AMENDED BY ORDINANCE NO. 1127 O R D I N A N C E NO. 1083
AN ORDINANCE, declaring the necessity for the
acquisition of easements within certain existing property within
The Metropolitan St. Louis Sewer District, for the purpose of
permitting construction of sewers therein to serve the needs of
residents on adjacent lands and authorizing the institution of
condemnation proceedings in connection therewith, with an
emergency clause.
WHEREAS, there exists within The Metropolitan St. Louis
Sewer District an area in St. Louis County, Mo. (Subdistrict No.
211, Kidder and Aliceton) in which there work and live numerous
people; and
WHEREAS, sanitary sewage gathered from such area will
have no alternative means of disposition to crossing said property
and will constitute a menace to the public health and welfare of
the general public and the residents of The Metropolitan St. Louis
Sewer District; and
WHEREAS, it is the purpose and design of The
Metropolitan St. Louis Sewer District to protect the public health
by relieving and alleviating these conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health, and
relieve the aforesaid insanitary and dangerous conditions, it is

necessary to appropriate and acquire by the exercise of eminent
domain or otherwise, easements for the use of sewers as
hereinafter set forth, together with such working space adjacent
to the rights-of-way as obtained as may be required for working
room during the construction period, and the right of ingress and
egress over the premises sought to be condemned for the access to
such easements:
An easement ten (10) feet wide over the east ten (10)
feet of Lots 9 and 10 of the Subdivision of Lot 78 of the
Mackenzie Tract, according to the plat thereof recorded in Plat
Book 9, pages 22 and 23 of the City (former County) of St. Louis
Records.
An easement five (5) feet wide over the south five (5)
feet of Lot 6 of Kidder Heights, a subdivision of St. Louis
County, Missouri according to the plat thereof recorded in Plat
Book 8 page 138 of the St. Louis County Records.
An easement ten (10) feet wide over the southern ten
(10) feet of property now or formerly of Hampton Village Realty
Company, a Missouri corporation, which property is more
particularly described as follows:
Part of Lot 7 of the Subdivision of Block 81 of the
Mackenzie Tract as per plat thereof recorded in Plat Book 9 page
22 of the St. Louis City (former County) records and described as:
Beginning at a point in the East line of Laclede Station Road
distance 194 feet 7 inches South of the intersection of the South

line of Aliceton Street with the East line of Laclede Station Road
being also the Southwest corner of property conveyed to William D.
Miller and wife by deed recorded in Book 592 page 466, thence East
along the South line of property now or formerly of Miller 260
feet to a point; thence South and parallel to the East line of
Laclede Station Road 97 feet 2 inches to a point; thence West and
parallel to the South line of said Miller property 260 feet to the
East line of Laclede Station Road, thence North along the East
line of Laclede Station Road 97 feet 2 inches to the beginning.
An easement ten (10) feet wide over the eastern ten
(10) feet of the southern 150 feet of property now or formerly of
Mike Eibert and Katie Eibert, his wife, and being part of Lot 5 of
a Subdivision of Block 78 of MACKENZIE TRACT in the County of St.
Louis, Missouri and more particularly described as: Beginning at
a stone in the South line of Rock Hill Road, distant 469.15 feet
Southeast from the Northwest corner of Lot 5 of a Subdivision of
Block 78 of the Mackenzie Tract running thence South 7 degrees 41
minutes West 328.00 feet to a stone in the North line of Alabama
Street, thence North 82 degrees 19 minutes West 64.00 feet along
the North line of Alabama Street to a point, thence North 7
degrees 41 minutes East 350.88 feet to a point in the South line
of Rock Hill Road, thence South 62 degrees 37 minutes East 67.97
feet along the South line of Rock Hill Road to the point of
beginning, containing one half acre, EXCEPTING THEREFROM that part
conveyed to St. Louis County, Missouri by instrument recorded in

Book 4095 page 356 of the St. Louis County Records,
Section Two. Counsel for The Metropolitan St. Louis
Sewer District be and is hereby authorized to institute and
prosecute an action in condemnation pursuant to the provisions of
the Plan of The Metropolitan St. Louis Sewer District and the laws
of the State of Missouri, for the appropriation of private
property as hereinbefore set out.
Section Three. The immediate construction of sewers
being necessary in order to protect the public health within the
District constitutes an emergency within the meaning of the Plan
of The Metropolitan St. Louis Sewer District and this Ordinance
shall take effect immediately upon its adoption.
