The Council of the City of Medina met in regular session on Tuesday, July 18, 1989 at
7:30 P.M.
Present: Mayor, Thomas Anderson; Councilmembers, Wilfred Scherer, Anne Theis, Robert
Mitchell, Stephen Schmit; Clerk -Treasurer, Donna Roehl; Public Works Director
Jim Dillman; Police Chief, Richard Rabenort; Attorney, Ron Batty; Engineer,

1. ADDITIONAL AGENDA ITEMS
Moved by Theis, seconded by Scherer to add the following items to the agenda:
Tamarack Dr. report
Lake Independence, Eurasian water milfoil
Woodlake landfill, ash application update
Bantle Farm subdivision approval
and to remove the following from the Consent Agenda:
U.S. West, permit for Cottonwood Tr.

2. MINUTES OF JULY 5, 1989
Anne Theis asked that Dan -Bar item, page 239 include her request to write a letter to
Northern States Power regarding their late response to a power outage at Independence
Beach on June 30th.
Moved by Theis, seconded by Schmit to accept minutes of July 5, 1989 as amended.

3. MINUTES OF JULY 13, 1989
Stephen Schmit that Item 2, Page 241 regarding city parks include the information that
Medina Morningside residents contacted the Orono Lions Club requesting participation in
the cost of playground equipment for the Medina Morningside park.
Moved by Schmit, seconded by Theis to approve the minutes of July 13, 1989, as amended.

4. PUBLIC WORKS DEPARTMENT
U.S. West
Stephen Schmit stated that he had asked that the U.S. West and Minnegasco items be removed
from the consent agenda as he wanted to know where the work was being done, particularly
the Minnegasco project.
Donna Roehl stated that she could include maps of the projects with future agendas.
Moved by Schmit, seconded by Theis to adopt Resolution 89-51, approving U.S. West project
to bury cable on Cottonwood Tr.
Motion declared carried

Moved by Schmit, seconded by Mitchell to adopt Resolution 89-52, approving Minnegasco's
installation gas lines on Tamarack Dr. and from Medina Rd. to Hunter Dr. north.

City Cars
Jim Dillman asked if Council was interested in selling the 1982 Ford Fairmont and the 1985
Ford LTD, through advertizing or county auction. He stated that if sold at auction two
employees would need to work an entire day at the auction.
Moved by Theis, seconded by Scherer to advertize the two vehicles, for sale, in the news-
paper.
Motion declared carried
City Hall Sign
Jim Dillman asked if Council would consider making the following city hall
ments: Lighting the city hall sign; erecting flag poles near the sign and
expanding the parking lot and installing outside receptacles for police
of the building.
Moved by Theis, seconded by Scherer to table the matter pending
for the projects.

4- City Hall Sidewalk Repair
Jim Dillman presented a quote from Concrete Raising Inc. to raise and level sidewalks
at front and rear entrances of city hall for a cost of $475.
Moved by Scherer, seconded by Schmit to authorize repair of sidewalks by Concrete Raising
Inc., at a cost of $475.

Water Quality
Jim Dillman asked Council how extensive the report on city water quality should be.
Thomas Anderson stated that he would like to know how effective the systems could be
taking into account that in some areas there are not enough water users.
Anne Theis stated that the residents bills are high enough now, they do not want to
pay any more for water treatment.
Glenn Cook stated that they could prepare a report on the cost of treatment.
Tamarack Dr. North
Jim Dillman reported that a resident of the Tamarack Dr. area had ridden her horse on
the newly laid blacktop and that she had told him that the rocks on the road shoulders
hurt her horses feet.
Donna Roehl reported that Ted Kuller of the Medina Horseowners Ass'n. would be writing
a letter to that resident.
5. PLANNING AND ZONING DEPARTMENT
Loretto Towing, Conditional Use Permit Amendment
Anne Theis asked that action on the Loretto Towing item be tabled unless the easement
regarding the fence had been received from Nick Oeffling. She also stated that the
field crops will not grow along the tree line after those trees become larger.
Robert Mitchell stated that approval of future projects would need to take that fact
into consideration.
Moved by Mitchell, seconded by Theis to table action on the Loretto Towing Conditional
Use Permit amendment pending receipt of the fence easement.

Independence Estates Subdivision
Anne Theis stated that she would not want to release escrow funds to Dan Bar Homes until
some matters were resolved; mainly, a schedule for completion of the work and a letter
regarding requirements from the Pioneer Creek Watershed Commission. She stated that work
has been going on for five weeks with residents being inconvenienced by the road being
close, heavy trucks on other streets and mud.
Thomas Anderson suggested that no more building permits be issued until some of these
matters are settled.
Glenn Cook stated that plans for curbing had been changed during the course of the project.
Robert Mitchell stated that the president of Dan Bar should be informed of the problems.
Thomas Anderson asked the Public Works department to put up signs on Lakeshore Ave. and
Ardmore Ave. regarding not allowing heavy truck traffic for the project on any streets
except Maple St. and Birch Ave.
Moved by Mitchell,seconded by Theis to table release of escrow funds to Dan Bar Homes
until all problems have been resolved,with no building permits to be issued until that
time and signs regarding project traffic errected on Lakeshore and Ardmore Ave.

Wehrman-Bergly Planning Agreement
Council discussed the prepared contract and asked that it be revised to incorporate the
work that is to be done into the contract, along with the dollar amount specified earlier
Moved by Mitchell, seconded by Theis to table action on the wehrman-Bergly contract.

Bantle Farms, Final Subdivision
Ron Batty stated that the resolution had been revised to cover the Outlot and road ease-
ments.
Glenn Cook reported that the biggest problem with constructing a road on the eastern edge
of the 20 acre parcel would be the steep hill and swamps at both ends of the easement.
Ron Batty stated that the Pipers attorney was reviewing the easement and agreement documents.
Moved by Mitchell,seconded by Theis to adopt Resolution 89-53, granting final subdivision
approval to Bantle Farm.

Moved by Theis, seconded by Schmit to adopt Resolution 89-54 granting setback variances to
Tom Wolf to construct a house at 4624 Brook St.

Moved by Theis, seconded by Schmit to adopt Resolution 89-55, granting a Conditional Use
Permit to Aquarius Development for property located at 265 Hwy. 55.

6. * MINNESOTA WATERFOWL ASSOCIATION
Moved by Theis, seconded by Schmit to grant a gambling license to the Minnesota Waterfowl
Association to conduct a raffle at the Medina BAllroom on September 14, 1989.

7.* ST. ANNE'S CHURCH
Moved by Theis, seconded by Schmit to approve a non -intoxicating malt liquor license and
a gambling license for St. Anne's Church for August 27, 1989.

8. SENIOR COMMUNITY SERVICES
Donna Roehl reported that the city had received an

10. HENNEPIN PARKS
Donna Roehl reported that the Independence Beach property owners association were concerned
that Hennepin Parks was not inspecting boats for Eurasian Water Milfoil and the groups was
asking the city for some assistance.
Moved by Mitchell, seconded by Scherer to write a letter to Hennepin Parks informing them of
the concern regarding the milfoil and the assumption that they are continuing the checking.

11. DEAF COMPOSTING
Wilfred Scherer reported that the composting project at Co. Rds. 201 and 19 had worked well,
herbicides had not run off and mulch had retained moisture. He stated that composting could
be done cheaper by this manner than the way by which the county has done it on other sites.
12. WOODLAKE LANDFILL ASH APPLICATION
Ron Batty updated Council on continuing review schedule for the Woodlake ash application.
He reported that a contested case hearing had been filed with the PCA which will come before
their board on August 22nd at which time they will decide if a hearing will be granted.
Council discussed proceeding with the application, at the city level, as planned and
to inform BFI and Hennepin County that any delays are not being caused by Medina.
Also discussed was the status of the compost project and the need to contact County
Commissioners regarding county action on the Medina site.
Moved by Scherer, seconded by Theis to adjourn.
