O R D I N A N C E NO. 1050
AN ORDINANCE, repealing Ordinance No. 1031, adopted
September 16, 1963, levying special benefit assessments in
Subdistrict No. 86 (Scottdale), and amending Ordinance No. 784,
adopted July 20, 1962, as amended by Ordinance No. 851, adopted
October 15, 1962 and by Ordinance No. 1030, adopted September 16,
1963, by adding thereto a new section designated Section Five of
said ordinance, providing that certain strips of ground situated
in Subdistrict No. 86 (Scottdale) shall not be subject to special
benefit assessments for the expense of constructing sanitary
sewers in such subdistrict, with an emergency clause.
WHEREAS, the Board of Trustees has found that certain
strips of ground within the boundaries of Subdistrict No. 86
(Scottdale) as such boundaries are delineated in Section Three of
Ordinance No. 784, are owned and used solely as public or private
ways for ingress to and egress from various lots or parcels of
ground within said Subdistrict and that such strips of ground as
so used are classifiable as property which will not be benefited
by the construction of sanitary sewers in such subdistrict, and
WHEREAS, in order to effectuate such change in the
aforesaid Subdistrict No. 86, Ordinance No. 1031, adopted
September 16, 1963, levying special benefit assessments against
all of the land benefited by the construction of sewers within the
aforesaid Subdistrict, should be repealed,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES

OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. Ordinance No. 1031, adopted September 16,
1963, is hereby repealed.
Section Two. Ordinance No. 784, adopted July 20,
1962, as amended, is hereby amended by adding thereto a new
section, designated Section Five thereof, reading as follows:
"Section Five. The strips of ground hereinafter
described, and situated within the area described in Section Three
of this ordinance, are hereby classified as property which will
not be benefited by the construction of sanitary sewers and such
strips shall not be subject to special benefit assessments for the
expense of constructing sanitary sewers in Subdistrict No. 86
(Scottdale). Such strips of ground are described as follows:
Strip One: That portion of a 30 foot wide strip of
land lying in Subdistrict No. 86 (Scottdale), known as "Circle
Drive", or Circle Avenue", a 30 foot wide strip of land known as
Wallace Avenue" or Winfred Avenue", and that portion of a 30 foot
wide strip of land lying in aforesaid Subdistrict No. 86 known as
"Orchard Avenue", all private roads of Jennings Oak Park, a
subdivision of St. Louis County, Missouri, according to the plat
thereof recorded in Plat Book 24 page 16 of the St. Louis County
Records.
Strip Two: That portion of a 50 foot wide strip of
land lying in Subdistrict No. 88 known as "Glade Avenue", a
private road of Ben Avis Park, a subdivision of St. Louis County,

Missouri, according to the plat thereof recorded in Plat Book 3
page 34 of the St. Louis County Records.
Strip Three: That portion of a 20 foot wide strip of
land lying in Subdistrict No. 86 known as "Lucas-Hunt Road", which
portion lies between the Northwestern line of U.S. Survey 1913 and
the Northwestern line of Jennings Oak Park Subdivision, and that
aforesaid 30 foot wide strip of land known as "Lucas-Hunt Road"
shown as "Street 30'W" according to the plat of Blewett Park, a
subdivision of St. Louis County, Missouri, according to the plat
thereof recorded in Plat Book 18 page 38 of the St. Louis County
records.
Strip Four: That portion of a 50 foot wide strip of
land lying in Subdistrict No. 86 known as "Glendale Avenue", a
private road of Hord's Subdivision, a subdivision of St. Louis
County, Missouri, according to the plat thereof recorded in Plat
Book 7 page 78 of the St. Louis County Records.
Strip Five: A 50 foot wide strip of land known as
"Glendale Avenue", a private road of North Woodland 2nd
Subdivision, a subdivision of St. Louis County, Missouri,
according to the plat thereof recorded in Plat Book 8 page 53 of
the St. Louis County Records, and its extension eastwardly a
distance of 567 feet.
Strip Six: A strip of land 50 feet wide known as
"Scottdale Avenue" or "Scott Avenue", a private road as shown on

the plat of North Woodland 2nd Subdivision, a subdivision of St.
Louis County, Missouri, according to the plat thereof recorded in
Plat Book 8 page 53 of the St. Louis County Records, and as shown
on the plat of North Woodland, a subdivision of St. Louis County,
Missouri, according to the plat thereof recorded in Plat Book 8
page 38 of the St. Louis County Records, and that portion thereof
lying within aforesaid Subdistrict No. 86, and being a private
road and shown on the plat of J.M. Hord Acres, a subdivision of
St. Louis County, Missouri, according to the plat thereof recorded
in Plat Book 14 page 58 of the St. Louis County Records.
Strip Seven: A strip of land 40 feet wide known as
"Victor Avenue", a private road of J.M. Hord Acres, a subdivision
of St. Louis County, Missouri, according to the plat thereof
recorded in Plat Book 14, page 58 of the St. Louis County Records.
Section Three. An emergency exists within the meaning
of the Plan, by reason of the completion of the sewer improvement
within such subdistrict and the necessity of levying assessments
for the cost. Accordingly, this ordinance shall take effect
immediately upon its enactment.
