HomeMy Public PortalAboutOrdinances-2013-325 CITY OF TIFFIN ORDINANCE NO. 2013-325 • AN ORDINANCE TO AMEND. THE MUNICIPAL CODE OF TIFFIN, IOWA, CHAPTER 56, DOG AND CAT LICENSES REQUIRED, TO CHANGE THE DATES UNDER SECTIONS 56.01 ANNUAL LICENSE REQUIRED, 56.03 DELINQUENCY, AND 56.04 EXPIRATION. BE IT ENACTED by the City Council of the City of Tiffin, Iowa: Section I. Purpose: The purpose of this ordinance is to amend Sections 56.01, 56.03, and 56.04, Code of Ordinances, to change the period for which the annual licenses run from July 1 through June 30 to January 1 through December 31. Section II. Amendment: Sections 56.01, 56.03, and 56.04 of Chapter 56 is hereby replaced with the following: CHAPTER 56 DOG AND CAT LICENSES REQUIRED 56.01 ANNUAL LICENSE REQUIRED. 1. Every owner of a dog or cat over the age of six months (or of a dog or cat under the age of six months which is no longer with its dam) shall procure a dog license or cat license for each year, from the City, before the first day of January of the year for which the license is in effect, or within 30 days after such dog or cat reaches the age of six months and is no longer with its dam, or if brought into the City. 2. The owner of a cat or'dog less than six months of age which is no longer with its dam, but which is too young to be immunized,'shall be issued a temporary license upon application to the City and payment of the regular fee. Such temporary license shall automatically expire seven months from the date of birth of the dog or cat unless the owner furnishes to the City a veterinarian's certificate showing that the dog or cat has been immunized. If such certificate is furnished prior to the time such dog or cat reaches seven months, the temporary license shall automatically become a regular animal license. 56.03 DELINQUENCY. After January 1 of each year, delinquent license fees as determined by the City shall be assessed in addition to the annual license fee, except in those cases where, by reason of residence outside the City limits, age, or ownership, the dog or cat was not subject to licensing on January 1. Such delinquent fees shall be set by the Council resolution. 56.04 EXPIRATION. All licenses, regardless of the date of issue, expire on December 31 of the year the license was in effect. • Section III. Repealer. All ordinances or parts of ordinance in conflict with the provisions of this Ordinance are hereby repealed. Section IV. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section V. When Effective. This ordinance shall be in effect after its final passage, approval, and posting as provided by law. Section VI. Applicability. Licenses which expire on June 30, 2013 shall bd renewed before January 1, 2014. On the 13th day of March 2013, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilpefson Upton introduced Ordinance No. 2013-325, and moved that it be given its first reading. The motion was seconded by Councilperson Kahler. Ayes: Phillips, Upton, Bartels, Ryan, Kahler Nays: None Five members of the Council being present and having voted "Aye", Mayor Steve Berner declared the motion carried, and Ordinance No. 2013-325, was read the first time, discussed, and placed on record. On the 27th day of March 2013, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Ryan introduced Ordinance No. 2013-325, and moved that it be given its second reading. The motion was seconded by Councilperson Upton. Ayes: Phillips, Upton, Bartels, Ryan, Kahler Nays: None. Five members of the Council being present and having voted "Aye", Mayor Steve Berner declared the motion carried, and Ordinance No. 2013-325,was read the second time and discussed and placed on record. On the 10th day of April 2013, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Ryan introduced Ordinance No. 2013-325, and moved that it be given its third and last reading. The motion was seconded by Councilperson Upton. Ayes: Phillips, Upton, Bartels, Ryan, Kahler Nays: None. Five members of the Council being present and having voted "Aye", Mayor Steve Berner declared the motion carried, and the ordinance was passed and adopted. Whereupon the Mayor declared that Ordinance No. 2013-325 be adopted and signified his approval of same by fixing his signature thereto.
