HomeMy Public PortalAbout01487 O R D I N A N C E NO. 1487 AN ORDINANCE authorizing and directing the Executive Director to grant to Laclede Gas Company, a Missouri Corporation, the right to construct and maintain a deep well and other structures and appurtenances thereto and roadway and access easements in and over certain District real property in St. Louis County, Missouri, as hereinafter described, and to execute an instrument giving effect thereto upon the conditions hereinafter set out. WHEREAS, Laclede Gas Company wishes to construct a deep well and other structures, equipment and appurtenances thereto, and roadway and access easements in and across certain real property of this District and has requested the District grant the right to so use such real property, and the District is willing so to do; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to Laclede Gas Company, the right to construct, reconstruct, repair and maintain a deep well and other structures, equipment and appurtenances thereto and roadway and access easements in and over the following described real property as hereinafter set forth, provided the right to the District to use the easement is preserved, and under suitable indemnity provisions. The easements which are involved in this grant are 2 those described as follows: 1. That easement to be used for the construction of a deep well and other structures, equipment and appurtenances thereto, being described as: A rectangular parcel of land measuring 150 feet on each of its sides and located in the northwest corner of a tract of land in U.S. Survey 210, Township 47 North, Range 7 East, St. Louis County, Missouri, said tract being particularly described in General Warranty Deed from Vernon Eugene Ryther and Johanna Ryther, his wife, to The Metropolitan St. Louis Sewer District dated September 27, 1962 and recorded in Book 4925, Page 531 of the St. Louis County Recorder's office. 2. That easement to be used for the roadway and access to aforesaid deep well area, being described as: The western 20 feet of two contiguous tracts of land, the first of such tracts being located in U.S. Survey 210, Township 47 North, Range 7 East, St. Louis County, Missouri and being more particularly described in General Warranty Deed from Vernon Eugene Ryther and Johanna Ryther, his wife, to The Metropolitan St. Louis Sewer District dated September 27, 1962 and recorded in Book 4925, Page 531 of the St. Louis County Recorder's office, and the second of such tracts being located in Fractional Section 18, Township 47 North, Range 7 East, St. Louis County, Missouri and being particularly described in General Warranty Deed from Jake L. Rinehart and 3 Donnie Rinehart, his wife, to The Metropolitan St. Louis Sewer District dated September 28, 1962 and recorded in Book 4926, Page 562 of the St. Louis County Recorder's office. Also, the existing roadway (or other convenient route of equal width should the existing roadway cease to exist or cease to be usable) running from the 20 foot wide easement described in the immediately preceding paragraph to Old Halls Ferry Road across three intervening tracts of land owned by The Metropolitan St. Louis Sewer District, said tracts being particularly described, respectively, in instruments recorded in Book 4860, Page 398; Book 4837, Page 341; and Book 4847, Page 509 of the St. Louis County Recorder's office. Section Two. The Executive Director is hereby authorized and directed to execute in behalf of the District an instrument giving effect to Section One hereof. The foregoing Ordinance was adopted May 9, 1966. 4
