AN ORDINANCE to extend the boundaries of The
Metropolitan St. Louis Sewer District and of the Coldwater Creek
Trunk Subdistrict to include an area of St. Louis County which
could be efficiently served by the sewer facilities of the
District and of the Coldwater Creek Trunk Subdistrict.
WHEREAS, petitions to the Board of Trustees of The
Metropolitan St. Louis Sewer District have been received from the
majority of the owners of the land in said area, who own more than
one-half of the land area therein, praying for annexation to both
the District and the Coldwater Creek Trunk Subdistrict of The
Metropolitan St. Louis Sewer District; and
WHEREAS, this area adjoins The Metropolitan St. Louis
Sewer District and such Coldwater Creek Trunk Subdistrict and the
existing sewers of the District and Subdistrict are adequate to
handle all of its sanitary sewage, that the interests of
sanitation and public health of the District will be promoted by
including the area in its territory; and that the sewage flow from
the area proposed to be annexed has no available outlet through
public sanitary sewers other than those of the District,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. That the Board finds that the sewer
facilities of the District can efficiently serve the area
described as follows:
Beginning at the point of intersection of the center-
line of Shackelford Road and Charbonier Road, which is a point
on the existing boundary of The Metropolitan St. Louis Sewer
District; thence northwestwardly along the said centerline of
Charbonier Road a distance of approximately 1,650 feet to the
point of intersection with the southwestern prolongation of a
line parallel with and 112.285 feet westwardly from, and
measured at right angles to, the eastern line of Lot 6,
Charbonier Acres, a subdivision of St. Louis County, Missouri,
according to the plat thereof recorded in Plat Book 43, page
36 of the St. Louis County Records; thence northeastwardly
along said prolongation and along said parallel line to its
intersection with the northern line of said Lot 6; thence
northwestwardly along said northern line of Lot 6, a distance of
7.235 feet to a point; thence North 37 degrees, 02 minutes West a
distance of 988.03 feet to a point; thence South 52 degrees,
34 minutes East a distance of approximately 2,225 feet to the
centerline of Shackelford Road, which is a point on the existing
boundary of The Metropolitan St. Louis Sewer District; thence
southwestwardly, northwestwardly, southwestwardly,
southeastwardly, and southwestwardly, along said existing boundary
of The
Metropolitan St. Louis Sewer District to the point of beginning.
Section Two. That the petitions praying for annexation
were signed by the majority of the owners of the land in said area
who own more than one-half of the land area therein.
Section Three. That the interests of sanitation and
public health of the District will be promoted by including the
area in its territory. -2-
Section Four. That the sewage flow from the area
proposed to be annexed has no available outlet through public
sanitary sewers other than those of the District.
Section Five. The corporate boundaries of The
Metropolitan St. Louis Sewer District and the Coldwater Creek
Trunk Subdistrict are hereby extended so as to include the above
described area.
Section Six. Certified copies of this ordinance shall
be filed in the offices of the Recorder of Deeds of St. Louis
County, the Recorder of Deeds of the City of St. Louis, and the
Secretary of State. The foregoing Ordinance was adopted October 2, 1967.
