HomeMy Public PortalAbout01241 O R D I N A N C E NO. 1241 AN ORDINANCE, confirming a contract with E. J. Fischer for the relocation of the lower terminus of a public sub-trunk sanitary sewer, called the Maline Creek Bissell Hills Sanitary Sewer, situated East of Bellefontaine Road at St. Cyr Road in the City of Bellefontaine Neighbors, St. Louis County, Missouri, with an emergency clause. WHEREAS, the Executive Director has proceeded under the emergency power of Section Three, Ordinance No. 164 as amended, to invite bids for emergency work, and WHEREAS, the emergency consists of a breakage of a sanitary sewer called the Maline Creek-Bissell Hills Sanitary Sewer, situated East of Bellefontaine Road at St. Cyr Road in the City of Bellefontaine Neighbors, St. Louis County, Missouri, at Maline Creek, as a result of which raw sewage flows into Maline Creek, and WHEREAS, such sewer is so situated as to obstruct the floodwater flow of Maline Creek and is continually endangered by the piling up against it of driftwood and other weighty objects, and such sewer has been continually damaged and repaired, and WHEREAS, it is deemed to be a waste of public funds to repair the present complete breakage without relocating such sewer, and WHEREAS, it is feasible in making such relocation to remove such sewer from underneath improvements of the Gustafson Nursing Hone without use of public funds because such Home has unconditionally deposited in escrow with Security Title Company $5,700.00 to be used for the project, and WHEREAS, the lowest responsible bid received by the Executive Director for the entire relocation project is in the sum of $20,057.10, of which $14,357.10 would be payable from public funds, held in the Operating Fund of the Maline Creek Trunk Subdistrict, and WHEREAS, the work consists of the laying of some 711 lineal feet of pipe, work necessarily incidental thereto, and the relocation of the connection to the public sewer system of the improvements of said Gustafson Nursing Home, and WHEREAS, the Board of Trustees finds such work necessary for the protection of the public health and deems it to be in the public interest to proceed with it at once, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The contract heretofore let by the Executive Director to E. J. Fischer as the lowest responsible bidder, for the construction of Maline Creek-Bissell Hills Sanitary Relocation of The Metropolitan St. Louis Sewer District, pursuant to bids received and opened on the 5th day of November, 1964, and formally executed on the 10th day of November, 1964 by said contractor and by the Executive Director and the Secretary- Treasurer on behalf of the District, in the following form: -2- is hereby confirmed. Section Two. The District officers are authorized to agree with Gustafson Nursing Home and its escrow agent for the use of the sum of Five Thousand Seven Hundred Dollars ($5,700.00) for part payment of the contract price for the work hereby approved and to make appropriate arrangements for the release of such sum from escrow when the construction contractor has completed performance of the contract for the work. Section Three. This Ordinance being for the confirmation of a contract for sewer construction and the sewers to be constructed being necessary for the protection of the public health, constitutes an emergency within the meaning of the Plan, and this Ordinance shall be and become effective immediately upon its adoption.
