AN ORDINANCE, declaring the necessity for the
acquisition of easements over and across certain property located
outside the boundaries of The Metropolitan St. Louis Sewer
District, for the purpose of permitting the construction of sewers
therein to serve the needs of residents of The Metropolitan St.
Louis Sewer District and authorizing the acquisition of such
easements by purchase or institution of condemnation proceedings.
WHEREAS, there exists within The Metropolitan St. Louis
Sewer District, an area in St. Louis County, Missouri, downstream
from the existing Coldwater Creek Sewage Treatment Plant in which
there live and work numerous people; and
WHEREAS, sanitary sewage gathered from such area will
constitute a menace to public health and welfare of the general
public, and the residents of The Metropolitan St. Louis Sewer
District, and in order to relieve and alleviate such conditions
and to reduce the pollution of waters caused by discharges of
wastes, it is the purpose and design of The Metropolitan St. Louis
Sewer District to construct a sewer line, and pumping station to
pump sanitary sewage from such area back to the Coldwater Creek
Sewage Plant for treatment; and
WHEREAS, it is necessary in order to construct such
sewer to acquire easements over and across, a parcel of property
lying outside the existing boundaries of The Metropolitan St.
Louis Sewer District, between the site of the proposed pumping
station and the Coldwater Creek Sewage Plant, both of which are

located within the boundaries of The Metropolitan St. Louis Sewer
District.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and
relieve insanitary and dangerous conditions, it is necessary to
appropriate and acquire by the exercise of eminent domain or
otherwise, an easement for the use of a sewer line as hereinafter
set forth, together with temporary easements adjacent to the
right-of-way as obtained for working room during the construction
period, and the right of ingress and egress over the premises
sought to be condemned for access to such easements, said
permanent and temporary easements being more particularly
described as follows:
Permanent Easement
A permanent easement 10' wide, over, across and thru a tract
of land situated in U. S. Survey 2771 and in Fractional
Sections 8 and 17, Township 47 North, Range 7 East, St. Louis
County, Missouri, which tract of land is held by David
Sokolik, Joseph Sokolik and Regina Smith, as Trustees, under
Trust Agreement dated December 28, 1959, and recorded in Book
4222, page 40 St. Louis County Recorder's office, the
centerline of which 10' wide easement is described as:
Beginning in the west line of said Sokolik, et al, property
distant along said west line North 00#, 40 minutes East,

942.30 feet from its intersection with the north line of U.
S. Survey 2771; thence South 54#, 42 minutes East, 905.3
feet, more or less, to its terminus in the east line of said
Sokolik, et al, property distant northwardly along said east
line, 425.31 feet from the intersection of the western
segment of the north line of U. S. Survey 2771 with the west
line of U. S. Survey 1012; said 10' wide strip of land being
bounded at its northwest and southeast ends by the western
and eastern lines, respectively, of said Sokolik, et al
property.
Temporary Easement
During original construction of sewer facilities after which
all rights of the Condemnor shall cease, which temporary
easements are described as strips of land 20' in width on
each side of, and immediately adjacent to, the hereinabove
described 10' wide permanent easement, the northeastern and
southwestern lines of which 20' wide temporary easements are
coincident with the southwestern and northeastern lines,
respectively, of said 10' wide permanent easement; said 20'
wide temporary easements being bounded on the northwest and
on the southeast by the western and eastern lines,
respectively, of said Sokolik, et al property.
Section Two. Counsel for The Metropolitan St. Louis
Sewer District be and is hereby authorized to acquire by purchase,
if possible, subject to approval of the Board of Trustees, or to
institute and prosecute an action in condemnation, as authorized

by law, if necessary, to appropriate and acquire the aforesaid
private property.
The foregoing Ordinance was adopted November 7, 1967.
