AN ORDINANCE, authorizing the Executive Director and
the Secretary-Treasurer of The Metropolitan St. Louis Sewer
District to purchase certain real property in St. Louis County,
Missouri, at a price not to exceed Thirty-five Thousand Dollars
($35,000.00), to be used as the site of the West Maintenance
Division office and yard, and prescribing terms therefor, with an
emergency clause.
WHEREAS, this Division of the Maintenance Department is
now located in rented quarters in University City which are both
inadequate and somewhat unsuitable as to location and access, and
WHEREAS, the District has obtained an option on a large
tract of ideally located ground which it wishes to purchase for
such use,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and the Secretary-
Treasurer of the District are authorized to purchase free of
encumbrances at a price not to exceed Thirty-five Thousand Dollars
($35,000.00) the following real property owned in fee simple by
Marld Investment Company and situated in St. Louis County,
Missouri, to be used as the site of the West Maintenance Division
office and yard: The North part of Lot 3 of OLIVETTE INDUSTRIAL ACRES, a Subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 79 page 4 of the St. Louis County records, described as: Beginning at a point in the West line of a private road, 40 feet wide, as shown on said plat, being the Northeast corner of said Lot 3, thence West along the North line of Lot 3, 549.89 feet to the Northeast line of the Right of Way of the
Chicago, Rock Island & Pacific Railroad, 100 feet wide, said point being the Northwest corner of said Lot 3, thence Southeastwardly along said Right of Way to a point, being the Northwest corner of a part of said Lot 3 conveyed to H.B. Surkamp and wife by instrument recorded in Book 3914 page 175 of the St. Louis County Records, thence East along the North line of said Surkamp property, 391.13 feet to the West line of said private road, being the Northeast corner of said Surkamp property, thence North along the West line of said private road, 155 feet to the point of beginning, according to survey executed by Rapp & Rapp, Surveyors, on May 8, 1958.
Section Two. Upon the execution and delivery to them
by the said owner of a warranty deed in property form, being free
from liens and encumbrances, conveying fee simple title to the
said land to The Metropolitan St. Louis Sewer District, the
Executive Director and the Secretary-Treasurer shall be and are
hereby authorized and directed to pay to the said owner, for the
said land, the total sum of Thirty-five Thousand Dollars
($35,000.00) of which the option payment of One Hundred Dollars is
a part.
Section Three. The expiration September 15, 1964, of
the District's option to purchase creates an emergency within the
Plan. Accordingly, this ordinance shall take effect immediately
upon its enactment. The foregoing Ordinance was adopted September 10, 1964.
