HomeMy Public PortalAbout01141 O R D I N A N C E NO. 1141 AN ORDINANCE, declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District, for the purpose of permitting construction of sewers therein to serve the needs of residents on adjacent lands and authorizing the institution of condemnation proceedings in connection therewith, with an emergency clause. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area in St. Louis County, Mo. (Subdistrict No. 50, Reavis and Vira) in which there work and live numerous people; and WHEREAS, sanitary sewage gathered from such area will have no alternative means of disposition to crossing said property and will constitute a menace to the public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health by relieving and alleviating these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health, and relieve the aforesaid insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise, easements for the use of sewers as hereinafter set forth, together with such working space adjacent to the rights of way as obtained as may be required for working room during the construction period, and the right of ingress and egress over the premises sought to be condemned for the access to such easements: Easements on strips of land 10' wide over, across, through and under a tract of land in Lots 3 and 4 of the John Sappington Estate in fractional Section 8, Township 44 North, Range 6 East, St. Louis County, Mo., and described as follows: 1.A strip of land 10' wide and approximately 470' long, the centerline of which strip is described as beginning in the north line of said factional Section 8, distant westwardly along said north line 542.33' from its intersection with the southwestern line of Rock Hill Road, 40' wide; thence southwestwardly in a straight line 470' + to a point in the north line of "Webster Downs Addition", a subdivision in St. Louis County, Mo., according to the plat thereof recorded in Plat Book 54, page 39 of the St. Louis County Recorder's Office, distant 58.63' eastwardly along said north line of "Webster Downs Addition" from the northwest corner of Lot 39 of said subdivision, the point of ending. 2.A strip of land 10' wide and approximately 185' long, and described as bounded on the north by the north line of said fractional Section 8; on the west by the eastern line of the 10' wide easement -2- firstly described herein, in "1.", above; on the south by a line parallel with and 10' southwardly from, measured at right angles to, said north line of fractional Section 8; and on the east by a line perpendicular to said north line of fractional Section 8 through a point therein distant along said north line 352.33' westwardly from its intersection with the southwestern line of Rock Hill Road, 40' wide. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri, for the appropriation of private property as hereinbefore set out. Section Three. The immediate construction of sewers being necessary in order to protect the public health within the District constitutes an emergency within the meaning of the Plan of The Metropolitan St. Louis Sewer District and this Ordinance shall take effect immediately upon its adoption.
