AN ORDINANCE declaring the necessity for the
acquisition of easements within certain existing property within
The Metropolitan St. Louis Sewer District, for the purpose of
permitting construction of sewers therein to serve the needs of
residents on adjacent lands and authorizing the institution of
condemnation proceedings in connection therewith, with an
emergency clause.
WHEREAS, there exists within The Metropolitan St. Louis
Sewer District an area in the Peach Tree Court Subdistrict No. 258
of The Metropolitan St. Louis Sewer District in which there work
and live numerous people; and
WHEREAS, sanitary sewage gathered from such area will
have no alternative means of disposition to crossing said property
and will constitute a menace to public health and welfare of the
general public and the residents of The Metropolitan St. Louis
Sewer District; and
WHEREAS, it is the purpose and design of The
Metropolitan St. Louis Sewer District to protect the public health
by relieving and alleviating these conditions:
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and
relieve the aforesaid insanitary and dangerous conditions, it is
necessary to appropriate and acquire by the exercise of eminent
domain or otherwise, an easement for the use of a sewer, together

with temporary construction easements adjacent to such permanent
easement, which are required for working room during the
construction period, and for the right of ingress and egress to
the premises sought to be condemned, as hereinafter set forth:
A. Permanent Easement:
A strip of land 10' wide by 458'∀ long in Section 20,
T.44N., R.6E., St. Louis County, Mo., the centerline of which
10' strip is described as follows: Beginning in the northern
line of Gravois Road, 80' wide, at its intersection with the
east line of property conveyed to John Martin Dressel,
Trustee, by instrument recorded in Book 3875, page 66, St.
Louis County Recorder's office; thence in a straight line
westwardly 465.6'∀ to its terminus in the centerline of the
15' wide easement granted to The Metropolitan St. Louis Sewer
District by instrument recorded in Book 4492, page 628, St.
Louis County Recorder's office, distant along said 15' wide
easement centerline, 38.6' northwardly from its intersection
with said northern line of Gravois Road; bounded eastwardly
by the east line of said Dressel property; and EXCEPTING
THEREFROM those portions thereof lying within said Gravois
Road, 80' wide, and within said 15' wide easement.
B. Temporary Construction Easements:
A strip of land 10 feet wide by 466 feet, more or less, long,
in Section 20, T.44N., R.6E., St. Louis County, Missouri, and
being a part of property conveyed to John Martin Dressel,

Trustee, by instrument recorded in Book 3875, page 66, St.
Louis County Recorder's Office, and described as bounded on
the south by the north line of the 10 foot wide (proposed)
permanent easement hereinabove described, on the north by a
line parallel with and 10 feet northwardly (perpendicular
distance) from the north line of said permanent easement, on
the east by the east line of said Dressel property, and on
the west by the eastern line of the 15 foot wide easement
heretofore granted to The Metropolitan St. Louis Sewer
District by instrument recorded in Book 4492, page 628, said
Recorder's Office.
A triangular strip of land 415 feet, more or less, long, in
Section 20, T.44N., R.6E., St. Louis County, Missouri, and
being a part of property conveyed to John Martin Dressel,
Trustee, by instrument recorded in Book 3875, page 66, St.
Louis County Recorder's Office, and described as bounded on
the south by the north line of
Gravois Road, 80 feet wide, on the north by the south line of the
10 foot wide (proposed) permanent easement hereinabove
described and on the west by the eastern line of the 15 foot
wide easement heretofore granted to The Metropolitan St.
Louis Sewer District by instrument recorded in Book 4492,
page 628, of the St. Louis County Recorder's Office.
Section Two. Counsel for The Metropolitan St. Louis
Sewer District be and is hereby authorized to institute and
prosecute an action in condemnation pursuant to the provisions of

the Plan of The Metropolitan St. Louis Sewer District and the laws
of the State of Missouri, for the appropriation of private
property as hereinbefore set out.
Section Three. The immediate construction of said
sewer being necessary in order to protect the public health within
the District constitutes an emergency within the meaning of the
Plan of The Metropolitan St. Louis Sewer District and this
Ordinance shall take effect immediately upon its adoption.
