AN ORDINANCE correcting a mis-description in a sewer
easement, and removing any effect on the title of the land
erroneously burdened by such mis-description.
WHEREAS, the District has received a sewer easement
signed by Raney-Michelson Corp., dated August 26, 1957 and
recorded in Book 3864 page 252 of the St. Louis County Records,
and which easement was intended to convey to this District the
easement granted to the said Raney-Michelson Corp. by the Westover
Nursery Company by instrument dated November 21, 1957 and recorded
as Daily No. 236 on November 22, 1957 in the St. Louis County
Records; and
WHEREAS, the land intended to be so burdened lies in
Survey No. 155 St. Ferdinand Commonfields, St. Louis County, Mo.
but was erroneously described as lying in Survey 154 St.
Ferdinand Commonfields, St. Louis County, Mo.; and
WHEREAS, it is the intention of the District to negate
and remove any effect such easement may have on the property in
said Survey 154,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. That easement granted to the District by
instrument signed by Raney-Michelson Corp., dated August 27, 1957,
and recorded in Book 3864 page 252 of the St. Louis County Records
is hereby declared to be a grant of the easement conveyed by
instrument recorded as Daily No. 236, November 22, 1957 of the St.
Louis County Records, and that such easement is intended to and
does lie in aforesaid Survey No. 155, St. Ferdinand Commonfields,
St. Louis County, Mo., and was not intended to nor does it lie in
aforesaid Survey No. 154, St. Ferdinand Commonfields, in St. Louis
County, Mo., and that any legal right, title or interest in said
lands in Survey No. 154 as may have been acquired by the District
by such easement recorded in Book 3864 page 252 is hereby vacated,
but that the District's rights, title and interest to the easement
lying in said Survey No. 155 be not disturbed. The foregoing Ordinance was adopted October 12, 1964.
