HomeMy Public PortalAbout01434 O R D I N A N C E NO. 1434 AN ORDINANCE declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District, for the purpose of permitting construction of sewers therein to serve the needs of residents on adjacent lands and authorizing the institution of condemnation proceedings in connection therewith, WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area in the City of St. Louis and in St. Louis County, Missouri, known as the Watkins Creek Trunk Subdistrict of The Metropolitan St. Louis Sewer District in which there work and live numerous people; and WHEREAS, sanitary sewage gathered from such area will have no alternative means of disposition to crossing said property and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health by relieving and alleviating these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OP THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve the aforesaid insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise, easements for the use of sewers as hereinafter set forth, together with such working space adjacent to the right-of-way as obtained as may be required for working room during the construction period, and the right of ingress and egress over the premises sought to be condemned for the access to such easements: An easement twenty feet wide across Lot No. 9 of the Subdivision of the Estate of Benjamin F. Watkins, Deceased, in U.S. Survey 114, in St. Louis County, Missouri, which property is now or formerly of George Graff. The centerline of the aforesaid easement is described as follows: Beginning at a point in the west line of Riverview Drive (60 feet wide) which is the point of intersection of such west line with a line parallel with and 25 feet north of the common lot line of Lots 9 and 8 of aforesaid Subdivision of the Estate of Benjamin F. Watkins, Deceased, which common lot line is also a part of the St. Louis City Limit; thence North 82 degrees 03 minutes West along aforesaid parallel line a distance of 498 feet to a point; thence, at an angle to the left of 52 degrees 09 minutes a distance of 32 feet more or less to its intersection with aforesaid common lot line of Lots 9 and 8. An easement twenty (20) feet wide across Lot 8 of the Subdivision of Benjamin F. Watkins Estate lying partly in U.S. Survey 114, St. Louis County, Missouri, and in the City of St. Louis, Missouri, which property is now or formerly of Michael Pessin. The centerline of aforesaid easement is described as follows: -2- Beginning at the point of intersection of the centerline of Coal Bank Road (40 feet wide) and the City of St. Louis Limit; thence westwardly along said centerline of Coal Bank Road a distance of 444.9 feet to a point; thence northeastwardly, at an angle to the right of 113 degrees 03 minutes, along a straight line to its point of intersection with the north line of aforesaid Coal Bank Road, being also the southern line of aforesaid Lot 8, which point of intersection is the point of beginning of the centerline of the aforesaid twenty (20) foot wide easement; thence continuing northeastwardly along said straight line to a point which is 496.85 feet from the intersection of such straight line with the aforesaid centerline of Coal Bank Road, measured along such straight line; thence northeastwardly, at an angle to the right of 26 degrees 16 minutes a distance of approximately 373 feet to its intersection with the common lot line of Lot 9 and Lot 8 of aforesaid Subdivision of Benjamin F. Watkins Estate, which common lot line is also a part of the St. Louis City Limit. An easement twenty (20) feet wide across all that part of Lot 7 of the Subdivision of the Estate of Benjamin F. Watkins, Deceased, in U.S. Survey 114 lying in St. Louis County, Missouri, excepting therefrom that part thereof conveyed to St. Louis County, Missouri, by deed recorded in Book 4291 page 422 of the St. Louis County Records, which property is now or formerly of George Graff. The centerline of aforesaid easement is described as follows: -3- Beginning at the point of intersection of the centerline of Coal Bank Road (40 feet wide) and the City of St. Louis Limit; thence westwardly along said centerline of Coal Bank Road a distance of 444.9 feet to a point; thence southwardly, at an angle to the left of 66 degrees 57 minutes, along a line which intersects the south line of said Coal Bank Road, which point of intersection is the beginning of aforesaid easement, and continuing in a straight line a distance of 103.15 feet, measured from the said centerline of Coal Bank Road, to a point; thence, on an angle to the right of 02 degrees 33 minutes, a distance of 300 feet to a point; thence westwardly at an angle to the right of 61 degrees 05 minutes, along a straight line a distance of approximately 64 feet to its intersection with the west line of aforesaid Lot 7, which point of intersection lies approximately 378 feet south of the centerline of aforesaid Coal Bank Road, measured along said west line of Lot 7. An easement twenty (20) feet wide across Lot 13 of the Subdivision of Benjamin F. Watkins Estate, a subdivision of St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 9 page 37 of the St. Louis City (former County) Recorder's Office, excepting therefrom that part thereof conveyed to St. Louis County, Missouri, by deed recorded in Book 4314 page 530 of the St. Louis County Records, which property is now or formerly of Elizabeth Grecky, widow of Maxim K. Grecky, deceased. The centerline of said easement is described as follows: -4- Beginning at a point on the southern line of aforesaid Lot 13, which point is 124 feet easterly from the southwest corner of said Lot 13, measured along the southern line thereof; thence northeastwardly, at an angle to the left of 62 degrees 40 minutes, a distance of 83 feet to a point; thence, continuing northeast- wardly at an angle to the right of 06 degrees 13 minutes, a dis- tance of 760 feet to a point; thence eastwardly, at an angle to the right of 41 degrees 15 minutes a distance of 176 feet, more or less, to its intersection with the eastern line of aforesaid Lot 13, which point of intersection lies approximately 378 feet south of the centerline of Coal Bank Road, measured along aforesaid eastern line of Lot 13. An easement twenty (20) feet wide across property now or formerly of Paul F. Blumenkamp, lying in St. Louis County, Missouri, which property is more particularly described as follows: A tract of land in U.S. Survey 114, Township 47 North, Range 7 East and being part of Lot 4 of the Subdivision of said Survey by the heirs of Isabella Chitwood, and described as follows: Beginning at a point in the North line of U.S. Highway No. 66 at the Southwest corner of property conveyed to Chas. W. Wilkinson and wife, by deed recorded in Book 3173 page 563 of the St. Louis County records; thence North 73 degrees 28 minutes East along the North line of said Highway, 253.67 feet to an iron pipe; thence North 8 degrees 00 minutes East, 193.08 feet to an iron pipe in the South line of Lot 13 of the Subdivision of the Estate of Benjamin F. Watkins, Deceased; thence North 82 degrees -5- West, along said South line, of Lot 13, 230.77 feet to a point, 88.09 feet East of the Southwest corner of said Lot 13, said point being also the Northwest corner of the aforementioned Wilkinson's property, thence South 8 degrees West 298.41 feet to the point of beginning, according to survey thereof executed by Rapp & Rapp Surveyors, in October, 1956. The centerline of said easement is described as follows: Beginning at a point in the northern line of said property, which is also a part of the common lot line of Lot 4 and Lot 13 of aforesaid Subdivision of Benjamin F. Watkins Estate, and which point is 35.91 feet east of the northwest corner of said Blumenkamp property, measured along said common lot line; thence southwestwardly in a straight line to its point of intersection with the west line of aforesaid Blumenkamp property, said point of intersection being 73 feet south of the aforesaid northwest corner thereof, measured along said west line. An easement twenty (20) feet wide across Lot 3 of Schantz Subdivision, a subdivision of St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 114 page 79 of the St. Louis County records, which property is now or formerly of Alfred J. Snyder and Irene Weiss Snyder, his wife. The centerline of said easement is described as follows: Beginning at a point in the east line of aforesaid Lot 3, distant 73 feet south of the northeast corner thereof, -6- measured along said east line; thence southwestwardly, at an angle to the right of 27 degrees 19 minutes a distance of 127 feet to a point; thence southwestwardly, at an angle to the right of 16 degrees 10 minutes, a distance of approximately 308 feet to its intersection with the northern line of Dunn Road, which is also the southern line of aforesaid Lot 3. An easement twenty (20) feet wide across property now or formerly of Edna Muehlemann Rose, Roy Muehlemann and Edwin R. Muehlemann, in St. Louis County, Missouri, in the western part of Lot 5 of the Subdivision of U.S. Survey 114 Township 47 North Range 7 East, containing 22 acres and bounded as follows: West by the Western line of said U.S. Survey 114, being the Western line of Lot 5; North by Lot 4 of said Subdivision and South by South line of Lot 5 of said subdivision and East by a line sufficiently East of the West line of said subdivision to contain an area of 22 acres; said Eastern line running from the South line of said Lot 5 North 10 degrees 44 minutes East 10.50 chains to the South line of said Lot 4. EXCEPTING THEREFROM that part thereof taken for road purposes by State of Missouri in Condemnation Proceedings in Cause #238749 of the St. Louis County Circuit Court. The centerline of said easement is described as follows: Beginning at a point in the southern right of way line of Interstate Highway 270, such point being 605 feet westward from the intersection of such right of way line and the east line of Lot 5 of aforesaid Subdivision of U.S. Survey 114 in St. -7- Louis County, Missouri, measured along said right of way line; thence southwestwardly, at an angle to the left of 57 degrees 00 minutes a distance of 200 feet to a point; thence, continuing southwestwardly, at an angle to the left of 09 degrees 30 minutes, a distance of 117 feet more or less to its intersection with the southern line of aforesaid Lot 5. An easement twenty (20) feet wide in St. Louis County, Missouri, across property now or formerly of Andrew Frisella and Frances Frisella, his wife, which property is more particularly described as follows: A tract of land in U.S. Survey 114, Township 47 North, Range 7 East, St. Louis County, Missouri, beginning at a point in the West line of said Survey 114, distant 5.30 1/4 chains North from the Southwest corner of said Survey 114, thence running South 82 degrees 19 minutes East 27.34 chains to a point; thence North 7 degrees 52 minutes East 5.31 1/4 chains to a point; thence North 82 degrees 21 minutes West 27.33 1/2 chains to a point in the West line of said Survey 114; thence along said West line of said Survey 114, South 7 degrees 55 minutes West 5.31 1/4 chains to the place of beginning, containing 14.51 acres more or less, bounded South by property now or formerly of William C. Glasgow et al. The centerline of said easement is described as follows: Beginning at a point in the common lot lines of Lots 5 and 6 of the Subdivision of U.S. Survey 114, St. Louis County, Missouri, which point is 700 feet east of the intersection of -8- such common lot line and the east line of U.S. Survey 2007, measured along said common lot line; thence South 22 degrees 14 minutes 30 seconds West a distance of 315.32 feet to a point; thence South 75 degrees 40 minutes 30 seconds West a distance of 115 feet more or less, to its point of intersection with the south line of aforesaid property of Frisella. An easement twenty (20) feet wide over property now or formerly of C.T. Wilson, which property is more particularly described as follows: A tract of land situated in the Northern part of U.S. Survey 115 and the Southern part of U.S. Survey 114, all in Townships 46 and 47 North, Range 7 East, in St. Louis County, Missouri, and described as follows: Beginning at a point being the most northern part of Lot 1 in Block 24B of GLASGOW VILLAGE UNIT NO. 10, a Subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 62 pages 22 and 23 of the St. Louis County records, thence South 54 degrees 53 minutes East, and along the Northeast line of said Lot 1, and its continuation and Lot 1 in Block 24, a distance of 240.00 feet to the most Eastern corner of said Lot 1 in Block 24, thence North 61 degrees 41 minutes East, 67.08 feet to a point, thence North 35 degrees 07 minutes East, 307.45 feet to a point, thence North 20 degrees 05- 1/2 minutes East, 1373.76 feet to a point, thence North 86 degrees 44-1/2 minutes East, 109.96 feet to a point, thence South 69 degrees 54-1/2 minutes East, 62.11 feet to a point in the Northwestern line of Lookaway Drive, thence North 20 degrees 05- 1/2 minutes East and along the Northwestern line of Lookaway -9- Drive, 328.74 feet to a point, thence North 82 degrees 16-1/2 minutes West and along the Northeast line of said Survey 115, a distance of 984.98 feet to an old stone, thence North 7 degrees 38 minutes East, 349.69 feet to an old stone, thence North 82 degrees 23 minutes West, 1804.61 feet to an old stone in the Western line of property now or formerly of Glasgow heirs, thence South 7 degrees 35 minutes West and along said Western line, 350.35 feet to a point in the Northeast line of said Survey 115, thence South 82 degrees 16-1/2 minutes East on said Survey line, 171.77 feet to a point, thence South 14 degrees 43 minutes East, 1100.61 feet to the intersection of the North line of Lot 51 in Block 22-B of Glasgow Village Unit No. 11, a Subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 65 pages 10 and 11 of the St. Louis County records; thence North 53 degrees 07-3/4 minutes East, 204.19 feet to a point, thence South 73 degrees 16-2/3 minutes East, 168.91 feet to a point, thence along a curve to the left, having a radius of 1107.29 feet a distance of 193.26 feet to a point, thence South 88 degrees 31 minutes East, 100.00 feet to a point of curve, thence along a curve to the right, having a radius of 1664.36 feet, a distance of 541.27 feet to a point, thence South 69 degrees 53 minutes East, 85.73 feet to a point, thence South 20 degrees 29 minutes East, a distance of 46.10 feet to a point, thence South 69 degrees 53 minutes East, 135.00 feet to a point in the Southeast line of Glen-Garry Road, 50 feet wide, thence South 20 degrees 7 minutes West along the Southeast line of Glen Garry Road, 2.39 feet to a point, thence South 69 degrees 53 minutes East and -10- along the Northeast line of Lot 19 in Block 24-B of Glasgow Village Unit No. 11, according to plat thereof recorded in Plat Book 65 pages 10 and 11 of said County records, 120.00 feet to a point, the most Eastern corner of said Lot 19, thence South 20 degrees 07 minutes West, and along the East line of said Unit #11, a distance of 565.20 feet to a point, thence South 32 degrees 16 minutes West, 162.00 feet to a point, thence South 43 degrees 16- 1/3 minutes West, 98.68 feet to the most Northern corner of Lot 2 in Block 24-B of Glasgow Village Unit No. 10, thence South 3 degrees 19 minutes West, 58.83 feet to the point of beginning, according to a survey made by George W. Kropp and Associates during the month of January, 1955 and containing 68.618 acres. The centerline of said easement is described as follows: Beginning at a point on the north line of aforesaid property, which is also the south line of aforesaid property now or formerly of Andrew Frisella and wife, and which point is 515 feet east of the intersection of such property line with the east line of U.S. Survey 2007, measured along such property line; thence South 75 degrees 40 minutes 30 seconds West a distance of 320 feet to a point; thence on an angle to the left of approximately 56 degrees a distance of approximately 230 feet, crossing the common line of U.S. Survey 114 and 115 at a point 172.93 feet east of the east line of U.S. Survey 2007, measured along such common survey line to a point on a west line of aforesaid property of C.T. Wilson. -11- An easement twenty (20) feet wide over property now or formerly of Leonard Fry and Loretto Fry, his wife, which property is more particularly described as follows: Lot 2 of the Subdivision of the FRY ESTATE in U.S. Survey 115 Townships 46 and 47 North Range 7 East, according to plat attached to and made part of deed recorded in Book 979 page 486 and which plat is recorded in Plat Book 26 page 36 of the St. Louis County records, containing 4.18 acres. The centerline of said easement is described as follows: Beginning at a point in the eastern line of aforesaid Lot 2, said point being 2 feet south of the northeast corner thereof, measured along said east line; thence South 18 degrees 41 minutes West a distance of 235 feet to a point; thence southwestwardly a distance of 98 feet more or less, to the point of intersection with the southern line of aforesaid Lot 2, at a point thereon distant 236 feet west of the southeast corner of said Lot 2, measured along the said southern line thereof. An easement twenty (20) feet wide over property now or formerly of Bellefontaine Country Club, which property is more particularly described as follows: Lot 5 of the Subdivision of the Fry Estate in U.S. Survey 115, Townships 46 and 47 North Range 7 East, St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 26 page 36 of the St. Louis County records, and the North part of Lot 7 of the Franz Boedefeld Estate Subdivision in U.S. Survey 115, Townships 46 and 47 North, Range 7 East, St. Louis -12- County, Missouri, according to the plat thereof recorded in Plat Book 13 page 33 of the St. Louis County records, and together described as: Beginning at an iron pipe set at the Northeast corner of said Lot 5 of the Subdivision of the Fry Estate; thence South 14 degrees 21 minutes East 664.91 feet to a point; thence North 82 degrees 11 minutes West 497.50 feet to an iron pipe; thence North 7 degrees 49 minutes East 240.0 feet to an old iron rod; thence North 62 degrees 36 minutes West 968.20 feet to an old iron rod; thence North 19 degrees 19 minutes West 92.82 feet to an iron axle; thence South 80 degrees 41 minutes East 83.39 feet to an iron pipe, thence South 0 degrees 37 minutes West 38.27 feet to an iron pipe, thence South 72 degrees 09 minutes East 79.48 feet to an iron pipe, thence North 9 degrees 35 minutes East 49.78 feet to an old stone, thence South 80 degrees 41 minutes East 1033.25 feet to the point of beginning, containing 10.087 acres, according to a survey executed by Elbring Surveying Company during the month of July 1959. The centerline of said easement is described as follows: Beginning at a point on the common lot line of Lots 5 and 4 of the aforesaid Subdivision of the Fry Estate, which is also the north line of aforesaid property of the Bellefontaine Country Club, and which point is distant 47 feet from the southwest corner of such Lot 4; thence South 34 degrees 22 minutes West a distance of 247 feet to a point; thence South 52 degrees 38 minutes West a distance of 18 feet more or less to a point in the northern line of Fry Lane (20 feet wide). -13- An easement twenty (20) feet wide over property now or formerly of Glasgow Village Development Corporation, which easement is more particularly described as follows: A tract of land situated in U.S. Survey 115, Township 46 North, Range 7 East, St. Louis County, Missouri, and being more particularly described as follows: Beginning at a point in the South line of said Survey 115, said beginning point being also the Southern line of a tract conveyed to Franz Boedefeld, and as recorded in Book 14 page 30 of the St. Louis County records, said beginning point being distant North 83 degrees West 819 feet 4-1/2 inches from the East line of said tract conveyed to Boedefeld by instrument recorded in Book 14 page 30; thence North 7 degrees East 1030 feet to a point in the Northern line of said Boedefeld tract; thence North 63 degrees 27 minutes West 561 feet 6-1/4 inches to a point; thence South 7 degrees 0 minutes West 1217 feet 9 inches to a point in the South line of said Survey 115; thence South 83 degrees 0 minutes East along said survey line, a distance of 529 feet 1 3/4 inches to the point of beginning and containing 13.65 acres, and being a tract known as Lot 6 of Franz Boedefeld Estate Subdivision. The centerline of said easement is described as follows: Beginning at a point in the west line of aforesaid property of Glasgow Village Development Corporation, which point is distant south 114 feet from the intersection of the northwardly prolongation of said western line and the north line of Fry Lane (20 feet wide); thence North 53 degrees 05 minutes -14- East a distance of 100 feet more or less to its intersection with the southern line of said Fry Lane (20 feet wide). An easement twenty (20) feet wide and an easement ten (10) feet wide over property in St. Louis County, Missouri, which property is now or formerly of Joseph Boedefeld and Anna S. Boedefeld, his wife, and being more particularly described as follows: Lot 5 of the Franz Boedefeld Estate Subdivision in U.S. Survey 115 Townships 46 and 47 North, Range 7 East, a plat of said Subdivision being recorded in Plat Book 13 page 33 of the St. Louis County Records, said Lot 5 containing 15.65 acres and bounded on the North by Lot 2 of said Subdivision conveyed to Bernard Boedefeld; on the East by Lot 6 of said Subdivision conveyed to Frank Boedefeld; on the South by the South line of said subdivision being the North line of Survey 402; on the West by Lot 4 of said Subdivision conveyed to Casper Boedefeld. The centerline of said twenty (20) foot wide easement is described as follows: Beginning at a point in the east line of aforesaid property, distant 21 feet south of the northeast corner of said property; thence southwestwardly, on an angle to the right of 45 degrees 51 minutes, a distance of 270 feet to a point; thence, southwestwardly, at an angle to the left of 25 degrees 09 minutes, a distance of 440 feet to a point; thence, southwardly, at an angle to the left of 20 degrees 24 minutes, a distance of 260 feet to a point; thence southwestwardly, at an angle to the right of 61 degrees 20 minutes, a distance of 29.75 feet to a -15- point, which is hereby denominated "Point A", and which is the intersection of the centerline of a hereinafter described ten (10) foot wide easement and such twenty (20) foot wide easement; thence continuing southwestwardly along the prolongation of the same line a distance of approximately 262 feet to its point of intersection with the west line of aforesaid property of Joseph Boedefeld and wife, at a point approximately 115 feet from the southwestern corner thereof. The centerline of aforesaid ten (10) foot wide easement is described as follows: Beginning at a point on the southern line of aforesaid property of Joseph Boedefeld and wife, which southern line is also the north line of U.S. Survey 402, said point being distant 178 feet from the southeast corner thereof; thence northwardly, at an angle to the right of 77 degrees 37 minutes a distance of 65 feet to a point; thence, on a angle to the left of approximately 34 degrees 00 minutes, a distance of approximately 254 feet to its point of intersection with the centerline of aforesaid twenty (20) foot wide easement at the point thereon hereinabove denominated "Point A". An easement twenty (20) feet wide over property now or formerly of Joseph Thiemet and Marie Thiemet, his wife, which property is more particularly described as follows: Lot 4 of the Franz Boedefeld Estate Subdivision, in U.S. Survey 115, Townships 46 and 47, North of Range 7 East, according to the plat thereof recorded in Plat Book 13, page 33 of the St. Louis County Records. -16- The centerline of said easement is described as follows: Beginning at a point in the western line of aforesaid Lot 4 at a point distant 79.75 feet north of the southwest corner thereof, measured along said western line thereof; thence, on an angle to the right of 91 degrees 18 minutes a distance of 407.57 feet to a point; thence northeastwardly, at an angle to the left of 29 degrees 40 minutes, a distance of 94 feet, more or less, to its intersection with the eastern line of aforesaid Lot 4, which point of intersection is 115 feet, more or less, from the southeast corner of said Lot 4. An easement twenty (20) feet wide and an easement ten (10) feet wide over property now or formerly of George Richard Banker, which property is more particularly described as follows: Lot 3 of the Franz Boedefeld Subdivision in U.S. Survey 115 Townships 46 and 47 North Range 7 East the plat of said Subdivision, being recorded in the St. Louis County Recorder of Deeds Office in Plat Book 13 page 33, said Lot 3 containing 13.65 acres and is bounded on the East by Lot 4 of said subdivision conveyed to Casper Boedefeld; and on the South by the South line of said subdivision and the North line of Survey 402; on the West by the West line of said subdivision property of Henry Roth and on the North by Lot 1 of said Subdivision conveyed to Theodore Boedefeld. The centerline of said twenty (20) foot wide easement is described as follows: -17- Beginning at a point on the western lot line of aforesaid Lot 3, which point is 348.6 feet south of the northwest corner of said Lot 3, measured along said western lot line; thence southeastwardly, on an angle to the left of 60 degrees 00 minutes a distance of 45 feet to a point which is hereby denominated "Point B", and which is the intersection of the centerline of a hereinafter described ten (10) foot wide easement and such twenty (20) foot wide easement; thence southeastwardly, on an angle to the right of 06 degrees 07 minutes a distance of 315 feet to a point; thence southwardly, on an angle to the right of 49 degrees 04 minutes a distance of 484.75 feet to a point of tangency with a curve to the left with a radius of 50 feet; thence along such curve to the left to its point of tangency with a line extending westwardly from the eastern line of aforesaid Lot 3, from a point in such eastern line 79.75 feet north of the southeast corner of such Lot 3; thence along such tangent line to such point of intersection with said eastern line of Lot 3. The centerline of aforesaid ten (10) foot wide easement is described as follows: Beginning at aforesaid "Point B" on the centerline of aforesaid 20 foot wide easement; thence North 15 degrees 13 minutes East a distance of approximately 369 feet to the north line of aforesaid Lot 3. An easement twenty (20) feet wide and an easement ten (10) feet wide over property now or formerly of Louis Roth and Rose Roth, his wife, which property is more particularly described as follows: -18- A tract of land in U.S. Survey 115, Townships 46 and 47 North, Range 7 East, St. Louis County, Missouri, more particularly described as follows: Beginning at a point in the South line of Survey 115 at its intersection with the East line of a 20 acre tract of land conveyed to Charles F. Hohmann by deed recorded in Book 35 page 470 and being also the West line of a tract of land conveyed to Henry Roth and wife by deed recorded in Book 286 page 15; thence North 7 degrees 06 minutes East 1482.862 feet to a point; thence North 89 degrees 56 minutes East 298 feet to an iron pipe; thence North 1 degree 23 minutes West 156.94 feet to a point in the center line of Bellefontaine Church Road; thence along the center line of said road South 82 degrees 34 minutes East 169.004 feet to a point in the West line of Franz Boedefeld Estate Subdivision; thence along the West line of said Subdivision South 1 degree 41 minutes West 983.664 feet to a point; thence South 0 degrees 03 minutes East 705.342 feet to the South line of U.S. Survey 115; thence along the said South line North 82 degrees 28 minutes West 622.38 feet to the place of beginning, containing 19 acres, more or less, according to a survey made by Richard Elbring, Surveyor during December 1915 and March 1916. EXCEPTING THEREFROM that part thereof condemned for the opening and extension of Lilac Avenue, 80 feet wide, under condemnation proceedings in the St. Louis County Circuit Court, Cause No. 224523. The centerline of aforesaid twenty (20) foot wide easement is described as follows: -19- Beginning at a point on the west line of aforesaid property, which point is 263 feet south of the intersection of such west line with the southeast line of Lilac Avenue, measured along such west line; thence eastwardly, at an angle to the left of 96 degrees 09 minutes a distance of 171 feet to a point which is hereby denominated "Point C", and which is the intersection of the centerline of a hereinafter described ten (10) foot wide easement and such twenty (20) foot wide easement; thence southeastwardly, at an angle to the right of approximately 31 degrees a distance of approximately 395 feet to a point on the eastern line of said property which eastern line is also the western line of Lot 3 of the aforesaid Boedefeld Estate Subdivision, and which point is 348.60 feet south of the northwest corner of said Lot 3. The centerline of aforesaid ten (10) foot wide easement is described as follows: Beginning at aforesaid "Point C"; thence southwestwardly a distance of 262 feet more or less to its intersection with the western line of aforesaid property of Roth at a point 738 feet northwardly from the southwestern corner thereof. An easement twenty (20) feet wide over property now or formerly of Vernon P. Neibert and Minnie Neibert, his wife, in St. Louis County, Missouri, which tract is more particularly described as follows: The Northern 10 acres of a tract of land in U.S. Survey 115 Townships 46 and 47 North Range 7 East, and more particularly -20- described as follows: Beginning at a hickory tree in the North line of U.S. Survey 115, 18.14 chains East of the Northwest corner of said survey at the East line of land conveyed by James Bissell to French Reyburn by deed recorded in Book A-6 page 234 of the records of the City (formerly County) of St. Louis, thence Eastwardly along the North line of said survey 115 to a point at such distance from said place of beginning that a line running thence Southwardly and parallel with the East line of said tract conveyed to said Reyburn as aforesaid to a point in the South line of said survey 115 shall form with said East line of said tract conveyed to Reyburn as aforesaid, a parallelogram containing just 20 acres; thence Southwardly and parallel with said East line of said tract conveyed to Reyburn as aforesaid to a point in the South line of said survey 115, thence Westwardly along the South line of said survey 115 to a point in the East line of said tract conveyed to said Reyburn as aforesaid; thence Northwardly along the East line of said tract conveyed to said Reyburn as aforesaid to said hickory tree and place of beginning; EXCEPTING THEREFROM that part conveyed to St. Louis County, Missouri according to deed recorded in Book 3883 page 638 of the St. Louis County records. The centerline of aforesaid twenty (20) foot wide easement is described as follows: Beginning at a point in the east line of said Neibert property, said point being south 263 feet from the intersection of such eastern line with the southeastern line of Lilac Avenue (80 feet wide), measured along said east line thereof; thence -21- westwardly at an angle to the right of 83 degrees 51 minutes a distance of 362 feet to a point; thence northwestwardly, at an angle to the right of 39 degrees 55 minutes a distance of approximately 191 feet to its intersection with the west line of aforesaid Neibert property excepting therefrom those portions of easement coincident with Lilac Avenue 80 feet wide. An easement ten (10) feet wide over property now or formerly of George Richard Banker in St. Louis County, Missouri, which property is more particularly described as follows: Lot 1 of the Franz Boedefeld Estate Subdivision in U.S. Survey 115 Township 46 and 47 North Range 7 East a plat of said Subdivision being recorded in St. Louis County Recorder of Deeds office in Plat Book 13 page 33, said Lot 1 containing 13.15 acres and is bounded on the North by the North line of said Subdivision and a small triangular tract of ground, on the East by Lot 2 of said subdivision conveyed to Bernard Boedefeld; on the South by Lot 3 of said subdivision conveyed to Elizabeth and by the Northwest corner of Lot 4 of said subdivision conveyed to Casper Boedefeld, on the West by the West line of said subdivision, property of Henry Roth by the Church Road and by the triangular tract of ground. The centerline of aforesaid ten (10) foot wide easement is described as follows: Beginning at the point of intersection of the south line of Lot 1 of aforesaid Boedefeld Estate, which is also the north line of Lot 3 thereof, and the centerline of a proposed 10 foot wide easement, which centerline is heretofore described as -22- beginning at a "Point B" and extending North 15 degrees 13 minutes East to its intersection with said common lot lines of Lots 1 and 3, the point of beginning thereof; thence continuing North 15 degrees 13 minutes East a distance of 185 feet to a point; thence northwestwardly, at an angle to the left of approximately 38 degrees in a straight line crossing the western line of said Lot 1 and extending to a point on the eastern line of aforesaid Lilac Avenue 27 feet north of the eastern extension of the south line of Belgrove Drive (30 feet wide). An easement ten (10) feet wide over property now or formerly of Glasgow Village Development Corporation, which property is more particularly described as follows: A tract in Glasgow Village Unit No. Eight, shown as "PARK" area, as per plat thereof recorded in Plat Book 58 pages 48 and 49 of the St. Louis County Records. The centerline of aforesaid ten (10) foot wide easement is described as follows: Beginning at a point in the north line of said property, said point being westwardly 178 feet from the most northeastern corner of said property; thence southwardly, at an angle to the left of 102 degrees 23 minutes a distance of 333 feet to a point; thence southwardly, at an angle to the right of 13 degrees 06 minutes a distance of 276.88 feet to a point; thence westwardly at an angle to the right of 57 degrees 30 minutes a distance of 58 feet to a point. An easement ten (10) feet wide over property now or formerly of C.T. Wilson, which property is more particularly -23- described as follows: Lot "A" of GLASGOW VILLAGE UNIT #14, a Subdivision in St. Louis County, Missouri as per plat thereof recorded in Plat Book 76 page 2 of the St. Louis County records. The centerline of aforesaid ten (10) foot wide easement is described as follows: Beginning at a point in the west line of aforesaid property, which point is south 191.00 feet from the northwest corner of said property; thence eastwardly, at an angle to the left of 86 degrees 02 minutes, a distance of 308 feet to a point; thence eastwardly, at an angle to the left of 08 degrees 58 minutes a distance of approximately 477 feet to a point on the east line of said property, which point is south approximately 174 feet from the northeast corner of said property, excluding therefrom that portion of said easement coincident with Lilac Avenue (80 feet wide). An easement twenty (20) feet wide over property now or formerly of Andrew Frisella and Frances Frisella, his wife, which property is more particularly described as follows: A tract of land in U.S. Survey 112, Township 47 North, Range 7 East, St. Louis County, Missouri, and described as follows: Beginning at a point in the South line of Highway #66, 150 feet wide at the Northwest corner of property conveyed to Theodore Kraichely and wife, by deed recorded in Book 2316 page 86 of the St. Louis County Records; thence along the South line of Highway #66, South 77 degrees 14 minutes East 146.25 feet to the Northwest corner of property conveyed to Daniel Kraichely by -24- deed recorded in Book 2512 page 284 of the St. Louis County Records; thence along the West line of said property of Daniel Kraichely South 7 degrees 09 minutes West 448.84 feet; thence South 88 degrees 10 minutes West 32.80 feet to a point in the West line of said property conveyed to Theodore Kraichely; thence North 6 degrees 25 minutes West 481.70 feet to the place of beginning, containing 0.931 acres, according to a survey executed by Elbring Surveying Co. EXCEPTING THEREFROM that part thereof condemned for highway purposes in Suit #238749 of the St. Louis County Circuit Court. The western line of aforesaid twenty (20) foot easement is described as follows: Beginning at the northwestern corner of aforesaid property, which is also a point in the southern and southeastern line of Interstate Highway 270; thence South 06 degrees 25 minutes East a distance of 209.59 feet to a point in the southern line of said property. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri, for the appropriation of private property as hereinbefore set out.
