AN ORDINANCE authorizing the Executive Director to Quit
Claim a certain portion of a parcel of real property in St. Louis
County, Missouri, formerly of the St. Johns-Overland Sanitary
Sewer District, to the City of St. Ann, Missouri, for road
purposes, and to execute a quit-claim deed upon the conditions
herein set out.
WHEREAS, pursuant to the Plan of The Metropolitan St.
Louis Sewer District and by Resolution No. 6 of the District,
adopted July 1, 1954 and recorded in Book 3286, Page 90 of the St.
Louis County Records, the District took title for its use and
possession to a sewage treatment plant tract formerly of the St.
Johns-Overland Sanitary Sewer District; and
WHEREAS, pursuant to Ordinance No. 724, adopted March
19, 1962, this District and the St. Johns-Overland Sanitary Sewer
District simultaneously executed quit-claim deeds to the aforesaid
treatment plant property to the Athletic Boys Club of St. Louis
County, Missouri, a non-profit corporation, and such deeds were to
be and are being held by a Title Company until ninety days after
such treatment plant located thereon is abandoned and by-passed,
when such Title Company will deliver such deeds to said Club; and
WHEREAS, in order to give the City of St. Louis a clear
title to such strip of property which is to be used for road
widening purposes the Executive Director should be authorized and
directed to join with the Athletic Boys Club of St. Louis County,
Missouri in executing a quit-claim deed to the City of St. Ann the
aforesaid strip of ground.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The District does hereby Remise, Release,
and forever Quit-Claim to the City of ST. Ann for public use for
road purposes any right, title or interest in or to the following
described portion of a parcel of real property, situated in St.
Louis County, Missouri, to wit:
Beginning at a point said point being the intersection
of the eastern line of Wright Avenue, 30 feet wide, a plat of
which dedication is of record in Plat Book 15, Page 38 of the St.
Louis County Records, with a line parallel with and 15 feet south
of the northern line of property conveyed by Mary E. Frame to the
St. Johns-Overland Sanitary Sewer District by instrument dated
June 26, 1939 and recorded in Deed Book 1583, Page 266 of the St.
Louis County Records; thence south 76 degrees 52 minutes east
along said parallel line a distance of 454.92 feet to a point;
thence south 7 degrees 49 minutes west along a line parallel with
the eastern line of said Wright Avenue to its intersection with a
line parallel with and 35 feet south of the norther line of
aforesaid Sewer District property; thence north 76 degrees 52
minutes west along the last mentioned parallel line a distance of
454.92 feet to the eastern line of said Wright Avenue; thence
north 7 degrees 49 minutes east along the eastern line of Wright
Avenue to the point of beginning.
Section Two. The Executive Director is hereby
authorized and directed to join with the Athletic Boys Club of St.
Louis County, Missouri, in executing in behalf of the District a
quit-claim deed giving effect to Section One hereof. The foregoing Ordinance was adopted April 2, 1964.
