HomeMy Public PortalAbout01611 O R D I N A N C E NO. 1611 AN ORDINANCE declaring the necessity for the acquisition of an easement within certain existing property within The Metropolitan St. Louis Sewer District, for the purpose of permitting construction of a sanitary sewer therein to serve the needs of residents on adjacent lands and authorizing the institution of condemnation proceedings in connection therewith. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area in St. Louis County, Missouri bounded approximately by Dunn Road on the south, Granview Drive on the west, Derhake Road and Pohlman Road on the north, and New Halls Ferry Road on the east, in which there work and live numerous people; and, WHEREAS, the Special School District of St. Louis County, Missouri, is in the process of constructing a school in said area to provide vocational training for numerous residents of St. Louis County, Missouri, to be known as North Vocational High School of the Special School District of St. Louis County, Missouri; and, WHEREAS, sanitary sewage gathered from such area, as well as from said vocational school, will cross the proposed ease- ment and will constitute a menace to the public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and, WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health 2 by relieving and alleviating these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve the aforesaid insanitary and dangerous conditions, it is necessary to appropriate and acquire, by the exercise of eminent domain or otherwise, an easement for the use of a sanitary sewer as hereinafter set forth, together with such working space adjacent to the right-of-way as obtained, as may be required for working room during the construction period, and the right of ingress and egress over the premises sought to be condemned for the access to such easement: The centerline of a 10 foot wide easement for a sanitary sewer to be constructed in property held in trust by Fred W. Timmermann, Jr. and the St. Louis Union Trust Company as Co-Trustees is described as follows: Beginning at a point in the east property line, having a bearing of N 1Ε 31-1/2' E a distance of 817.62 feet south of the northeast corner of said property; thence at a bearing of N 44Ε 33' W a distance of 398.22 feet to a point; thence at a bearing of N 62Ε 17' 45" W a distance of 210.04 feet, terminating at a point in the west line of said property a distance of 444.16 feet south of the northwest corner of the property. The centerline of a 10 foot wide easement for a sanitary sewer to 3 be constructed in the property of Harry B. Wilshusen and Mary B. Wilshusen, his wife, is described as follows: Beginning at a point in the east property line a distance of 112.57 feet north of an iron pipe at the southeast corner of said property; thence at a bearing of N 69Ε 55' 40" W a distance of 275.0 feet to a point; thence at a bearing of N 80Ε 20' 40" W a distance of 350.0 feet to a point; thence at a bearing of N 73Ε 14' 40" W a distance of 390.0 feet to a point; thence at a bearing of N 82Ε 34' 40" W a distance of 268.0 feet to a point; thence at a bearing of N 44Ε 32' 20" W a distance of 188.08 feet, terminating at a point in the west property line of said property a distance of 536.35 feet north of an iron pipe at the southwest corner of the said property. Section Two. Counsel for The Metropolitan St. Louis Sewer District be, and is hereby authorized, to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri, for the appropriation of private property as hereinbefore set out.
