O R D I N A N C E NO. 1287
AN ORDINANCE, establishing certain described lands as
part of the Water Pollution Control Project of the Mississippi
River Subdistrict of The Metropolitan St. Louis Sewer District,
contemplated by Ordinance No. 775, approved June 25, 1962;
containing a legal description of the aforesaid lands forming all
integral, constituent and necessary part of said Water Pollution
Control Project; authorizing and directing the Executive Director
to purchase said lands when reasonably possible, and the General
Counsel to condemn such lands when necessary, and containing an
emergency clause.
WHEREAS, the Board of Trustees of The Metropolitan St.
Louis Sewer District, pursuant to proceedings duly and lawfully
had in accordance with the provisions of its Plan, by Ordinance
No. 775, adopted on the 25th day of June, 1962, did create the
Mississippi River Subdistrict of The Metropolitan St. Louis Sewer
District; and
WHEREAS, thereafter by Ordinance No. 845, adopted on
the 27th day of September, 1962, the Board of Trustees of The
Metropolitan St. Louis Sewer District did call and provide for the
holding of a special election in the said Mississippi River
Subdistrict of The Metropolitan St. Louis Sewer District for the
purpose of submitting to the qualified electors of said
Subdistrict, the following proposition, to wit:

Proposition.
"Shall the general obligation bonds of the Mississippi
River Subdistrict of The Metropolitan St. Louis Sewer District be
issued in the amount of Ninety Five Million Dollars
($95,000,000.00) to provide funds for the purpose of constructing
a system of sanitary interceptor sewers and sewage disposal and
treatment plant and works for said subdistrict, including all
expenses necessarily incidental thereto?" and
WHEREAS, more than two-thirds of the qualified electors
voting on the aforesaid proposition, voted in favor thereof; and
WHEREAS, by reason of the aforesaid result of said
special election, the Mississippi River Subdistrict of The
Metropolitan St. louis Sewer District is now authorized and
empowered to borrow money and issue its bonds in evidence thereof,
in the sum of Ninety Five Million Dollars ($95,000,000.00) for the
purpose of constructing a system of sanitary interceptor sewers
and sewage disposal and treatment plants and works for said
subdistrict, including all expenses necessarily incidental
thereto; and
WHEREAS, it is necessary that The Metropolitan St.
Louis Sewer District acquire certain lands forming an integral,
constituent and necessary part of the Water Pollution Control
Project of the Mississippi River Subdistrict of The Metropolitan
St. Louis Sewer District;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES

OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. There shall be and is hereby established
as part of the Water Pollution Control Project of the Mississippi
River Subdistrict of The Metropolitan St. Louis Sewer District,
contemplated by Ordinance No. 775, adopted on the 25th day of
June, 1962, the following described land located in St. Louis
County, State of Missouri: A tract of land in St. Louis County, Missouri being partly in U.S. Survey 904, Township 44 North, Range 7 East and partly in Carondelet Commons, also being part of Allen's Subdivision the Chouquette Tract as recorded in Book 3 page 60 of the St. Louis County Records, and being more particularly described as follows: Beginning at a point in the Southeastern line of Broadway Blvd., 60 feet wide at its intersection with the southerly line of property conveyed to Reconstruction Finance Corporation by deed recorded in Book 2045, page 554 of the St. Louis County Records; thence along the southerly line of property conveyed to Reconstruction Finance Corporation South 31 degrees 55 minutes 30 seconds East a distance of 1506.13 to a point; thence continuing along said Southerly line South 3 degrees 17 minutes 30 seconds East a distance of 189.96 feet to a point in the center line of former Van Buren Street; thence along the center line of former Van Buren Street South 33 degrees 25 minutes West a distance of 650.76 feet to a point; thence continuing along the center line of former Van Buren Street South 21 degrees 25 minutes West a distance of 448.83 feet to a point in the Northeastern line of property now or formerly of Columbian Carbon Company; thence along said Northeastern line North 37 degrees 58 minutes 18 seconds West a distance of 227.39 feet to a point; thence along the Northwestern line of the property now or formerly of Columbian Carbon Company South 52 degrees 07 minutes 18 seconds West a distance of 597.74 feet to a point in the Southwestern line of Allen's Subdivision in the Chouquette Tract; thence North 37 degrees 51 minutes 48 seconds West along said Southwestern line a distance of 1682.15 feet to a point being the Northwest corner of Allen's Subdivision in the Chouquette Tract; thence North 35 degrees 43 minutes West a distance of 184.64 feet to a point in the Southeastern line of Broadway Blvd. 60 feet wide; thence along the Southeastern line of Broadway Blvd. North 53

degrees 51 minutes 45 seconds East a distance of 1614.42 feet to a point; thence continuing along the Southeastern line of Broadway Blvd. North 41 degrees 11 minutes 30 seconds East a distance of 247.41 feet to the point of beginning.
Section Two. The Executive Director shall be and is
hereby authorized and directed to purchase said lands when
reasonably possible, and the General Counsel to condemn such lands
in accordance with the Plan of The Metropolitan St. Louis Sewer
District and the laws of the State of Missouri, for the
appropriation of private property, when necessary.
Section Three. The immediate construction of a system
of sanitary interceptor sewers and sewage disposal and treatment
plants and works for said subdistrict is necessary in order to
protect the public health and constitutes an emergency within the
meaning of the Plan of The Metropolitan St. Louis Sewer District
and this Ordinance shall take effect immediately upon its
adoption.
The foregoing Ordinance was adopted February 25, 1965.
