HomeMy Public PortalAbout01480 O R D I N A N C E NO. 1480 AN ORDINANCE authorizing and directing the Executive Director to Quit-Claim certain real estate in St. Louis County, Missouri, formerly used for the Woodson Terrace Sewage Disposal Plant to Joseph H. Vatterott and Margaret R. Vatterott, his wife, and to execute a quit claim deed upon the conditions herein set out. WHEREAS, pursuant to a quit claim deed recorded January 6, 1956, in Book 3543, Page 368, of the St. Louis County Recorders Office, title to the following described tract of ground was conveyed to The Metropolitan St. Louis Sewer District by Joseph H. Vatterott and Margaret R. Vatterott, his wife, to be used for the Woodson Terrace Sewage Disposal Plant, and WHEREAS, said deed contained a clause which reads as follows: "Provided, however, that in the event that the above described parcels of land are no longer used as a site for the treatment of sanitary sewage, the title to said tracts of land shall revert to the grantors, their heirs and assigns. Part of the consideration for the execution of this instrument being a separate agreement between the Parties hereto in which The Metropolitan St. Louis Sewer District agrees to re-convey to the Grantors, their heirs and assigns in such event; and WHEREAS, the District has abandoned the use of the Woodson Terrace Sewage Disposal Plant; and WHEREAS, the grantors as well as the City of Woodson Terrace have requested the District to quit claim this tract of 2 land back to the original grantors; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The District, upon condition that Joseph H. Vatterott and Margaret R. Vatterott, his wife, grant to the Sewer District all necessary easements for storm and sanitary purposes does hereby Remise, Release and forever Quit-Claim to Joseph H. Vatterott and Margaret Vatterott, his wife, any right, title, or interest in or to the following described real estate, situated in the County of St. Louis and State of Missouri, to wit: Part of Lot Two (2) of LEWELLEN BROWN ESTATE in U.S. Survey 656, Township 46 North, Range 6 East in St. Louis County, Missouri, consisting of the North 15 feet of property conveyed to Harry Herklotz and wife by deed recorded in Book 1798, page 312 of the St. Louis County records, being more particularly described as follows: Beginning at a point in the East line of Woodson Road of irregular width, said point being the Northwest corner of property conveyed to Harry Herklotz and wife by deed recorded in Book 1798, Page 312 of the St. Louis County Records, thence South 83 degrees 03 minutes East along the North line of property so conveyed to Harry Herklotz and wife, 338.87 feet to a point, said point being the Northeast corner of property so conveyed to said Harry Herklotz and wife; thence South 18 degrees 28 minutes West along the Eastern line of said property so conveyed to 3 Herklotz, 15.31 feet to a point; thence North 83 degrees 03 minutes West, 335.89 feet to a point in the East line of said Woodson Road; thence North 7 degrees 16 minutes East along said East line of Woodson Road, 15.0 feet to the Northwest corner of property so conveyed to Herklotz, and to the point of beginning, containing 0.12 acres. Also, a parcel of ground in Lot Two (2) of LEWELLEN BROWN ESTATE, in U.S. Survey 656, Township 46 North, Range 6 East, in St. Louis County, Missouri, consisting of the Northern portion of property conveyed to Harry Herklotz and wife by deed recorded in Book 1379, page 265 of the St. Louis County records, being more particularly described as: Beginning at the Northeast corner of property conveyed to Harry Herklotz and wife by deed recorded in Book 1379, page 265 of the St. Louis County Records; thence South 6 degrees 51 minutes West along the East line of property as conveyed to said Harry Herklotz and wife, 260.19 feet to a point; thence North 83 degrees 09 minutes West and at 90 degrees to said East line, 489.20 feet to a point, said point being also an angle point in the Northwest line of property so conveyed to said Herklotz; thence North 44 degrees 46 minutes East along the Northwest line of said property so conveyed to Herklotz, 180.21 feet to a point; thence North 18 degrees 28 minutes East 238.0 feet to the Northernmost corner of property so conveyed to Herklotz; thence South 63 degrees 57 minutes East along the North line of said property so conveyed to Harry 4 Herklotz and wife, 350.0 feet to the Northeast corner of said Herklotz property and to the point of beginning, containing 2.88 acres. Section Two. The Executive Director is hereby authorized and directed to execute in behalf of the District a Deed giving effect to Section One hereof. 5 The foregoing Ordinance was adopted April 21, 1966.
