HomeMy Public PortalAbout00990 O R D I N A N C E NO. 990 AN ORDINANCE authorizing and directing the Executive Director to grant to Union Electric Company, a Missouri Corporation, the right to construct and maintain an electric line or lines and appurtenances in and along certain District Rights of Way in St. Louis County, Missouri, as hereinafter described, and to execute an instrument giving effect thereto upon the conditions hereinafter set out. WHEREAS, Union Electric Company wishes to construct an electric line in certain Rights of Way of this District and has requested the District grant the right to so use such Rights of Way, and the District is willing so to do; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to Union Electric Company, the right to construct, reconstruct, repair and maintain an electric line or lines and appurtenances in and along the following described Rights of Way according to plans to be approved by District's Engineering Department and as hereinafter set forth, subject, however, to the following terms and reservations: The Metropolitan St. Louis Sewer District reserves the right to the full access to and use of such Rights of Way for sewer and drainage purposes, including the right to construct new sewers and appurtenances therein and to use, maintain and reconstruct the new and existing sewers and appurtenances therein. The Rights of Way which are involved in this grant are those described as follows: That strip of land of varying width granted by the St. Paul's Evangelical Church by instrument dated June 24, 1962 and recorded in Book 4860, page 398 (Daily No. 135, July 12, 1962) of the St. Louis County Records. That strip of land of varying width granted by Merrill C. Williams and wife by instrument dated June 6, 1962 and recorded in Book 4837, page 340 (Daily No. 10, June 13, 1962) of the St. Louis County Records. That strip of land of varying width granted by the Postal Employees' Country Club by instrument dated June 26, 1962 and recorded in Book 4847, page 509 (Daily No. 94, June 26, 1962) of the St. Louis County Records. Section Two. The Executive Director is hereby authorized and directed to execute in behalf of the District an instrument giving effect to Section One hereof.
