HomeMy Public PortalAbout01215 O R D I N A N C E NO. 1215 AN ORDINANCE authorizing and directing the Executive Director to grant to the State of Missouri, for the use of the State Highway Commission of Missouri, the right to cross certain sewer Rights of Way in St. Louis County, Missouri, as hereinafter described, with a highway, and to execute an instrument giving effect thereto upon the conditions hereinafter set out. WHEREAS, the State Highway Commission of the State of Missouri wishes to cross certain Rights of Way and sewers of this District with a highway, and WHEREAS, the State Highway Commission of the State of Missouri has requested the District grant the right to so use such Rights of Way, and the District is willing so to do; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to the State of Missouri, for the use of the State Highway Commission, the right to construct, reconstruct, repair and maintain a highway across the following described Rights of Way according to plans approved by District's Engineering Department and as hereinafter set forth, subject, however, to the following terms and reservations: The Metropolitan St. Louis Sewer District reserves the right to use such Rights of Way for sewer and drainage purposes, including the right to construct new sewers and appurtenances therein and to use, maintain and reconstruct the new and existing sewers and appurtenances therein. The State Highway Commission will, if considered reasonably necessary by District's engineers, protect the existing sewers and appurtenances at its cost, or, if necessary to reconstruct, relocate or repair because of such highway use, such work will be done at the cost of the State Highway Commission. Those portions of Rights of Way which are involved in this grant are situated in St. Louis County, Missouri and are described as follows: That portion of District's easement situated in part of Ida Drive (40 feet wide) a street in Emerson Terrace, a Subdivision in Lot 16 of Lake House Farm Subdivision in Section 3, Township 45 North, Range 5 East, according to the plat thereof recorded in Plat Book 38, Page 37 of the St. Louis County Records, more particularly described as follows: All that part of said Ida Drive, bounded Southwest by the existing Northeast right-of-way line of the Missouri Pacific Railroad, Northeast by the Southwest line of Lots 17, 18, 19 and 20 of said Subdivision, West by the West line of Lot 20 prolonged Southerly, and East by a line parallel to and 150 feet perpendicular distance East of the hereinafter described centerline of Interstate Route 244. The centerline of Interstate Route 244 is described as follows: Commencing at Station 308-14.43 on the centerline of Interstate Route 244 at its intersection with the North line of Lot 5 of said Emerson Terrace, distant 15.92 feet, South 89 degrees 36 minutes 55 seconds East of the Northwest corner of said Lot 5; thence South 2 degrees 45 minutes 55 seconds East on the centerline of Interstate Route 244, 637.73 feet to Station 314-52.16, being a point on the centerline, 150 feet South 87 degrees 14 minutes 05 seconds West of the point of intersection of the East right-of-way line herein established with the Southwest right-of-way line of Ida Drive, being also the Northeast right-of-way line of the Missouri Pacific Railroad. Those portions of District's easements situated in Lots 46 thru 50 of Emerald Green Estates, according to the plat thereof recorded in Plat Book 104, Pages 20 and 21 of the St. Louis County Records, and in part of the Southwest quarter of the Northwest quarter of Section 10, Township 45 North, Range 5 East, St. Louis County, Missouri, more particularly described as follows: Beginning at a point on the existing North right-of-way line of Ladue Road, 30 feet perpendicular distance North of Station 7-00 on the -2- hereinafter described centerline of Ladue Road; thence Westerly along said existing North right-of-way line of Ladue Road to a point 30 feet perpendicular distance North of centerline Station 20-00; thence Northerly to a point 60 feet perpendicular distance North of centerline Station 20-00; thence Northeasterly to a point 565 feet perpendicular distance West of Station 354-00 on the hereinafter described centerline of Interstate Route 244; thence Northerly to a point 542.50 feet perpendicular distance West of centerline Station 351-30, Interstate Route 244; thence Easterly to a point 400 feet perpendicular distance East of centerline Station 351-30, Interstate Route 244; thence Southeasterly to a point 45 feet perpendicular distance North of centerline Station 7-00, Ladue Road; thence Southerly to the point of beginning. The centerline of Interstate Route 244, is described as follows: Commencing at Station 355-50.56 on the centerline of Interstate Route 244 at its intersection with the North line of Beacon Hill, a Subdivision in the Southwest quarter of Section 10, Township 45 North, Range 5 East, according to the plat thereof recorded in Plat Book 50, Page 39 of the St. Louis County Records, said Station being 35.35 feet North 89 degrees 50 minutes 55 seconds West of the Northeast corner of Lot 2 of said Subdivision; thence North 2 degrees 45 minutes 55 seconds West along the centerline of Interstate Route 244, 30.04 feet to Station 355-20.52, Interstate Route 244 equals Station 13-82.50, Ladue Road, which shall later be referred to as Point "A"; thence continuing North 2 degrees 45 minutes 55 seconds West, 390.52 feet to Station 351-30. The centerline of Ladue Road is described as follows: Commencing at Point "A" as above described; thence South 89 degrees 50 minutes 55 seconds East, 682.5 feet to Station 7-00. Also commencing at said Point "A"; thence North 89 degrees 50 minutes 55 seconds West, 617.50 feet to Station 20-00. That portion of District's easement situated in part of Lot 1 and in Beacon Hill Lane in Beacon Hill, a Subdivision in the Southwest quarter of Section 10, Township 45 North, Range 5 East, according to the plat thereof recorded in Plat Book 50, Page 39 of the St. Louis County Records, more particularly described as follows: Beginning at a point on the existing South right-of-way line of Ladue Road, 30 feet perpendicular distance South of Station 18-20 on the hereinafter described centerline of said Ladue Road; thence Southerly to a point 60 feet perpendicular distance South of centerline Station 18-20; thence Southeasterly to a point 35 feet perpendicular distance West of Station 1-00 on the hereinafter described centerline of an Outer Road; thence Southerly to a point 35 feet perpendicular distance East of -3- centerline Station 2-03.27, Outer Road; thence Southwesterly to a point 35 feet radial distance Northwest of centerline Station 2-65, Outer Road; thence Southeasterly to a point on the existing Southeast right-of-way line of Beacon Hill Lane, 38 feet radial distance Southeast of centerline Station 2-86, Outer Road; thence Northeasterly following said existing Southeast right-of-way line of Beacon Hill Lane, to its intersection with the existing South right-of-way line of Ladue Road; thence Westerly along said existing South right-of-way line of Ladue Road, to the point of beginning. The centerline of Ladue Road is described as follows: Commencing at Station 13-45.62 on the centerline of Ladue Road, distant 30 feet North 0 degrees 09 minutes 05 seconds East of the Northeast corner of Lot 2 of Beacon Hill; thence North 89 degrees 50 minutes 55 seconds West, 398.87 feet to Station 17-44.49, Ladue Road equals Station 0-00, Outer Road, which shall later be referred to as Point "B"; thence continuing North 89 degrees 50 minutes 55 seconds West, 75.51 feet to Station 18-20. The centerline of the Outer Road is described as follows: Commencing at Point "B" as above described; thence South 2 degrees 32 minutes 55 seconds East, 203.27 feet to P. C. Station 2-03.27; thence Southwesterly along the arc of a curve to the right having a radius of 100 feet a distance of 82.73 feet to Station 2-86 Section Two. The Executive Director is hereby authorized and directed to execute in behalf of the District an instrument giving effect to Section One hereof.
