Members present: Mayor, Wayne Neddermeyer; Councilmembers, Arthur Theis, Thomas Crosby, Nancy Laurent; Clerk, Donna Roehl; Planning and Zoning Administrator, Jeanne Mabusth; Chief of Police, Charles Hoover; Public Works Director, Ron Duran; Attorney Richard Schaeffer; Engineer Lyle Swanson Member absent: William Reiser Minutes of July 5, 1978: Page 79, Item 11: Nancy Laurent asked that the following be added to motion: Reason being that grass had been on the property before the sewer and water project was begun. Motion by Laurent, seconded by Theis to approve the minutes of July 5, 1978, as corrected. Motion declared carried 1. METRO WASTE CONTROL S1U.UY Motion by Theis, seconded by Crosby to :.ppoint Phyllis Willegalla to represent Medina on the Metro Wast;Control study group for the Medina-Morningside area. Motion declared carried 2. PUBLIC WORKS DEPARTMENT Seal Coating Lyle Swanson reported that it would cost approximately $13,000 to seal -coat Hunter Dr. from Hamel Rd., 600 ft. south; Brockton Lane from Hamel Rd., 600 ft. south; Pinto Dr. from Hamel Rd. to Hwy. 55; Hamel Rd. from Plymouth line to Gates Apartments; Willow Dr. from Co. Rd. 24 to Orono line. Motion by Laurent, seconded by Theis to authorize the City Engineer to advertize for bids for seal -coating as listed above and to request Co. -State Aid funds for the project. Bids to be opened at 10:00 A.M. on August 15, 1978. Motion declared carried LeRoy Giese resignation Motion by Laurent, seconded by Theis to accept resignation of LeRoy Giese as of July 28,1978 advertize for a replacement and write a letter of thanks to Mr. Giese. Motion declared carried Hamel Test Well Site Discussion with Joe and Bob Raskob of Medina Recreation of the terms of the purchase agreement. Motion by Laurent, seconded by Theis to adjust the terms of the purchase agreement to indicate the purchase of a 100 x 100 ft. piece of property at a price of $7500.00, city attorney to re -write said terms. Motion declared carried 3. SEPTIC SYSTEM ORDINANCE, P1BLIC HEARING, 8:25 P.M. Mike Hensel of PCA presented slides and history of the development of septic systems. He explained the various methods of waste disposal. Jim Schoen: Are Pere tests the only means of determining the type of septic system to be installed? Hensel: Water table is also a determining factor. Riesenberg: There are 3 types of systems that can be installed. The present Medina ordinance allows just conventional. A11 others require special use permits. Herb Beatty: Is the patented Coolbrath Osmosis System allowed? Mabusth: With a Special Use Permit, as other modified systems. Robert Scott: Does Medina have ordinance that permits use of map showing areas of permitted and not permitted septic systems? llabusth: The map is used as an informational guide. Scott: Caption should be changed. Emil Jubert: What ordinance are we now using: J. Mabusth: State codes. 8 4111 Jubert: Why would Medina have to impose stricter regulations than the State? Hensel: A more strict code WPC 40 has been written by various consultants from all areas when this is signed by the Sec. of State it will be used. haurent: How can a buyer know before he buys a property what type of system wi11 be required? ensel: The only way would be to take a Pero test and check the water table. Jubert: Why is not the Comprehensive plan adopted and then ordinances written as was originally planned? Riesenberg: There are problems that need to be solved now rather than waiting for the comprehensive plan to be adopted. Motion by Theis, seconded by Crosby to close the Public Hearing. Motion declared carried Public Hearing closed at 10:15 P.M. 4. INDEPENDENCE RFIGHTS SMOKE TEST Lyle Swanson reported that test had been conducted as scheduled and that only one house may have a problem. He stated that smoke went to the ground possibly because of nearness to the lake. After consultation with the state plumbing inspector the problem may be with the house vents and perhaps they should be raised above the peak of the roof. Motion by Crosby, seconded by Theis to authorize the engineer to notify residents of the Independence Heights area of the zesults of the lest and recommend possible solutions to the problem. Motion declared carried 5. HUNTER FARMS Darrell Farr explained that there have been delays with completing road construction in Hunter Farms due to the summer rains. He stated that the grading is finished on all but Carriage Dr., that Class 5 gravel will be put on during the week of July 25th and paving completed after that. He also explained the drainage problem across Hunter Dr. from the Holasek farm through Mr. Elling's property and asked that they be allowed to change the drainage to run past the Elling property to Navajo Rd. rather than through his property as it now runs. Motion by Crosby, seconded by Laurent to extend the date of the development contract with Hunter Farms to August 30, 1978 in view of the wet spring and summer rains. Such exten- ion granted with the understanding that the developer continues to use his best effort to complete the roads. Motion declared carried Motion by Laurent, seconded by Theis to change the drainage plans of Hunter Farms plat according to revisions dated 7/11/78. Motion declared carried 6. ACCOUSTICAL FLOORS Jeanne Mabusth reviewed the Planning Commission recommendations for approval of the building they will be constructing on Lot 6, Block 1, Medina Creekside addition. She stated that Elm Creek Watershed district had not had time to review the plans but would do so before a building permit would be issued. Rarold Pederson representing the Medina Creekside Addition developers discussed the work that needs to be done to complete the street and the sewer and water extension. He asked that the project not be held up because of their difficulties. He agreed to meet with the city engineer to determine what work was remaining. Motion by Crosby, seconded by Laurent to approve plans of Accoustical Floors dated 6/27/78, revised 7/11/78, to construct a storage garage and office on Lot 6, Block 1, Medina Creekside Addition, subject to: 1. Culvert to be 15" in diameter 2. Landscaping to be: Sodding around building; Low shrubs, 5 ft. apart, along south side of building; Five 1 -" trees on the east side of building. 3. Bond amount to be $7750 for paving and landscaping 4. Developer to pay administration costs 5. Drainage and grading to be installed according to plans 6. Sod to be provided in all disturbed areas 7. Acceptance of Hickory Dr. and related sewer and water extension, by City Engineer 8. Developer to enter into a development contract with a completion date of July 15, �9s 9. Approval of plans by Elm Creek watershed district. Motion declared carried 7. KEITH NEILSEN Mr. Nielsen, an Employee of Coolbrath, requested to be allowed to do Pere tests in Medina although he is not a soils engineer. Council felt that his doing Pero tests would be a conflict of interest in as much as the company he works for is installing systems in Medina. Thomas Crosby stated that the matter should be tabled until and if a new septic ordinance is adopted. A new ordinance will have regulations regarding qualifications of personnel. 8. M AND P UTILITIES Jeanne Mabusth reviewed Planning Commission recommendations. Lyle Swanson reported that the additional bond for blacktopping should be $300 for 2 parking spaces. Motion by Crosby, seconded by Laurent to approve plans of M and P Utilites to construct a 20 x 40 ft. office addition to their present building on Hwy. 55 and Chippewa Rd. as shown on revised plans dated 7/6/78, subject to: 1. Landscaping, consisting of shrubs, such as lilacs, on the east side of the building and low shurbs along the south side. 2. Building to be painted 3. Septic system to be reivewed 4. 2 additional parking spaces to be provided making a total of 7 5. Additional bond amount of $800 to cover landscaping and additional parking spaces. ( Total bond amount to be ; 4800) 6. Quit -Claim deed for 33 $. road easement along Chippewa Rd. 7. Developer to enter into development contract with a completion date of Oct. 15, 1978. 9. WCCO Thomas Crosby asked that minutes reflect acknowledgement of letter regarding court proceed- ings regarding status of the proposed WCCO tower. 10. JOHNSON-PEET Discussion of the road that Mr. Johnson is constructing through wetlands on his property on Pioneer Rd. Motion by Crosby, seconded by Theis to request a recommendation from the Elm Creek Watershed District as to the possible land alteration caused by Mr. Johnsonts road. Information is to be given to the city attorney to recommend action. Motion declared carried. Abstaining, Nancy Laurent 11. WILLIAM FENHOLT Discussion of letter from Mr. Fenholt requesting the purchase of tax forfeit lot 11 and the west 20 ft. of Lot 10, Block 26, Independence Beach. Richard. Schieffer reported that Mr. Fenholt will be asked to prepare an application for Council. 12. MINNESOTA EXTERIORS BOND Motion by Crosby, seconded by Theis to release the performance bond of Minnesota Exteriors. Motion declared carried 13. ROLLING GREEN COUNTRY CLUB Discussion of letter from Rolling Green Country Club to County Commissioner Robb regarding the cut -back of police services by Hennepin County and the increase in problems at the Country Club. Nancy Laurent reported that a meeting would be held among representatives of the Northwest League of Municipalities , Commissioners Robb and Derus. 14. JOHN DYI O.h'r' Motion by Laurent, seconded by Theis to pay John Dykhoff $75.00 for damages to his home caused by the sewer backing up into his basement. Motion declared carried 86 15. ASSESSING Jeanne Mabusth was asked to secure information from the West Hennepin Assessors and Hennepin County as to cost of assessing Medina 16. BILLS Motion by Crosby, seconded by Theis to pay the bills. of $3372.89. Motion declared carried Payroll # 4981-4990 in the amount 17. LORETTO TOWING Jeanne Mabusth reported that Loretto Towing will be erecting an 8 ft. high fence around their property and blacktopping their parking area in the very near future, to comply with terms of the development agreement. 18. KOST - LINDGREN TAX FORFEIT PROPERTIES Motion by Crosby, seconded by Theis to approve Resolution 78-26, authorizing sale of real- estate to Anthony Kost. Motion declared carried Motion by Crosby, seconded by Laurent to approve Resolution 78-27, authorizing sale of real- estate to Gary M. Lindgren.
