HomeMy Public PortalAbout01028 O R D I N A N C E NO. 1028 AN ORDINANCE, authorizing the Executive Director and the Secretary-Treasurer of The Metropolitan St. Louis Sewer District to purchase from the owner thereof, as the site to construct a portion of the sewage treatment works to serve the Coldwater Creek Trunk Subdistrict of The Metropolitan St. Louis Sewer District, a tract of land in St. Louis County, Missouri described as follows: A tract of land in United States Survey 210, Township 47 North, Range 7 East, St. Louis County, Missouri, and being more particularly described as follows: Beginning at the point of intersection of the eastern line of property described in deed to Thomas A. Winka and wife, recorded in Book 1900, Page 9, St. Louis County Recorder's Office, with the centerline of former Cold Water Creek; thence along the meanders of said former Cold Water Creek the following courses and distances: North 80 degrees 36 minutes West 116.72 feet, South 43 degrees 37 minutes West 88.00 feet, South 3 degrees 58 minutes West 103.70 feet and South 74 degrees 23 minutes East 173.95 feet to a line distant 35.00 feet north of the centerline of the Cold Water Creek Drainage Ditch Right-of-Way 2-A, 100 feet wide; thence along said offset line the following courses and distances: South 46 degrees 13 minutes West 221.04 feet, South 51 degrees 10 minutes West 261.47 feet and South 61 degrees 57 minutes West 370.73 feet to the western line of said Winka property; thence North 22 degrees 54 minutes West 1104.81 feet along the western line of said Winka property; thence North 73 degrees 19 1/2 minutes East 819.38 feet to the eastern line of said Winka property; thence South 31 degrees 46 minutes East 666.53 feet along the eastern line of said Winka property to the centerline of former Cold Water Creek and the point of beginning, and containing 18.977 Acres, according to a survey by Pitzman's Company of Surveyors and Engineers, Dated June 24, 1963 and revised August 22, 1963. for a total sum of Seventy-Five Thousand Nine Hundred Eight Dollars ($75,908.00), the purchase price to be paid as follows: In addition to the earnest money deposit of Five Hundred Dollars ($500.00) previously paid to Sellers there shall be paid in cash at the time of closing Eighteen Thousand Four Hundred Seventy-Seven Dollars ($18,477.00). The balance of Fifty- Six Thousand Nine Hundred Thirty-One Dollars ($56,931.00) shall be paid in three equal annual installments, without interest, with the first installment of Eighteen Thousand Nine Hundred Seventy- Seven ($18,977.00) due August 30, 1964, and the second installment of Eighteen Thousand Nine Hundred Seventy-Seven ($18,977.00) due on August 30, 1965, and the last installment of Eighteen Thousand Nine Hundred Seventy-Seven ($18,977.00) due on August 30, 1966, and authorizing the Executive Director and the Secretary-Treasurer to execute any note, deed of trust or any other agreement or in- strument necessary or proper to carry out the terms of this purchase of property, and containing an emergency clause. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and the Secretary- Treasurer of The Metropolitan St. Louis Sewer District shall be and are hereby authorized and directed to purchase from the owner thereof, as the site to construct a sewage treatment plant to serve the Coldwater Creek Trunk Subdistrict of The Metropolitan St. Louis Sewer District, a tract of land in St. Louis County, Missouri described as follows, to wit: A tract of land in United States Survey 210, Township 47 North Range 7 East, St. Louis County, Missouri, and being more particularly described as follows: Beginning at the point of intersection of the eastern line of property described in deed to Thomas A. Winka and wife, recorded in Book 1900, Page 9, St. Louis County -2- Recorder's Office, with the centerline of former Cold Water Creek; thence along the meanders of said former Cold Water Creek the following courses and distances: North 80 degrees 36 minutes West 116.72 feet, South 43 degrees 37 minutes West 88.00 feet, South 3 degrees 58 minutes West 103.70 feet and South 74 degrees 23 minutes East 173.95 feet to a line distant 35.00 feet north of the centerline of the Cold Water Creek Drainage Ditch Right-of-Way 2-A, 100 feet wide; thence along said offset line the following courses and distances: South 46 degrees 13 minutes West 221.04 feet, South 51 degrees 10 minutes West 261.47 feet and South 61 degrees 57 Minutes West 370.73 feet to the Western line of said Winka property; thence North 22 degrees 54 minutes West 1104.81 feet along the western line of said Winka property; thence North 73 degrees 19 1/2 minutes East 819.38 feet to the eastern line of said Winka property; thence South 31 degrees 46 minutes East 666.53 feet along the eastern line of said Winka property to the centerline of former Cold Water Creek and the point of beginning, and containing 18.977 Acres, according to a survey by Pitzman's Company of Surveyors and Engineers, Dated June 24, 1963 and revised August 22, 1963. Section Two. Upon the execution and delivery to them by the said owner of a warranty deed in proper form, being free from liens and encumbrances, conveying fee simple title to the said land to The Metropolitan St. Louis Sewer District, the Executive Director and the Secretary-Treasurer shall be and are hereby authorized and directed to pay to the said owner, for the said land, the total sum of Seventy-Five Thousand Nine Hundred Eight Dollars ($75,908.00) as follows: In addition to the earnest money deposit of Five Hundred Dollars ($500.00) previously paid to Sellers there shall be paid in cash at the time of closing Eighteen Thousand Four Hundred Seventy-Seven Dollars ($18,477.00). The Executive Director and the Secretary-Treasurer are further authorized to execute any note, deed of trust or any other instrument necessary or proper to carry out the terms of this purchase of property. Section Three. The purchase of this property being a necessity to properly carry out the functions of this District and the necessity for acquiring this property immediately for its program of water pollution abatement and in particular, to construct the Coldwater Creek Treatment Plant constitutes an emergency within the meaning of the Plan and this Ordinance shall therefore take effect immediately upon its enactment.
