HomeMy Public PortalAbout01542 O R D I N A N C E NO. 1542 AN ORDINANCE, establishing certain described lands as part of the Water Pollution Control Project of the Mississippi River Subdistrict of The Metropolitan St. Louis Sewer District, contemplated by Ordinance No. 775, approved June 25, 1962; containing a legal description of the aforesaid lands forming an integral, constituent and necessary part of said Water Pollution Control Project, authorizing the institution of condemnation proceedings in connection therewith, and containing an emergency clause. WHEREAS, the Board of Trustees of The Metropolitan St. Louis Sewer District, pursuant to proceedings duly and lawfully had in accordance with the provisions of its Plan, by Ordinance No. 775, adopted on the 25th day of June, 1962, did create the Mississippi River Subdistrict of The Metropolitan St. Louis Sewer District; and WHEREAS, thereafter by Ordinance No. 845, adopted on the 27th day of September, 1962, the Board of Trustees of The Metropolitan St. Louis Sewer District did call and provide for the holding of a special election in the said Mississippi River Subdistrict of The Metropolitan St. Louis Sewer District for the purpose of submitting to the qualified electors of said Subdistrict, the following proposition, to wit: Proposition. "Shall the general obligation bonds of the Mississippi River Subdistrict of The Metropolitan St.Louis Sewer District be 2 issued in the amount of Ninety Five Million Dollars ($95,000,000.00) to provide funds for the purpose of constructing a system of sanitary interceptor sewers and sewage disposal and treatment plant and works for said subdistrict, including all expenses necessarily incidental thereto?" and WHEREAS, more than two-thirds of the qualified electors voting on the aforesaid proposition, voted in favor thereof; and WHEREAS, by reason of the aforesaid result of said special election, the Mississippi River Subdistrict of The Metropolitan St. Louis Sewer District is now authorized and empowered to borrow money and issue its bonds in evidence thereof, in the sum of Ninety Five Million Dollars ($95,000,000.00) for the purpose of constructing a system of sanitary interceptor sewers, force mains and sewage disposal and treatment plants and works for said subdistrict, including all expenses necessarily incidental thereto; and WHEREAS, it is necessary that The Metropolitan St. Louis Sewer District acquire certain lands forming an integral, constituent and necessary part of the Water Pollution Control Project of the Mississippi River Subdistrict of The Metropolitan St. Louis Sewer District; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. There shall be and is hereby established as part of the Water Pollution Control Project of the Mississippi 3 River Subdistrict of The Metropolitan St. Louis Sewer District, contemplated by Ordinance No. 775, adopted on the 25th day of June, 1962, the following described lands located in the City of St. Louis, State of Missouri: A small triangular parcel of land comprised of parts of Lots 10 and 11 of Blow and Ewing's Subdivision and in Block 3254 of the City of St. Louis, Mo., and described as: Beginning in the northwestern line of said Lot 10 distant 8.34 feet southwestwardly along said northwestern line from the northernmost corner of said Lot 10; thence southeastwardly and parallel with the northeastern line of said Lot 10, a distance of 9.06 feet; thence northwardly in a straight line 14.8 feet, more or less, to a point in the northwestern line of said Lot 11 distant 3.43 feet northeastwardly along said northwestern line of Lot 11 from the westernmost corner of said Lot 11, thence southwestwardly along the northwestern lines of Lots 11 and 10, a distance of 11.77 feet to the beginning. A strip of land 30 feet wide by 224.32 feet, more or less, long fully across Lots 2 thru 9, inclusive, and the southwest 16 feet 8 inches of Lot 10 of Blow and Ewing's Subdivision, and in Block 3254 of the City of St. Louis, Mo., the centerline of which 30 foot wide strip of land is described as follows: Beginning in the northwestern line of Minnesota Avenue, 60 feet wide, 57.14 feet northeastwardly along said street line from the southernmost corner of said Block 3254; 4 thence northwardly in a straight line 224.32 feet to its terminus in the southeastern line of the 20 foot wide alley in said Block, distant northeastwardly along said alley line 51.09 feet from its intersection with the eastern line of the River des Peres Drainage Works Right-of-Way, 280 feet wide. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri, for the appropriation of private property as hereinbefore set out. Section Three. The immediate construction of a system of sanitary interceptor sewers, force mains and sewage disposal and treatment plants and works for said subdistrict is necessary in order to protect the public health and constitute an emergency within the meaning of the Plan of The Metropolitan St. Louis Sewer District and this Ordinance shall take effect immediately upon its adoption. 5 The foregoing Ordinance was adopted October 17, 1966.
