AN ORDINANCE declaring the necessity for the
acquisition of easements within certain existing property within
The Metropolitan St. Louis Sewer District, for the purpose of
permitting construction of sewers therein to serve the needs of
residents on adjacent lands and authorizing the institution of
condemnation proceedings in connection therewith.
WHEREAS, there exists within The Metropolitan St. Louis
Sewer District an area in St. Louis County, Missouri, near the St.
Charles Rock Road and Lindbergh Boulevard, known as Subdistrict
No. 194 (Kenneth and Elrath) of The Metropolitan St. Louis Sewer
District, in which there work and live numerous people; and
WHEREAS, sanitary sewage gathered from such area will
cross said property and will constitute a menace to public health
and welfare of the general public and the residents of The
Metropolitan St. Louis Sewer District; and
WHEREAS, it is the purpose and design of The Metro-
politan St. Louis Sewer District to protect the public health by
relieving and alleviating these conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and
relieve the aforesaid insanitary and dangerous conditions, it is
necessary to appropriate and acquire by the exercise of eminent
domain or otherwise an easement for the use of sewers as
hereinafter set forth, together with such working space adjacent

to the right-of-way as obtained as may be required for working
room during the construction period, and the right of ingress and
egress over the premises sought to be condemned for the access to
such easement:
A strip of land variously 15' and 10' in width within the
tract of land in U.S. Survey 406, T46N, R5E, St. Louis
County, Mo., conveyed to Thomas H. Lucas by deed
recorded in Book #28, page 377, St. Louis County
Recorder's office, which strip of land is described as
follows: Beginning in the southern line of St. Charles
Rock Road, 60 feet wide, distant along said road line
N. 53 degrees 07'W., 25.50' from its intersection with
the western line of Fee Fee Road, 40' wide, said
beginning point also being the westernmost corner of
the triangular parcel of land conveyed to St. Louis
County, Mo., for road purposes by deed recorded in Book
945, page 455, said Recorder's office; thence along the
southern line of said St. Charles Rock Road, N.53
degrees 07'W. 110.84' to the easternmost corner of
property conveyed to George F. Gosejohann and wife by
deed recorded in Book 1745, page 28; thence along the
southeast and southwest lines of said Gosejohann
property, S.31 degrees 49'W., 80.00' and N.50 degrees
24' W., 110.09' respectively, to the westernmost corner
thereof in the eastern line of Raymond Avenue, 30'

wide; thence along said eastern line of Raymond Avenue,
S.15 degrees 30'W, 10.95' to a line parallel with and
10.00' southwest of, measured at right angles to the
southwest line of said Gosejohann property; thence
along said parallel line S.50 degrees 24'E., 117.08' to
its intersection with a line parallel with an 10.00'
southeast of, measured at right angles to the southeast
line of said Gosejohann property; thence along said
last mentioned parallel line, N.31 degrees 49' E.,
75.51' to its intersection with a line parallel with
and 15.00' southwest of, measured at right angles to
said southern line of St. Charles Rock Road; thence
along said last mentioned parallel line, S.53, 07' E.,
128.40' to its intersection with the west line of said
triangular parcel conveyed to St. Louis County for road
purposes; thence along the west line of said triangular
parcel N. 25 degrees 42-4/5' W., 32.59' to the
beginning.
Section Two. Counsel for The Metropolitan St. Louis
Sewer District be and is hereby authorized to institute and
prosecute an action in condemnation pursuant to the provisions of
the Plan of The Metropolitan St. Louis Sewer District and the laws
of the State of Missouri, for the appropriation of private
property as hereinbefore set out.
