HomeMy Public PortalAbout01045 O R D I N A N C E NO. 1045 AN ORDINANCE, repealing Ordinance No. 1034, adopted September 16, 1963, levying special benefit assessments in Subdistrict No. 139 (Olive Crest), and amending Ordinance No. 553, adopted May 18, 1961, by adding thereto a new section designated Section Three of said Ordinance, providing that certain strips of ground situated in Subdistrict No. 139 (Olive Crest) shall not be subject to special benefit assessments for the expense of constructing sanitary sewers in such Subdistrict, with an emergency clause. WHEREAS, the Board of Trustees has found that certain strips of ground within the boundaries of Subdistrict No. 139 (Olive Crest), as such boundaries are delineated in Section Two of Ordinance No. 553, are owned and used solely as public or private ways for ingress to and egress from various lots or parcels of ground in said Subdistrict and that such strips of ground as so used are classifiable as property which will not be benefited by the construction of sanitary sewers in such subdistrict, and WHEREAS, in order to effectuate such change in the aforesaid Subdistrict No. 139 (Olive Crest) Ordinance No. 1034, adopted September 16, 1963, levying special benefit assessments against all of the land benefited by the construction of sewers within the aforesaid Subdistrict, should be repealed, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: 2 Section One. Ordinance No. 1034, adopted September 16, 1963, is hereby repealed. Section Two. Ordinance No. 553, adopted May 18, 1961, is hereby amended by adding thereto a new section, designated Section Three thereof, reading as follows: "Section Three. The strips of ground hereinafter described, and situated within the area described in Section Two of this ordinance, are hereby classified as property which will not be benefited by the construction of sanitary sewers and such strips shall not be subject to special benefit assessments for the expense of constructing sanitary sewers in Subdistrict No. 139 (Olive Crest). Such strips of ground are described as follows: Strip One: Various private roads lying within an area known as "Colonial Hills" in the City of Creve Coeur, St. Louis County, Missouri, and described as follows: a) A 60 foot wide strip of land known as "Colonial Hills Parkway", as established by instruments recorded in Book 1397 page 509 and Book 1429 page 360 of the St. Louis County Records, such road extending from Spoede Road westwardly approximately 1080 feet. b) A 20 foot wide strip of land established as a private road by instrument recorded in Book 1596 Page 535 of the St. Louis County Records and extending from a point in the southern line of Lot 1, Olive Crest First Addition Subdivision southwardly a distance of approximately 475 feet. 3 c) A 16 foot wide strip of land established as the north-south portion of a private road by instrument recorded in Book 1783 page 63 of the St. Louis County Records, and extending from a point in the southern boundary of Lot 10, Sona Lane Subdivision southwardly, southeastwardly and southwardly to the private road 60 feet wide known as "Colonial Hills Parkway". d) Those portions only of the private east-west road 20 feet wide established by instrument recorded in Book 1783 Page 63 of the St. Louis County Records, which portions lie in property now or formerly of Alan T. Smith and wife, as per instrument recorded in Book 2816 page 264; of property now or formerly of St. Clair Automobile Finance Company as per instrument recorded in Book 4863, page 560; of property now or formerly or Donald S. Ellis and wife, as per instrument recorded in Book 4637 page 54; of property now or formerly of Burton W. Duenke Building Company as per instrument recorded as Daily No. 48, December 6, 1957; of property now or formerly of Ronald M. Merkadeau and wife, as per instrument recorded in Book 4965 page 496; and of property now or formerly of Fred G. Bentrup and wife, as per instrument recorded as Daily No. 20, December 9, 1954. e) A strip of land 20 feet wide, a portion of which was established by the deed to Burton W. Duenke Building Company recorded as Daily No. 48, December 6, 1957 in the St. Louis County Recorder's Office, which portion lies south of the private road 20 feet wide established by instrument recorded in Book 1783 page 63 4 of the St. Louis County Records, and the remaining portion of which is the ten (10) foot wide strip described in deed to James P. O'Haire and wife, recorded as Daily No. 124, April 15, 1955 in the St. Louis County Recorder's Office, which 10 foot wide strip is further described as extending from the center line of the private road known as "Colonial Hills Parkway" northwardly a distance of 263.69 feet. Strip Two: A 40 foot wide strip of land known as "Larkin Avenue", and a 15 foot wide strip of land known as "The Lane", private roads of Olive Crest, a subdivision of St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 13 page 42 of the St. Louis County Records. Strip Three: A 50 foot wide strip of land, together with corner roundings and cul-de-sac, known as "Mission Lane", a private road of Mission Hills, a subdivision of St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 59 page 36 of the St. Louis County Records. Strip Four: A 50 foot wide strip of land, together with corner roundings and cul-de-sac, known as "Ramblewood Lane", a private Road of Ramblewood, a subdivision of St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 59 page 58 of the St. Louis County Records. Strip Five: That portion of the following described strip of land which lies within the boundaries of Subdistrict No. 139 (Olive Crest): A fifty (50) foot wide strip of land known as 5 "Gas-Light Square", a private road of Gas-light Square, a subdivision of St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 104, pages 18 and 19 of the St. Louis County Records. Strip Six: That portion of the following described strip of land which lies within the boundaries of Subdistrict No. 139 (Olive Crest): a strip of land of varying widths, known as "Spoede Hills Drive", a private road of Spoede Hills, a subdivision of St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 54, page 26 of the St. Louis County Records. Section Three. The completion and acceptance of the said improvement and the immediate need for the issuance and delivery of said Special Tax Bills in payment thereof create an emergency within the meaning of the Plan and this Ordinance shall be in full force and effect from and after its passage. 6 The foregoing Ordinance was adopted October 4, 1963.
