will pay
to the District, for each and every day of such delay beyond the
time of completion of this work, the sum of Two Hundred Dollars
($200.00) as the liquidated damages that the District will suffer
by such default and not by way of penalty, and such sum shall be
deducted as such from the payments or final balance due the
contractor.
The foregoing Ordinance was adopted April 5, 1963.
