HomeMy Public PortalAbout01634 O R D I N A N C E NO. 1634 AN ORDINANCE declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District, for the purpose of permitting construction of sewers therein to serve the needs of residents on adjacent lands and authorizing the institution of condemnation proceedings in connection therewith, WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area in St. Louis County, Missouri, known as the Watkins Creek Trunk Subdistrict of The Metropolitan St. Louis Sewer District in which there work and live numerous people; and WHEREAS, sanitary sewage gathered from such area will have no alternative means of disposition to crossing said property and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health by relieving and alleviating these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve the aforesaid insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise, easements for the use of sewers as 2 hereinafter set forth, together with such working space adjacent to the right-of-way as obtained as may be required for working room during the construction period, and the right of ingress and egress over the premises sought to be condemned for the access to such easements: Easements across Property of John H. Londoff and Sylvia Londoff, his wife, being: Three strips of land, 10' wide, over, across and thru the north part of Lot 7 of the subdivision of the Estate of Daniel Bissell in Sec. 33, T. 47N., R. 7E., St. Louis County, Mo., as per plat thereof recorded in Plat Book 1, Vol. 1, page 63, of the City (former County) of St. Louis Recorder's office, which 10' wide strips are described as follows: A strip of land 10' wide, the centerline of which is described as: Beginning in the south line of property conveyed to John H. Londoff and wife by deed recorded in Book 5918, page 477, St. Louis County Recorder's office, distant N. 89Ε 30' W., 375.88' along the south line of said Londoff property from the southeast corner thereof; thence N. 44Ε 08' W., 492.61'; thence N. 52Ε 30' W., 358.00'; thence N. 60Ε 08' W., 660.00'; and thence N. 67Ε 45' W., 229.33', more or less, to its terminus in the west line of said Londoff property distant 5.00Ε 23' W., 316.63' along said west line from the northwest 3 corner of said Londoff property; said 10' wide strip being bounded on the south and west by the south and west lines, respectively, of said Londoff property. (2) A strip of land 10' wide, the centerline of which is described as: Beginning in the east line of property conveyed to John H. Londoff and wife by deed recorded in Book 5918, page 477, St. Louis County Recorder's office, distant N. 00Ε 32' E., 5.00' from the southeast corner thereof; thence N. 89Ε 30' W., parallel with the south line of said Londoff property, 376.82' to the terminus of said centerline in the northeastern line of the 10' wide strip described in (1), above; and bounded eastwardly by the east line of said Lot 7 and westwardly by the northeastern line of said 10' wide strip described in (1), above. (3) A strip of land 10' wide, the centerline of which is described as: Beginning in a line 5.00' west of and parallel to the east line of said, Lot 7, distant 10.00' north of its intersection with the south line of property conveyed to John H. Londoff and wife by deed recorded in Book 5918, page 477, St. Louis County Recorder's office; thence along said parallel line, N. 00Ε 32' E., 636.51'; thence N. 06Ε 02' W., 222.23'; and thence N. 01Ε 34' E., 434.22' to its terminus in the north line of said Londoff property distant there along N. 89Ε 30- 1/2' W., 22.58' from the northeast corner thereof; and 4 which 10' wide strip is bounded on the south and north by the south and north lines, respectively, of said Londoff property. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri, for the appropriation of private property as hereinbefore set out. 5 The foregoing Ordinance was adopted July 6, 1967.
