AN ORDINANCE repealing Ordinance No. 1499 adopted June
9, 1966 and enacting a new ordinance in lieu thereof on the same
subject; authorizing and directing the Executive Director to grant
to Union Electric Company the right to install, maintain and use
overhead electrical wires and overhanging crossarms and
appurtenances along, over, through and across certain properties
in which the District has various rights, titles and interests
lying in the City of St. Louis and St. Louis County, Missouri,
together with the temporary right to install, maintain and use a
tower and appurtenances in part of such property, and to execute
an instrument giving effect thereto upon the conditions herein-
after set out.
WHEREAS, Union Electric Company has asked the District
for the right to install, maintain and use overhead electrical
wires and overhanging crossarms and appurtenances along, over,
through and across certain hereinafter described real property in
which the District has various rights, titles and interests, and
to install, maintain and use temporarily a tower and
appurtenances, and the District is desirous of granting such right
for the good of the general public;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District
does hereby grant to the Union Electric Company the right to
install, maintain and use overhead electrical wires and
overhanging crossarms and appurtenances, along, over, through and

across certain properties as hereinafter described in the City of
St. Louis and in St. Louis County, Missouri in which the District
has various rights, titles and interests, together with the
temporary right to install, maintain and use a tower and
appurtenances in such properties, such properties being described
as follows:Beginning at a point on the east line of Waterworks
Conduit right of way 120 feet wide and its intersection with the
north line of Metropolitan St. Louis Sewer District right of way
(acquired by Ordinance No. 38915 and recorded in Book 5158 at page
462 of the deed records of the City of St. Louis, Missouri);
thence southeasterly along the northeasterly right of way line of
said Metropolitan St. Louis Sewer District to its point of inter-
section with a 50-foot wide dedicated road for tho point of
beginning of the herein-described easement; thence easterly along
the north line of said 50-foot wide road a distance of 15 feet,
more or less, to its point of intersection with the northeasterly
right of way line of said Metropolitan St. Louis Sewer District
right of way; thence southeasterly along the northeasterly right
of way line of Metropolitan St. Louis Sewer District a distance of
252 feet, more or less, to a point; thence southeasterly a
distance of 450 feet, more or less, to a point in the south line
of Lot 2, St. Cyr in Partition, which point is 280 feet, more or
less, west of the west line of the Chicago, Burlington and Quincy
Railroad right of way; thence west along the said south line of
Lot 2, St. Cyr, a distance of 95 feet, more or less, to a stone;

thence northwesterly along the southwesterly right of way line of
Metropolitan St. Louis Sewer District a distance of 60 feet, more
or less; thence northerly a distance of 585 feet, more or less, to
the northeasterly right of way line of Metropolitan St. Louis
Sewer District; thence southeasterly along said right of way line
a distance of 20 feet, more or less, to the point of beginning.
Beginning at a point on the east line of Waterworks Conduit
right of way 120 feet wide and its intersection with
the northeasterly line of Metropolitan St. Louis Sewer
District right of way (acquired by Ordinance No. 38915
and recorded in Book 5158 at page 462 of the deed
records of the City of St. Louis, Missouri); thence
northwesterly a distance of 609 feet, more or less, to
a point in the City Limits line of 1876; which point is
46 feet, more or less, southwesterly from a stone
(designated No. 137) in said City Limits line; thence
northeasterly along said City Limits line a distance of
46 feet, more or less, to said Stone No. 137; thence
continuing along said City Limits line a distance of 60
feet, more or less; thence southeasterly along said
Metropolitan St. Louis Sewer District right of way line
a distance of 50.38 feet to a point; thence
southeasterly along said right of way line of
Metropolitan St. Louis Sewer District a distance of 335

feet, more or less, to its point of intersection with
the northwest line of Riverview Drive; thence
continuing along the said northeasterly right of way
line of Metropolitan St. Louis Sewer District a
distance of 105 feet, more or less, to its intersection
with the northwest line of Waterworks Conduit; thence
southeasterly along the said northeasterly right of way
line of Metropolitan St. Louis Sewer District a
distance of 120 feet, more or less, to its intersection
with the southeasterly line of the said Waterworks
Conduit, being the point of beginning.
The center of said transmission line tower is described as
follows: Beginning at a point in the northeasterly
right of way line of said Sewer District and its
intersection with the northerly line of Riverview
Drive; thence northwesterly along said northeasterly
right of way line and its prolongation thereof a
distance of 338.22 feet to a point; thence making an
angle of 90 degrees to the left from the last-described
line, a distance of 22 feet.
Beginning at the point of intersection of St. Louis City
Limits of 1876 and the north line of existing Maline
Creek Channel right of way; thence south along the said

St. Louis City Limits line a distance of 60 feet to a
stone in said City Limits line (designated as Stone
137), said stone being the point of beginning of the
herein-described easement; thence southerly along the
said City Limits line a distance of 25 feet, more or
less, to a point; thence northerly 854 feet, more or
less, to a point in the easterly right of way line of
the Metropolitan St. Louis Sewer District 200-foot wide
Channel easement; thence southeasterly along said
easterly right of way line a distance of 40 feet, more
or less, to a point; thence southerly along said right
of way line of Metropolitan St. Louis Sewer District a
distance of 339 feet, more or less, to a point; thence
southwesterly along said right of way line a distance
of 421 feet, more or less, to its point of intersection
with the City Limits line of 1876; thence southwesterly
along the aforesaid City Limits line of 1876 a distance
of 60 feet, more or less, to the point of beginning.
Beginning at a point on the north line of St. Cyr Road with
its intersection with the easterly right of way line of
Metropolitan St. Louis Sewer District; thence southerly
along the said easterly right of way line of
Metropolitan St. Louis Sewer District a distance of 530
feet, more or less, to a point on said easterly right

of way line; thence northwesterly a distance of 560
feet, more or less, to a point, which point is 5 feet
north of a point on the north line of St. Cyr Road
measured at right angles thereto, said point on the
north line of St. Cyr Road being 655 feet, more or
less, east of the northeast corner of Bellefontaine and
St. Cyr Roads; thence north a distance of 50 feet, more
or less, to a point in the northeast right of way line
of Metropolitan St. Louis Sewer District, which point
is 70 feet northwest of the north line of St. Cyr Road
and its intersection with the northwest right of way
line of Metropolitan St. Louis Sewer District; thence
southeast a distance of 70 feet, more or less, to the
point of beginning.
Section Two. The rights herein granted are limited to
such rights as the District may have in the premises concerned and
the Union Electric Company shall secure such permission as may be
necessary on account of any other existing rights.
Section Three. Grantor's right to the use of such
properties for sewer and drainage purposes is hereby reserved.
Section Four. Grantee shall at its own sole cost and
expense relocate, change or adjust such portion of its facilities
as are reasonably necessary in order to avoid interference with
construction and operation of Grantor's facilities in aforesaid
properties, and Grantee shall, at its own sole cost and expense,

remove or relocate such tower at such time as the Grantor shall
require for channel improvements.
Section Five. Grantee shall agree to indemnify the
Grantor against any claim or damage arriving out of the use of the
rights hereby granted.
Section Six. The Executive Director is hereby
authorized and directed to execute in behalf of the District an
instrument giving effect to Sections One, Two, Three, Four and
Five hereof.
