HomeMy Public PortalAboutOrdinances-2013-324 CITY OF TIFFIN ORDINANCE NO. 2013-324 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF TIFFIN, IOWA, CHAPTER 99, SEWER USAGE CHARGE SYSTEM, TO INCLUDE AN EXCEPTION UNDER 99.10 PAYMENT OF BILLS BE IT ENACTED by the City Council of the City of Tiffin, Iowa: Section I. Purpose: The purpose of this ordinance is to amend Chapter 99.10, Code of Ordinances, to include an exception for sewer credit. Section II. Amendment. Section 99.10 of Chapter 99 is hereby replaced with the following: CHAPTER 99 SEWER USAGE CHARGE SYSTEM 99.10 PAYMENT OF BILLS. All sewer user charges are due and payable under the same terms and conditions provided for payment of a combined service account as contained in Section 92.03 of this Code of Ordinances. Sewer service may be discontinued in accordance with the provisions contained in Section 92.04 if the combined service account becomes delinquent, and the provisions contained in Section 92.07 relating to lien notices shall also apply in the event of a delinquent account. 1. Exception A. If there is a malfunctioning outside plumbing fixture that caused high consumption of water, the user may file a verified application at City Hall requesting sewer credit for water used from the malfunctioning outside plumbing fixture, when the City sewer system was not used. The amount of high consumption must be at least 50% greater than the account holder's average consumption over the last 12 months. If the account is less than 12 months old, usage must be 50% greater than the industry standard average, which is 300 cubic feet per person, per month. The user must request a review within 60 calendar days after the "high"billing. The Clerk may make an independent determination on whether to reject, approve, or approve with modifications, an application for a sewer credit of up to $300.00 without City Council approval: Requests for credit of over $300.00 must be approved by the City Council. The Clerk shall provide monthly reports to the City Council regarding the applications received. Section III. Repealer. All ordinances or parts of ordinance in conflict with the provisions of this Ordinance are hereby repealed. Section W. Severability Clause. If any section, provision or part of this tY Y � P P ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section V. When Effective. This ordinance shall be in effect after its final passage, approval, and posting as provided by law. On the 27th day of February 2013, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Bartels introduced Ordinance No. 2013-324, and moved that it be given its first reading. The motion was seconded by Councilperson Ryan. Ayes: Phillips, Upton, Bartels, Ryan, Kahler Nays: None Five members of the Council being present and having voted "Aye", Mayor Steve Berner declared the motion carried, and Ordinance No. 2013-324, was read the first time, discussed, and placed on record. On the 13th day of March 2013, at a regular meeting of the Tiffin City Council,Tiffin, Iowa, Councilperson Ryan introduced Ordinance No. 2013-324, and moved that it be given its second reading. The motion was seconded by Councilperson Upton. Ayes: Kahler, Ryan, Bartels, Upton, Phillips Nays: None Five members of the Council being present and having voted "Aye", Mayor Steve Berner declared the motion carried, and Ordinance No. 2013-324, was read the second time and discussed and placed on record. On the 27th day of March 2013, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Ryan introduced Ordinance No. 2013-324, and moved that it be given its third and last reading. The motion was seconded by Councilperson Upton. Ayes: Phillips, Upton, Bartels, Ryan, Kahler Nays: None Five members of the Council being present and having voted "Aye", Mayor Steve Berner declared the motion carried,'and the ordinance was passed and adopted. Whereupon the Mayor declared that Ordinance No. 2013-324 be adopted and signified his approval of same by fixing his signature thereto.
