AN ORDINANCE repealing Ordinances Nos. 1395 and 1396
adopted October 5, 1965, relating to the area subject to special
benefit assessments and the assessment of special benefits for the
sewer improvement in Subdistrict No. 22 (Forest Drive Trunk), with
an emergency clause.
WHEREAS, certain typographical errors were made in
Section Two of Ordinance No. 1395, delineating the boundaries of
Subdistrict No. 22 (Forest Drive Trunk), so that it is impossible
to issue the special tax bills authorized by Ordinance No. 1396,
and it is necessary to adopt new ordinances in lieu thereof,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. Ordinances Nos. 1395 and 1396, adopted
October 5, 1965, are hereby repealed.
Section Two. An emergency exists within the meaning of
the Plan in that the construction of sewers in Subdistrict No. 22
(Forest Drive Trunk) has been completed by the contractor but it
is impossible to issue the special tax bills in payment therefor
until the property in such subdistrict which is actually benefited
is clearly delineated. Since failure to issue such special tax
bills would constitute a deprivation of property of the
contractor, an emergency exists and accordingly this ordinance
shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted November 4, 1965.
