HomeMy Public PortalAbout01638 O R D I N A N C E NO. 1638 AN ORDINANCE repealing Ordinance No. 1613, adopted May 4, 1967 and enacting a new ordinance in lieu thereof on the same subject; declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District, for the purpose of permitting construction of sewers therein to serve the needs of residents on adjacent lands and authorizing the institution of condemnation proceedings in connection therewith, WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area in the City of St. Louis and in St. Louis County, Missouri, known as the Watkins Creek Trunk Subdistrict of The Metropolitan St. Louis Sewer District in which there work and live numerous people; and WHEREAS, sanitary sewage gathered from such area will have no alternative means of disposition to crossing said property and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health by relieving and alleviating these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. Ordinance No. 1613, adopted May 4, 1967, is hereby repealed. 2 Section Two. In order to protect the public health and relieve the aforesaid insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise, easements for the use of sewers as hereinafter set forth, together with such working space adjacent to the right-of-way as obtained as may be required for working room during the construction period, and the right of ingress and egress over the premises sought to be condemned for the access to such easements: A permanent easement ten (10) feet wide across Lot No. 9 of the Subdivision of the Estate of Benjamin F. Watkins, Deceased, in U. S. Survey 114, in St. Louis County, Missouri, which property is now or formerly of GEORGE GRAFF. The centerline of the aforesaid easement is described as follows: Beginning in the west line of Riverview Drive (60 feet wide) at its intersection with a line parallel with and 25 feet north of the line common to Lots 9 and 8 of aforesaid Subdivision of the Estate of Benjamin F. Watkins, Deceased, which common lot line is also a part of the St. Louis City Limit; thence North 82 degrees, 03 minutes West along aforesaid parallel line, 498 feet; thence at a deflection angle to the left of 52 degrees, 09 minutes, a distance of 32 feet, more or less, to its intersection with aforesaid common lot line of Lots 9 and 8. Temporary easements during original construction of 3 sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20' in width on each side of and immediately adjacent to the hereinabove described 10' wide permanent easement, the northern and southern lines of which 20' wide temporary easements are coincident with the southern and northern lines, respectively, of said 10' wide permanent easement; said 20' wide easements being bounded on the east by the west line of Riverview Drive, 60' wide, and on the south by the south line of said Lot 9 of the Subdivision of the Estate of Benjamin F. Watkins, Deceased. A permanent easement ten (10) feet wide across Lot 8 of the Subdivision of Benjamin F. Watkins Estate lying partly in U. S. Survey 114, St. Louis County, Missouri, and partly in the City of St. Louis, Missouri, which property is now or formerly of MICHAEL PESSIN. The centerline of aforesaid easement is described as follows: Beginning at the intersection of the centerline of Coal Bank Road (40 feet wide) and the St. Louis City Limit; thence westwardly along said centerline of Coal Bank Road, 444.9 feet; thence northeastwardly, at a deflection angle to the right of 113 degrees 03 minutes, along a straight line to its intersection with the north line of aforesaid Coal Bank Road, being also the southern line of aforesaid Lot 8, which point of intersection is the point of beginning of the centerline of the aforesaid ten (10) foot wide easement; thence continuing northeastwardly along said 4 straight line to a point which is 496.85 feet from the intersection of such straight line with the aforesaid centerline of Coal Bank Road, measured along such straight line; thence northeastwardly, at a deflection angle to the right of 26 degrees, 16 minutes a distance of approximately 373 feet, more or less, to its intersection with the common lot line of Lot 9 and Lot 8 of aforesaid Subdivision of Benjamin F. Watkins Estate, which common lot line is also a part of the St. Louis City Limit. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20' in width, on each side of and immediately adjacent to the hereinabove described permanent 10' wide easement, the northwestern and southeastern lines of which 20' wide temporary easements are coincident with the southeastern and northwestern lines, respectively, of said 10' wide permanent easement; said 20' wide easements being bounded on the north by the north line of said Lot 8 of the Subdivision of the Estate of Benjamin F. Watkins, Deceased, and on the south by the north line of Coal Bank Road, 40' wide. A permanent easement ten (10) feet wide across all that part of Lot 7 of the Subdivision of the Estate of Benjamin F. Watkins, Deceased, in U. S. Survey 114 lying in St. Louis County, Missouri, excepting therefrom that part thereof conveyed to St. Louis County, Missouri, by deed recorded in Book 4291, page 422 of the St. Louis County Records, which property is now or formerly of 5 GEORGE GRAFF. The centerline of aforesaid easement is described as follows: Beginning at the intersection of the centerline of Coal Bank Road (40 feet wide) and the City of St. Louis City Limit; thence westwardly along said centerline of Coal Bank Road a distance of 444.9 feet; thence southwardly, at a deflection angle to the left of 66 degrees, 57 minutes, along a straight line which intersects the south line of said Coal Bank Road, which point of intersection is the beginning of aforesaid easement, and continuing along said straight line to a point distant 103.15 feet, measured along said straight line, from the said centerline of Coal Bank Road; thence at a deflection angle to the right of 02 degrees, 33 minutes, a distance of 300 feet; thence westwardly at a deflection angle to the right of 61 degrees, 05 minutes, along a straight line a distance of approximately 64 feet to its intersection with the west line of aforesaid Lot 7, which point of intersection lies approximately 378 feet south of the centerline of aforesaid Coal Bank Road, measured along said west line of Lot 7. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20' in width on each side of and immediately adjacent to the hereinabove described 10' wide permanent easement, the southeastern and northwestern lines of which 20' wide temporary 6 easements are coincident with the northwestern and southeastern lines, respectively, of said 10' wide permanent easement; said 20' wide easements being bounded on the north by the south line of Coal Bank Road and on the west by the west line of said Lot 7 of the Subdivision of the Estate of Benjamin F. Watkins, Deceased. A permanent easement ten (10) feet wide across Lot 13 of the Subdivision of Benjamin F. Watkins Estate, a subdivision in St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 9, page 37 of the St. Louis City (former County) Recorder's office, excepting therefrom those parts thereof conveyed to St. Louis County, Missouri, by deeds recorded in Book 4314, page 530 and Book 5870, page 323 of the St. Louis County Records, which property is now or formerly of ELIZABETH GRECKY, widow of Maxim K. Grecky, deceased. The centerline of said easement is described as follows: Beginning on the southern line of aforesaid Lot 13, distant along said southern line 124 feet easterly from the southwest corner of said Lot 13; thence northeastwardly, making an angle with said southern line of 62 degrees, 40 minutes, in the northeast quadrant, a distance of 83 feet; thence continuing northeastwardly at a deflection angle to the right of 06 degrees, 13 minutes, a distance of 760 feet; thence eastwardly, at a deflection angle to the right of 41 degrees, 15 minutes a distance of 176 feet, more or less, to its intersection with the eastern line of aforesaid Lot 13, which point of intersection lies 7 approximately 378 feet south of the centerline of Coal Bank Road, measured along aforesaid eastern line of Lot 13. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20' in width on each side of and immediately adjacent to the hereinabove described permanent 10' wide easement, the northwestern and southeastern lines of which 20' wide temporary easements are coincident with the southeastern and northwestern lines, respectively, of said 10' wide permanent easement; said 20' wide easements being bounded on the south and on the east by the south and east lines, respectively, of said Lot 13 of the Subdivision of the Benjamin F. Watkins Estate. A permanent easement ten (10) feet wide across Lot 3 of Schantz Subdivision, a subdivision of St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 114, page 79 of the St. Louis County records, which property is now or formerly of ALFRED J. SNYDER and Irene Weiss Snyder, his wife. The centerline of said easement is described as follows: Beginning in the east line of aforesaid Lot 3, distant South 08 degrees, 00 minutes East, 73 feet from the northeast corner thereof, measured along said east line; thence South 35 degrees, 19 minutes West, 127 feet; thence South 51 degrees, 29 minutes West, approximately 308 feet to its intersection with the northern line of Dunn Road, which is also the southern line of 8 aforesaid Lot 3, at a point distant 109.7 feet, more or less, eastwardly along said road line from the southwest corner of said Lot 3. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20' in width on each side of and immediately adjacent to the hereinabove described 10' wide permanent easement, the northwestern and southeastern lines of which 20' wide temporary easements are coincident with the southeastern and northwestern lines, respectively, of said 10' wide permanent easement; said 20' wide easements being bounded on the south and on the west by the southern and western lines, respectively, of said Lot 3 of "Shanty Subdivision." A permanent easement ten (10) feet wide across property now or formerly of Edna Muehlemann Rose, ROY MUEHLEMANN and Edwin R. Muehlemann, in St. Louis County, Missouri, in the western part of Lot 5 of the Subdivision of U. S. Survey 114, Township 47 North, Range 7 East, which property is described as containing 22 acres, and bounded as follows: west by the western line of said U. S. Survey 114, being the western line of Lot 5; north by Lot 4 of said Subdivision and south by south line of Lot 5 of said Subdivision and east by a line sufficiently east of the west line of said Subdivision to contain an area of 22 acres; said eastern line running from the south line of said Lot 5 North 10 degrees, 44 minutes East, 10.50 chains to the south line of said Lot 4. 9 EXCEPTING THEREFROM that part thereof taken for road purposes by State of Missouri in Condemnation Proceedings in Cause #238749 of the St. Louis County Circuit Court. The centerline of said easement is described as follows: Beginning at a point in the southern right-of-way line of Interstate Highway 270, distant 601.69 feet westwardly along such right-of-way line from its intersection with the east line of property conveyed to Muehlemann by deed recorded in Book 4118, page 603, St. Louis County Recorder's office; thence southwestwardly, at a deflection angle to the left of 57 degrees, 15 minutes, 191.64 feet; thence continuing southwestwardly, at a deflection angle to the left of 09 degrees, 30 minutes, 117 feet, more or less, to its intersection with the southern line of aforesaid Lot 5 at a point South 82 degrees, 21 minutes East, 692 feet along said southern line from the southwest corner of said Lot 5 of Subdivision of U. S. Survey 114. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20' in width on each side of and immediately adjacent to the hereinabove described 10' wide permanent easement, the eastern and western lines of which 20' wide temporary easements are coincident with the western and eastern lines, respectively, of said 10' wide permanent easement; said 20' wide easements being bounded on the north by the south line of the right-of-way of Missouri - U.S. 10 Highway I-270, as established under Condemnation Proceedings in Cause #238749 of the St. Louis County Circuit Court, and on the south by the south line of said Lot 5 of the Subdivision of U. S. Survey 114. A permanent easement ten (10) feet wide in St. Louis County, Missouri, across property now or formerly of ANDREW FRISELLA and Frances Frisella, his wife, which property is more particularly described as follows: A tract of land in U. S. Survey 114, Township 47 North, Range 7 East, St. Louis County, Missouri, beginning at a point in the west line of said Survey 114, distant 5.30 1/4 chains north from the southwest corner of said Survey 114, thence running South 82 degrees, 19 minutes East, 27.34 chains to a point; thence North 7 degrees, 52 minutes East, 5.31-1/4 chains to a point; thence North 82 degrees, 21 minutes West, 27.33-1/2 chains to a point in the west line of said Survey 114; thence along said west line of said Survey 114, South 7 degrees, 55 minutes West, 5.31-1/4 chains to the place of beginning, containing 14.51 acres, more or less, bounded south by property now or formerly of William C. Glasgow et al. The centerline of said easement is described as follows: Beginning at a point in the line common to Lots 5 and 6 of the Subdivision of U. S. Survey 114, St. Louis County, Missouri, which point is 692 feet east of the intersection of such common lot line and the east line of U. S. Survey 2007, measured 11 along said common lot line; thence South 21 degrees, 05 minutes West, 315 feet; thence South 74 degrees, 41 minutes West, 112 feet, more or less, to its point of intersection with the south line of aforesaid property of Frisella. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20' in width on each side of and immediately adjacent to the hereinabove described 10' wide permanent easement, the eastern and western lines of which 20' wide temporary easements are coincident with the western and eastern lines, respectively, of said 10' wide permanent easement; said 20' wide easements being bounded on the north by the north line of said Lot 6 of the Subdivision of U. S. Survey 114 and on the south by the south line of the above described Frisella property. A permanent easement ten (10) feet wide over property now or formerly of Charles E. Arnett and Lora L. Arnett, his wife, an undivided 1/2 interest, and John L. Fry and Marlene R. Fry, his wife, an undivided 1/2 interest, which property is more particularly described as follows: Lot 2 of the Subdivision of the FRY ESTATE, in U. S. Survey 115, Townships 46 and 47 North, Range 7 East, St. Louis County, Missouri, according to plat attached to and made part of deed recorded in Book 979, page 486 and which plat is recorded in Plat Book 26, page 36 of the St. Louis County records, containing 4.18 acres. 12 The centerline of said easement is described as follows: Beginning in the eastern line of aforesaid Lot 2, distant South 14 degrees, 43 minutes East, 2 feet along said eastern line from the northeast corner thereof; thence South 18 degrees, 41 minutes West, 235 feet; thence South 49 degrees, 37 minutes West, 98 feet, more or less, to an intersection with the southern line of aforesaid Lot 2, at a point thereon distant 236 feet west of the southeast corner of said Lot 2, measured along the said southern line thereof. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20' in width on each side of and immediately adjacent to the hereinabove described 10' wide permanent easement, the eastern and western lines of which 20' wide temporary easements are coincident with the western and eastern lines, respectively, of said 10' wide permanent easement; said 20' wide easements being bounded on the north by the north and east lines of said Lot 2 of said Subdivision of the Fry Estate, and on the south by the south line of said Lot 2. A permanent easement ten (10) feet wide over property now or formerly of BELLEFONTAINE COUNTRY CLUB, which property is more particularly described as follows: Lot 5 of the Subdivision of the Fry Estate in U. S. Survey 115, Townships 46 and 47 North, Range 7 East, St. Louis 13 County, Missouri, according to the plat thereof recorded in Plat Book 26, page 36 of the St. Louis County records, and the north part of Lot 7 of the Franz Boedefeld Estate Subdivision in U. S. Survey 115, Townships 46 and 47 North, Range 7 East, St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 13, page 33 of the St. Louis County records, and together described as: Beginning at an iron pipe set at the northeast corner of said Lot 5 of the Subdivision of the Fry Estate; thence South 14 degrees 21 minutes East, 664.91 feet to a point; thence North 82 degrees, 11 minutes West, 497.50 feet to an iron pipe; thence North 7 degrees, 49 minutes East, 240.0 feet to an old iron rod; thence North 62 degrees, 36 minutes West, 968.20 feet to an old iron rod; thence North 19 degrees, 19 minutes West, 92.82 feet to an iron axle; thence South 80 degrees, 41 minutes East, 83.39 feet to an iron pipe, thence South 0 degrees, 37 minutes West, 38.27 feet to an iron pipe, thence South 72 degrees, 09 minutes East, 79.48 feet to an iron pipe, thence North 9 degrees, 35 minutes East, 49.78 feet to an old stone, thence South 80 degrees, 41 minutes East, 1033.25 feet to the point of beginning, containing 10.087 acres, according to a survey executed by Elbring Surveying Company during the month of July, 1959. The centerline of said easement is described as follows: Beginning on the line common to Lots 5 and 4 of the aforesaid Subdivision of the Fry Estate, being also the north line of aforesaid property of the Bellefontaine Country Club, distant 14 South 80 degrees, 41 minutes East, 47 feet along said common lot line from the southwest corner of such Lot 4; thence South 34 degrees, 22 minutes West, 247 feet; thence South 52 degrees, 38 minutes West, 18 feet, more or less, to a point in the northern line of Fry Lane (20 feet wide). Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20' in width on each side of and immediately adjacent to the hereinabove described 10' wide permanent easement, the northwestern and southeastern lines of which 20' wide temporary easements are coincident with the southeastern and northwestern lines, respectively, of said 10' wide permanent easement; said 20' wide easements being bounded on the north and on the south by the north and south lines, respectively, of said Lot 5 of the Subdivision of the Fry Estate. A permanent easement ten (10) feet wide over property now or formerly of JOSEPH THIEMET and Marie Thiemet, his wife, which property is more particularly described as follows: Lot 4 of the Franz Boedefeld Estate Subdivision, in U. S. Survey 115, Townships 46 and 47 North, Range 7 East, St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 13, page 33 of the St. Louis County Records. The centerline of said easement is described as follows: Beginning in the western line of aforesaid Lot 4 15 distant North 07 degrees, 27 minutes East, 79.75 feet along said western line from the southwest corner thereof; thence South 87 degrees, 15 minutes East, 407.57 feet; thence North 69 degrees, 05 minutes East, 94 feet, more or less, to an intersection with the eastern line of aforesaid Lot 4, which point of intersection is North 07 degrees, 27 minutes East, 115 feet, more or less, along said eastern line, from the southeast corner of said Lot 4. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20' in width on each side of and immediately adjacent to the hereinabove described 10' wide permanent easement, the north and south lines of which 20' wide temporary easements are coincident with the south and north lines, respectively, of said 10' wide permanent easement; said 20' wide easements being bounded on the west and on the east by the west and the east lines, respectively, of said Lot 4 of the Franz Boedefeld Estate Subdivision. Permanent easements ten (10) feet wide over property now or formerly of LOUIS ROTH and Rose Roth, his wife, which property is more particularly described as follows: A tract of land in U. S. Survey 115, Townships 46 and 47 North, Range 7 East, St. Louis County, Missouri, more particularly described as follows: Beginning at a point in the south line of Survey 115 at its intersection with the east line of a 20 acre tract of land conveyed to Charles F. Hohmann by deed recorded in Book 35, page 470 and being also the west line of a 16 tract of land conveyed to Henry Roth and wife by deed recorded in Book 286, page 15; thence North 7 degrees, 06 minutes East, 1482.862 feet to a point; thence North 89 degrees, 56 minutes East, 298 feet to an iron pipe; thence North 1 degree, 23 minutes West, 156.94 feet to a point in the centerline of Bellefontaine Church Road; thence along the centerline of said road South 82 degrees, 34 minutes East, 169.004 feet to a point in the west line of Franz Boedefeld Estate Subdivision; thence along the west line of said Subdivision, South 1 degree, 41 minutes West, 983.664 feet to a point; thence South 0 degrees, 03 minutes East, 705.342 feet to the south line of U. S. Survey 115; thence along the said south line North 82 degrees, 28 minutes West, 622.38 feet to the place of beginning, containing 19 acres, more or less, according to a survey made by Richard Elbring, Surveyor during December, 1915, and March, 1916. EXCEPTING THEREFROM that part thereof condemned for the opening and extension of Lilac Avenue, 80 feet wide, under condemnation proceedings in the St. Louis County Circuit Court, Cause No. 224523. The centerline of the first aforesaid ten (10) foot wide easement is described as follows: Beginning in the west line of aforesaid property, distant South 07 degrees, 06 minutes West, 263 feet along such west line from its intersection with the southeast line of Lilac Avenue (80 feet wide); thence South 89 degrees, 03 minutes East, 171 feet to a point which is hereby denominated "Point C"; thence 17 South 58 degrees, 07 minutes East, approximately 393 feet to a point on the eastern line of said property which eastern line is also the western line of Lot 3 of the aforesaid Boedefeld Estate Subdivision, and which point is South 01 degree, 41 minutes West, 348.60 feet along said west line of Lot 3 from the northwest corner of said Lot 3. The centerline of the second aforesaid ten (10) foot wide easement is described as follows: Beginning at aforesaid "Point C"; thence South 47 degrees, 24 minutes West, 262 feet, more or less, to an intersection with the western line of aforesaid property of Roth at a point North 07 degrees, 06 minutes East, 738 feet along said western line from the southwestern corner thereof. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20' in width on each side and immediately adjacent to the hereinabove described 10' wide permanent easements, and further described as including all land lying between said permanent easements and parallel lines on each side of and 25' from the centerlines of the hereinabove described permanent easements; said 20' wide easements being bounded on the east and on the west by the east and west lines, respectively of aforesaid Roth property. A permanent easement ten (10) feet wide over property now or formerly of VERNON P. NEIBERT and Minnie Neibert, his wife, in St. Louis County, Missouri, which tract is more particularly 18 described as follows: The northern 10 acres of a tract of land in U. S. Survey 115, Townships 46 and 47 North, Range 7 East, and more particularly described as follows: Beginning at a hickory tree in the north line of U. S. Survey 115, 18.14 chains east of the northwest corner of said survey at the east line of land conveyed by James Bissell to French Reyburn by deed recorded in Book A-6, page 234 of the records of the City (formerly County) of St. Louis; thence eastwardly along the north line of said Survey 115 to a point at such distance from said place of beginning that a line running, southwardly and parallel with the east line of said tract conveyed to said Reyburn as aforesaid to a point in the south line of said Survey 115 shall form with said east line of said tract conveyed to Reyburn as aforesaid, a parallelogram containing just 20 acres; thence southwardly and parallel with said east line of said tract conveyed to Reyburn as aforesaid to a point in the south line of said Survey 115; thence westwardly along the south line of said Survey 115 to a point in the east line of said tract conveyed to said Reyburn as aforesaid; thence northwardly along the east line of said tract conveyed to said Reyburn as aforesaid to said hickory tree and place of beginning; EXCEPTING THEREFROM that part conveyed to St. Louis County, Missouri according to deed recorded in Book 3883, page 638 of the St. Louis County records. The centerline of aforesaid ten (10) foot wide easement is described as follows: 19 Beginning in the east line of said Neibert property, distant along said east line, South 06 degrees, 58 minutes 50 seconds West, 263 feet from its intersection with the southeastern line of Lilac Avenue (80 feet wide); thence North 89 degrees, 10 minutes 10 seconds West, 362 feet; thence North 49 degrees, 15 minutes 10 seconds West, approximately 191 feet to an intersection with the west line of aforesaid Neibert property; EXCEPTING THEREFROM, that portion thereof conveyed to St. Louis County, Missouri for the opening of Lilac Avenue, by said deed recorded in Book 3883, page 638. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20' in width on each side of and immediately adjacent to the hereinabove described 10' wide permanent easement, the northern and southern lines of which 20' wide temporary easements are coincident with the southern and northern lines, respectively, of said 10' wide permanent easement; said 20' wide easements being bounded eastwardly and westwardly by the east and west lines, respectively, of aforesaid Neibert property, and intermediately by the right-of-way lines of said Lilac Avenue. A permanent easement fifteen (15) feet wide over property now or formerly of ANDREW FRISELLA and Frances Frisella, his wife, which property is more particularly described as follows: A tract of land in U. S. Survey 112, Township 47 North, Range 7 East, St. Louis County, Missouri, traversing that tract of land conveyed to Gerald Raftery and wife by deed recorded in Book 5511, page 409, St. Louis County Recorder's office, the centerline of which 10 foot wide strip of land is described as follows: Beginning in the east line of said Raftery tract, distant along said east line North 07 degrees, 23 minutes East, 46.28 feet from the southeast corner thereof; thence North 44 degrees, 44 minutes West, 86.71 feet; thence North 56 degrees, 32 minutes West, 215.23 feet; and thence North 06 degrees, 25 minutes West, 260 feet to its terminus in the north line of said Raftery property distant along said north line North 88 degrees, 10 minutes East, 10.03 feet from the most western northwest corner of said Raftery tract; said 10 foot wide strip of land being bounded on the east and north by the east and north lines, respectively of said Raftery tract; and EXCEPTING THEREFROM so much thereof as was conveyed to Gene H. Holtzman and wife by deed recorded in Book 1610, page 491, said St. Louis County Recorder's office, the centerline of which 10 foot wide strip is described as: Beginning in the southeast line of Larimore Road, 60 feet wide, distant North 69 degrees, 37 minutes East, 68 feet along said road line from the northwest corner of said Holtzman tract; thence South 11 degrees, 16 minutes West, 506 feet to its terminus in the south line of said Holtzman tract distant South 77 degrees, 14 minutes East, 59.79 feet along 26 said south line from the southwest corner of said tract; said 10' foot wide strip being bounded on the north and on the south by the north and south lines, respectively, of said Holtzman tract. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20' in width on each side of and immediately adjacent to the hereinabove described 10' wide permanent easement, the eastern and western lines of which 20' wide temporary easements are coincident with the western and eastern lines, respectively, of said 10' wide permanent easement; said 20' wide easements being bounded on the north and on the south by the northern and southern lines of the aforesaid Holtzman property. A permanent easement over property now or formerly of LOUIS ROTH, which easement is more particularly described as follows: A parcel of land in U. S. Survey 115, Township 47 North, Range 7 East, St. Louis County, Missouri, at the northeast corner of the tract of land conveyed to Louis Roth and wife by deed recorded in Book 1915, page 68, St. Louis County Recorder's office, and described as follows: Beginning at the northeast corner of said Roth tract; thence along the east line of said Roth tract South 01 degree, 41 minutes West, 21.95 feet; thence North 22 degrees, 29 minutes West, 21.93 feet to the east line of Lilac Avenue, (formerly Bellefontaine Church Road) thence along the east line of Lilac Avenue North 07 degrees, 26 minutes East, 3.03 feet 27 to the north line of said Roth tract; thence along said north line South 82 degrees, 34 minutes East, 9.07 feet to the beginning. A temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as follows: Beginning in the east line of said Roth property at the southernmost corner of the hereinabove described permanent easement; thence along said east line South 01 degree, 41 minutes West, 48.85 feet; thence North 22 degrees, 29 minutes West, 58 feet, more or less, to the south line of Belgrove Drive (formerly Bellefontaine Church Road); thence eastwardly along said south line, 13 feet, more or less to its intersection with the east line of Lilac Avenue (formerly Bellefontaine Church Road); thence northwardly along said east line. A permanent easement ten (10) feet wide over property now or formerly of B & F CONSTRUCTION COMPANY, which property is more particularly described as follows: A strip of land 10 feet wide in Block 35 of NORTHDALE NO. 2, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 28, page 7, St. Louis County Recorder's office, which 10 foot wide strip of land is described as bounded on the west by the east lines of Lots 8 and 43, on the east by the west lines of Lots 9 and 42, on the north by the south line of Cove (formerly Booker) Avenue, and on the south by the north line of Reale Avenue, all in said Block 35; and which 10 foot wide strip is designated as a WALK on said subdivision plat. 28 Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as being over the western 20' of Lots 8 and 42 and over the eastern 20' of Lot 43, all in Block 35 of said "Northdale No. 2"; EXCEPTING THEREFROM so much thereof as is occupied by existing permanent structures or dwellings. A permanent easement ten (10) feet wide over property now or formerly of B & F CONSTRUCTION COMPANY, which property is more particularly described as follows: A strip of land 10 feet wide in Block 34 of NORTHDALE NO. 2, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 28, page 7, St. Louis County Recorder's office, SUBJECT TO instrument vacating certain streets and lots according to instrument recorded in Book 1342, page 255, said Recorder's office, which 10 foot wide strip of land is described as bounded on the west by the east line of Lot 8, on the east by the west line of Lot 9, on the north by the south line of Reale Avenue, and on the south by the south line of said subdivision, all in said Block 34; and which 10 foot wide strip is designated as a WALK on said subdivision plat. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as being over the eastern 20' of Lot 8 and over the western 20' of Lot 9, both in Block 34 of said "Northdale No. 2"; EXCEPTING THEREFROM so much 29 thereof as is occupied by existing permanent structures or dwellings. Section Three. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri, for the appropriation of private property as hereinbefore set out. The foregoing Ordinance was adopted July 12, 1967.
