HomeMy Public PortalAbout01192 O R D I N A N C E NO. 1192 AN ORDINANCE authorizing and directing the Executive Director to grant to the State of Missouri, for the use of the State Highway Commission of Missouri, the right to cross certain sewer Rights of Way in St. Louis County, Missouri, as hereinafter described, with a highway, and to execute an instrument giving effect thereto upon the conditions hereinafter set out. WHEREAS, the State Highway Commission of the State of Missouri wishes to cross certain Rights of Way and sewers of this District with a highway, and WHEREAS, the State Highway Commission of the State of Missouri has requested the District grant the right to so use such Rights of Way, and the District is willing so to do; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to the State of Missouri, for the use of the State Highway Commission, the right to construct, reconstruct, repair and maintain a highway across the following described Rights of Way according to plans approved by District's Engineering Department and as hereinafter set forth, subject, however, to the following terms and reservations; The Metropolitan St. Louis Sewer District reserves the right to use such Rights of Way for sewer and drainage purposes, including the right to construct new sewers and appurtenances therein and to use, maintain and reconstruct the new and existing sewers and appurtenances therein. The State Highway Commission will, if considered reasonably necessary by District's engineers, protect the existing sewers and appurtenances at its cost, or, if necessary to reconstruct, relocate or repair because of such highway use, such work will be done at the cost of the State Highway Commission. Those portions of Rights of Way which are involved in this grant are situated in the Southwest Quarter of Section 22, Township 45 North, Range 5 East, St. Louis County, Missouri and more particularly described as follows: That portion of Districts Easement as heretofore acquired by said District and situated in part of Lots 4 and 5 of Clayton Hills, according to the plat thereof recorded in Plat Book 46, at page 32 of the St. Louis County Records and bounded on the West by the West line of said Lot 4, on the East by a line parallel to and 225 feet Easterly of the hereinafter described centerline of Interstate Route 244 and extending from opposite centerline Station 478-48 to opposite centerline Station 479-17, on the North by a line perpendicular to said centerline at its Station 478-48 and extending Easterly from said centerline for a distance of 225 feet and on the South by a line perpendicular to said centerline at its Station 479-17 and extending Easterly 225 feet to its point of ending. Also that portion of Districts Easement as heretofore acquired by said District and situated in part of Lot 2 of said Clayton Hills and bounded on the East by the East line of said Lot 2, on the West by a line beginning at a point 246 feet, more or less, perpendicular distance Westerly of said centerline opposite its Station 478-48 and running thence Southerly to a point 249 feet, more or less, perpendicular distance Westerly of said centerline opposite its Station 479-17, on the North by a line perpendicular to said centerline at its Station 478-48 and extending Westerly 246 feet, more or less, to its point of ending and on the South by a line perpendicular to said centerline at its Station 479-17 and extending Westerly 249 feet, more or less, to its point of ending. The centerline of said Interstate Route 244 is described as follows: Commencing at Station 476-19.70 on the centerline of said Interstate Route 244 at its -2- intersection with the North line of Clayton Hills, said Station being distant South 89 degrees 17 minutes 55 seconds East 135.80 feet from an iron pipe set at the Northeast corner of Lot 2 of said Clayton Hills; thence on the centerline of said Interstate Route 244, South 4 degrees 50 minutes 05 seconds West 228.30 feet to center line Station 478-48; thence continuing South 4 degrees 50 minutes 05 seconds West 69.0 feet to centerline Station 479-17. Section Two. The Executive Director is hereby authorized and directed to execute in behalf of the District an instrument giving effect to Section One hereof.
