HomeMy Public PortalAbout01684 O R D I N A N C E NO. 1684 AN ORDINANCE, declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District, for the purpose of permitting construction of sewers therein to serve the needs of residents of the area and authorizing the acquisition of such easements by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of St. Louis County, Missouri known as Subdistrict No. 235, (Des Peres Branch of Sugar Creek) wherein there live and work numerous people; and WHEREAS, sanitary sewage gathered from such area will have no alternative means of disposition to crossing said property and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health by constructing sanitary sewers over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or 2 otherwise, an easement for the use of a sewer line as hereinafter set forth, together with temporary easements adjacent to the right- of-way as obtained for working room during the construction period,and the right of ingress and egress over the premises sought to be condemned for access to such easements, said permanent and temporary easements being more particularly described as follows: A permanent easement 10 feet wide over property now or formerly of Robert H. Ackerman and wife, which easement is more particularly described as follows: A strip of land 10 feet wide in the Northeastern 1/4, Section 34, Township 45 North, Range 5 East, St. Louis County, Missouri, traversing that property in said Section 34 conveyed to Robert H. Ackerman and wife by deed recorded in Book 5391, page 251, St. Louis County Recorder's office, the centerline of which 10 foot wide strip of land is described as: Beginning in the south line of said Ackerman property distant therealong North 89 degrees, 07 minutes West, 299.05 feet from the southeast corner thereof; thence North 21 degrees, 26 minutes West, 140.52 feet to its terminus in the north line of said Ackerman property distant therealong North 89 degrees 07 minutes West, 352.22 feet from its northeast corner; said 10 foot wide strip of land being bounded on the south and on the north by the south and north lines, respectively, of said Ackerman property. 3 Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20 feet in width on each side of, and immediately adjacent to the hereinabove described 10 foot wide permanent easement, the western and eastern lines of which 20 foot wide temporary easements are coincident with the eastern and western lines, respectively, of said 10 foot wide permanent easement; said 20 foot wide temporary easements being bounded on the south and on the north by the south and the north lines, respectively, of said Ackerman property. A permanent easement 10 feet wide over property now or formerly of Robert H. Ackerman and wife, which easement is more particularly described as follows: A strip of land 10 feet wide in the Northeastern 1/4 Section 34, Township 45 North, Range 5 East, St. Louis County, Missouri, traversing that property in said Section 34 conveyed to Robert H. Ackerman and wife by deed recorded in Book 5824, pages, St. Louis County Recorder's office, the centerline of which 10 foot wide strip of land is described as: Beginning in the south line of said Ackerman property distant North 89 degrees, 07 minutes West, 142.29 feet therealong from the 4 southeast corner thereof; thence North 12 degrees 46 minutes West, 44.44 feet; thence North 58 degrees 27-1/2 minutes West, 170.26 feet to its terminus in the north line of said Ackerman property distant South 89 degrees 07 minutes East, 0.95 feet therealong from its northwest corner; said 10 foot wide strip of land being bounded on the south by the south line and on the northwest by the north and west lines of said Ackerman property. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20 feet in width on each side of, and immediately adjacent to, the hereinabove described 10 foot wide permanent easement,the northeastern and southwestern lines of which 20 foot wide temporary easements are coincident with the southwestern and northeastern lines respectively, of said 10 foot wide permanent easement; said 20 foot wide temporary easements being bounded on the south by the south line and on the northwest by the west and north lines of said Ackerman Property. A permanent easement 10 feet wide over property now or formerly of Robert H. Ackerman and wife, which easement is more particularly described as follows: 5 A strip of land 10 feet wide in the Northeastern 1/4 Section 34, Township 45 North, Range 5 East, St. Louis County, Missouri, traversing that property in said Section 34 conveyed to Robert H. Ackerman and wife by deed recorded in Book 3216, page 301, St. Louis County Recorder's office, the centerline of which 10 foot wide strip of land is described as: Beginning in the south line of said Ackerman property distant therealong North 89 degrees 07 minutes West, 147.22 Sect from the southwest corner of property conveyed to John H. Kuhn and wife by deed recorded in Book 4973, page 195, said Recorder's office; thence North 21 degrees, 26 minutes West, 59.48 feet; thence North 32 degrees 16 minutes West, 187.98 feet to its terminus in the north line of said Ackerman property distant therealong North 89 degrees 07 minutes West, 272.29 feet from the northwest corner of said Kuhn property; said 10 foot wide strip of land being bounded on the south and on the north by the south and north lines, respectively, of said Ackerman property. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20 feet in width on each side of, and immediately adjacent to, the hereinabove described 10 foot wide permanent easement, the eastern and western lines of which 20 foot wide 6 temporary easements are coincident with the western and eastern lines, respectively, of said 10 foot wide permanent easement; said 20 foot wide easements being bounded northwardly and southwardly by the north and south lines, respectively, of said Ackerman property. A permanent easement 10 feet wide over property now or formerly of Martin Bachert and wife, which easement is more particularly described as follows: A strip of land 10 feet wide in the Western 1/2 of the Southwestern 1/4 of Section 34, Township 45 North, Range 5 East, St. Louis County, Missouri, traversing property in said Section 34 conveyed to Martin Bachert and wife by deeds recorded in Book 2251, page 216 and Book 2254, page 164, St. Louis County Recorder's office, the centerline of which 10 foot wide strip of land is described as: Beginning in the south line of said Bachert property distant westwardly therealong 101. 00 feet from its intersection with the west right-of-way line of Missouri U.S. Highway I-244 as established by condemnation in Cause No. 244520 of the Circuit Court of St. Louis County; thence northwardly in a straight line, 213 feet, more or less, to its terminus in the north line of said Bachert property distant westwardly therealong 109.00 feet from its intersection with said west right-of-way 7 line of Highway 1-244; said 10 foot wide strip of land being bounded on the south and on the north by the south and north lines, respectively, of said Bachert property. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20 feet in width on each side of and immediately adjacent to, the hereinabove described 10 foot wide permanent easement, the western and eastern lines of which 20 foot wide temporary easements are coincident with the eastern and western lines, respectively, of said 10 foot wide permanent easement; said 20 foot wide easements being bounded northwardly and southwardly by the north and south lines, respectively, of the aforesaid Bachert property. A permanent easement 10 feet wide over property now or formerly of Robert Louis Blattner and wife, which easement is more particularly described as follows: A strip of land 10 feet wide in the Eastern 1/2 Southwestern 1/4 Section 34, Township 45 North, Range 5 East, St. Louis County, Missouri, traversing property in said Section 34 conveyed to Robert Louis Blattner and wife by deed recorded in Book 3291, page 543, St. Louis County Recorder's office, the centerline of which 10 foot wide strip of land is 8 described as: Beginning in the north line of said Blattner property distant therealong South 89 degrees 30 minutes East, 319.5 feet from its northwest corner; thence South 36 degrees 49 minutes West, 103.3 feet; thence South 25 degrees 11 minutes East, 88 feet, more or less, to its terminus in the south line of said Blattner property distant therealong South 89 degrees 30 minutes East, 295.8 feet from its southwest corner; said 10 foot wide strip of land being bounded on the north and on the south by the north and south lines, respectively, of said Blattner property. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20 feet in width on each side of and immediately adjacent to, the hereinabove described 10 foot wide permanent easement, the western and eastern lines of which 20 foot wide temporary easements are coincident with the eastern and western lines, respectively, of said 10 foot wide permanent easement; said 20 foot wide easements being bounded on the north and on the south by the north and south lines, respectively, of said Blattner property. A permanent easement, 10 feet wide, over property nor or formerly of Norval A. Carron and wife, which easement is more 9 particularly described as follows: A strip of land 10 feet wide traversing that part of Lot 1 of WHITE OAKS, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 1, page 124, St. Louis County Recorder's office, that was conveyed to Norval A. Carron and wife by deed recorded in Book 5114, page 302, said Recorder's office, the centerline of which 10 foot wide strip of land is described as: Beginning in the west line of said Lot 1 distant therealong North 00 degree 43 minutes East, 55.65 feet from the southwest corner thereof; thence North 61 degrees 38 minutes East, 65.50 feet; thence North 53 degrees, 34 minutes East, 348.83 feet to its terminus in the north line of said Carron property distant therealong North 88 degrees 58 minutes West, 7.89 feet from the northeast corner thereof; said 10 foot wide strip of land being bounded at its southwestern end by the east line of Lindeman Road, 30 feet wide, and at its northeastern end by the north and east lines of said Carron property; EXCEPTING THEREFROM a small triangular part thereof, being the northwestern part of property conveyed to Barbara E. Reynolds by deed recorded in Book 5886, page 577, embraced therein. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as: strips of 10 land 20 feet in width on each side of and immediately adjacent to, the hereinabove described 10 foot wide permanent easement, the northwestern and southeastern lines of which 20 foot wide easements are coincident with the southeastern and northwestern lines, respectively, of said 10 foot wide permanent easement; said 20 foot wide easements being bounded southwestwardly by the east line of Lindeman Road, 30 feet wide, and northeastwardly by the north and east lines of said Carron property. A permanent easement 10 feet wide over property now or formerly of Bernard Cohen and wife, which easement is more particularly described as follows: A strip of land 10 feet wide in the Southwestern 1/4 of the Northeastern 1/4 of Section 34, Township 45 North, Range 5 East, St. Louis County, Missouri, traversing that property in said Section 34 conveyed to Bernard Cohen and wife by deed recorded in Book 5707, page 410, St. Louis County Recorder's office, the centerline of which 10 foot wide strip of land is described as: Beginning in the east line of said Cohen property distant South 00 degree 48 minutes West, 5.00 feet therealong from its northeast corner; thence parallel with the north line of said Cohen property North 89 degrees 07 minutes West, 147.85 feet; thence South 45 degrees 43-2/3 minutes 11 West, 345.55 feet to its terminus in the south line of said property at a point distant North 89 degrees 07 minutes West, 391.88 feet therealong from the southeast corner thereof; said 10 foot wide strip of land being bounded eastwardly and southwardly by the east and south lines, respectively, of said Cohen property. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as: (1) Strips of land 20 feet wide on each side of, and immediately adjoining that portion of the hereinabove described permanent 10 foot wide easement coursing South 45 degrees 43-2/3 minutes West, 352.60 feet, the northwestern and southeastern lines of which 20 foot wide strips are coincident with the southeastern and northwestern lines, respectively, of said portion of said 10 foot wide permanent easement; said 20 foot wide easements being bounded northwardly and southwardly by the north and south lines, respectively, of said Cohen property. (2) A strip of land 40 feet wide to the south of, and immediately adjoining that portion of the hereinabove described permanent 10 foot wide easement coursing North 89 degrees 07 minutes West; said 40 foot wide easement being bounded on the east by the east line of said Cohen property and on the west by the southeastern line of the 12 southeasternmost of the 20 foot wide easements described in (1> immediately above. A permanent easement, 10 feet wide, over property now or formerly of Edith Ellis, which easement is more particularly described as follows: A strip of land 10 feet wide traversing Lot 2 of WHITE OAKS, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 1, page 124, St. Louis County Recorder's office, the centerline of which 10 foot wide strip of land is described as: Beginning in the west line of said Lot 2 distant therealong South 00 degree 43 minutes West, 202.31 feet from its northwest corner; thence North 53 degrees 34 minutes East, 131.27 feet;and thence North 50 degrees 05 minutes 48 seconds East, 197.22 feet to its terminus in the north line of said Lot 2 distant therealong South 89 degrees 01 minute East, 246.74 feet from the northwest corner thereof; said 10 foot wide strip of land being bounded at its southwestern and northeastern ends by the west and north lines respectively, of said Lot 2. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20 feet in width an each side of and immediately adjacent 13 to, the hereinabove described 10 foot wide permanent easement, the northwestern and southeastern lines of which 20 foot wide easements are coincident with the southeastern and northwestern lines, respectively, of said 10 foot wide permanent easement; said 20 foot wide easements being bounded at its southwestern and northeastern ends by the west and north lines, respectively, of said Lot 2. Permanent easements 10 feet wide over property now or formerly of Charles S. Erber and wife, which property is described as Lot IS of HUE VISTA ADD'N., NO. 2, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 55, page 15, St. Louis County Recorder's office, and which easements are described as strips of land 10 feet wide executing a "Y" shaped traverse across said Lot 15, and described as follows: (1) A strip of land 10 feet wide, the centerline of which is described as: Beginning in the western line of said Lot 15, distant therealong North 17 degrees 22 minutes IS seconds East, 26.93 feet from the southwest corner thereof; thence North 85 degrees 08 minutes 15 seconds East, 145.96 feet to a point hereby designated "A"; thence North 35 degrees 48 minutes 35 seconds East, 241.47 feet to a terminus in the northern line of said Lot 15 distant therealong North 72 degrees 53 minutes 50 seconds West, 36.94 feet from the 14 northeast corner thereof; said 10 foot wide strip of land being bounded on the west and on the north by the western and northern lines, respectively, of said Lot 15. (2) A strip of land 10 feet wide, the centerline of which is described as: Beginning at Point "A" as described in (1) above; thence South 04 degrees 51 minutes 45 seconds East, 47.01 feet to a terminus in the south line of said Lot IS distant therealong North 67 degrees 54 minutes West, 177.84 feet from the southeast corner thereof; said 10 foot wide strip of land being bounded on the south by the south line of said Lot 15, and on the north by the southeast line of the 10 foot wide strip described in (1), above; EXCEPTING THEREFROM that part thereof embraced within the 10 foot wide easement previously established over the south 10 feet of said Lot 15 on said plat of HUE VISTA ADDITION NO. 2. A temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as follows: Beginning at the southwest corner of said Lot 15; thence along the west line of Lot 15, North 17 degrees 22 minutes 15 seconds East, 64.84 feet; thence South 89 degrees, 04 minutes East, 156 feet, more or less, to an intersection with the southeastern line of the 10 foot wide permanent easement described in (1), above; thence northeastwardly along said 15 southeastern line to the northern line of said Lot 15; thence eastwardly along said northern line to the northeast corner of said Lot 15; thence southwardly along the eastern line of said Lot 15 to its intersection with a line parallel with and 40 feet southeastwardly from measured at right angles to, the southeast line of the 10 foot wide permanent easement described in (1), above; thence southwestwardly along said parallel line, and its straight southwestern prolongation, to its intersection with the south line of said Lot 15; thence along said south line North 67 degrees 54 minutes West, 33 feet, more or less, to an angle point therein; thence continuing along said south line North 89 degrees 04 minutes West, 141.58 feet to the beginning; EXCEPTING THEREFROM those parts thereof embraced within the easements previously established for sewer purposes on said plat of HUE VISTA ADDITION NO. 2, and within the permanent 10 foot wide easements described in (1) and (2), above. A permanent easement 10 feet wide over property now or formerly of Albert Raymond Kreitz and wife, which easement is more particularly described as follows: A strip of land 10 feet wide in the Western 1/2 Southwest 1/4 Section 34, Township 45 North,Range 5 East, St. Louis County, Missouri, traversing that property in said Section 34 16 conveyed to Albert Raymond Kreitz and wife by bed recorded in Book 2183, page 576, St. Louis County Recorder's office the centerline of which 10 foot wide strip of land is described as: Beginning in the south line of said Kreitz property distant therealong North 89 degrees 41 minutes West, 5.02 feet from its intersection with the western line of Missouri-U.S. Highway 1-244 as established by Cause #244520 of the Circuit Court of St. Louis County, Missouri; thence parallel with the west line of said Highway I-244, North 05 degrees 12 minutes West, 137.00 feet; thence North 55 degrees 51 minutes West, 65.00 feet; thence North IS degrees 06 minutes West, 262.00 feet; and thence North 07 degrees 16 minutes West, 35 feet, more or less, to its terminus in the north line of said Kreitz property distant therealong North 89 degrees 28 minutes West, 101 feet, more or less, from its intersection with the west line of said Highway I-244; said 10 foot wide strip of land being bounded on the south and on the north by the south and north lines, respectively, of said Kreitz property. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land aggregating 40 feet in width, and which temporary easement areas are described as being all that part of said Kreitz property lying within 25 feet on each side of the 17 following described centerline: Beginning in the south line of said Kreitz property distant therealong North 89 degrees 41 minutes West, 25.12 feet from its intersection with the western line of said Highway 1-244; thence parallel with said right-of-way line North 05 degrees 12 minutes West, 151.47 feet; thence North 55 degrees 51 minutes West, 39.14 feet; thence North 15 degrees 06 minutes West, 262.00 feet; and thence North 07 degrees 16 minutes West, 35 feet, more or less, to its terminus in the north line of said Kreitz property distant therealong North 89 degrees 28 minutes West, 101 feet or less, from its intersection with the west line of said Highway I-244; said temporary easements being bounded northwardly and southwardly by the north and south lines, respectively, of said Kreitz property; EXCEPTING THEREFROM that part thereof described hereinabove as a 10 foot wide permanent easement. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land aggregating 40 feet in width and which temporary easement areas are described as being all that part of said Loehr Investments, Inc. land lying within 25 feet on each side of the following described centerline: Beginning in the north 19 line of said Southwestern 1/4 Northwest 1/4 Section 3, distant therealong North 89 degrees 12 minutes West, 25.14 feet from its intersection with the west right-of-way line of said Highway I-244; thence parallel with said right-of-way line South 05 degrees 12 minutes East, 221.57 feet; thence South 34 degrees 18 minutes West, 734.96 feet; thence South 08 degrees 33 minutes West, 457.00 feet; thence South 06 degrees 37 minutes West, 295 feet, more or less, to its terminus in the north line of Dougherty Ferry Road, distant westwardly therealong 635.14 feet from its intersection with said west right-of-way line of Highway I-244, said temporary easements being bounded northwardly by the north line of said Loehr Investments, Inc. property and southwardly by the north line of Dougherty Ferry Road; EXCEPTING THEREFROM that part thereof described hereinabove as a 10 foot wide permanent easement. A permanent easement 10 feet wide over property now or formerly of Loehr Investments, Inc., which easement is more particularly described as follows: A strip of land 10 feet wide in the Northwestern 1/4 of the Southwestern 1/4 of Section 3, Township 44 North, Range 5 East, St. Louis County, Missouri, traversing said part of said Section 3 as conveyed to Loehr Investments, Inc., by deed recorded in Book 4112, page 268, St. Louis County Recorder's office, the centerline of which 10 foot wide strip of land is 20 described as-: Beginning in the southern right-of-way line of Dougherty Ferry Road, distant westwardly therealong 180 feet from its intersection with the westwardly line of Highland Avenue, said right-of-way line of Dougherty Ferry Road being on a curve concave to the north with a radius of 1,256.28 feet; thence southeastwardly in a straight line, 511 feet, more or less, to its terminus on said westwardly line or Highland Avenue, distant 19 feet therealong from its intersection with the northern line of property conveyed to Metropolitan St. Louis Sewer District by deed recorded in Book 4440, page 409, said Recorder's office; said 10 foot wide strip of land being bounded northwestwardly and southeastwardly by the southern and western lines of Dougherty Ferry Road and Highland Avenue, respectively. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20 feet in width on each side of, and immediately adjacent to, the hereinabove described 10 foot wide permanent easement, the northeastern and southwestern lines of which 20 foot wide temporary easements are coincident with the southwestern and northeastern lines, respectively, of said 10 foot wide permanent easement; said 20 foot wide easements being bounded northwestwardly and southeastwardly by the 21 southern and western lines, respectively, of said Dougherty Ferry Road and Highland Avenue. A permanent easement 10 feet wide over property now or formerly of Julius Nickel and wife, which easement is more particularly described as follows: A strip of land 10 feet wide in the Eastern 1/2 of the Southwestern 1/4 of Section 34, Township 45 North, Range 5 East, St. Louis County, Missouri, traversing that property in said Section 34 conveyed to Julius Nickel and wife by deed recorded in Book 578, page 225, St. Louis County Recorder's office, the centerline of which 10 foot wide strip of land is described as: Beginning in the south line of said Nickel property distant 715.00 feet westwardly therealong from its intersection with the west line of Ballas Road, 60 feet wide; thence northeastwardly in a straight line 709 feet, more or less, to its terminus in the north line of said Nickel property distant 200.00 feet westwardly therealong from its intersection with said west line of Ballas Road; said 10 foot wide strip of land being bounded on the south and on the north by the south and north lines, respectively, of said Nickel property. Olms, which property is described as Lot 14 of HUE VISTA ADDITION NO. 2, a subdivision in St. Louis County, Missouri as per plat thereof recorded in Plat Book 55, page 15, St. Louis County Recorder's office, and which easement is described as follows: A strip of land 10 feet wide, the centerline of which is described as: Beginning in the southern line of said Lot 14 distant therealong North 72 degrees 53 minutes 50 seconds West, 36.94 feet from the southeast corner of said Lot 14; thence North 35 degrees 48 minutes 35 seconds East, 63.12 feet to its terminus in the east line of said Lot 14 distant therealong North 01 degree 30 minutes East, 62.07 feet from said southeast corner of Lot 14; said 10 foot wide strip of land being bounded on the south and on the north by the 23 southern and eastern lines, respectively, of said Lot 14; EXCEPTING THEREFROM that part thereof embraced within the 10 foot wide easement previously established over the east 10 feet of said Lot 14 on said plat of HUE VISTA ADDITION NO. 2. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are over parcels of land described as follows: (1) A small triangular parcel of land in said Lot 14 described as bounded on the south by the south line of said Lot 14, bounded on the east by a line parallel with and 10 feet west of, measured at right angles to, the east line of said Lot 14, and bounded on the northwest by the southeast line of the 10 foot wide permanent easement described above. (2) A strip of land 20 feet wide, in said Lot 14, described as bounded on the southeast by the northwest line of the 10 foot wide permanent easement hereinabove described, bounded on the northwest by a line parallel with and 20 feet northwest of, measured at right angles to, said northwest line of said 10 foot wide permanent easement hereinabove described, bounded on the south by the south line of said Lot 14, and bounded on the east by a line parallel with and 10 feet west of, measured at right angles to, the east line of said Lot 14. 24 A permanent easement 10 feet wide over property now or formerly of St. Paul's Lutheran Cemetery Association of Des Peres, Missouri, a corporation, which easement is more particularly described as follows: A strip of land 10 feet wide in the Northwestern 1/4 of the Southwestern 1/4 of Section 34, Township 45 North, Range 5 East, St. Louis County, Missouri traversing that property conveyed to St. Paul's Lutheran Cemetery Association of Des Peres, Missouri, a corporation by deed recorded in Book 5198, page 337, St. Louis County Recorder's office; the centerline of which 10 foot wide strip of land is described as: Beginning in the south line of said Cemetery Association property distant eastwardly therealong 56 feet from its intersection with the east line of property conveyed to the State of Missouri for highway purposes by deed recorded in Book 4705, page 269, said Recorder's office; thence northwardly in a straight line 230 feet, more or less, to its terminus in the north line of said Cemetery Association property at a point distant 74 feet eastwardly therealong from its intersection with the east line of said, property conveyed to the State of Missouri; said 10 foot wide strip of land being bounded on the south and on the north by the south and north lines, respectively, of said Cemetery Association property. A temporary easement during original construction of 25 sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as all that part of said Cemetery Association property lying east of Missouri U. S. Highway I-244 as established by said conveyance recorded in Book 4705, page 269, St. Louis County Recorder's office; EXCEPTING THEREFROM that part thereof hereinabove described as a 10 foot wide permanent easement. A permanent easement 10 feet wide over property now or formerly of Roy A. Schacht which easement is more particularly described as follows: A strip of land 10 feet wide in the Southwestern 1/4 of the Southwestern 1/4 of Section 34, Township 45 North, Range 4 East, St. Louis County, Missouri, within property conveyed to Roy A. Schacht by deed recorded in Book 3951, page 449, St. Louis County Recorder's office, said 10 foot wide strip being described as: Beginning at the intersection of the north line of said Schacht property with the west right-of-way line of Missouri U.S. Highway I-244 as established by condemnation in Cause No. 244520 of the Circuit Court of St. Louis County; thence southwardly along the west line of said property so conveyed to the State of Missouri, 155.00 feet; thence westwardly along a line parallel with said north line of said Schacht property, 10 feet, more or less, to its intersection 26 with a line parallel with and 10 feet westwardly from, measured at right angles to, the west line of said State of Missouri property; thence northwardly along said last described parallel line, 155.00 feet to its intersection with the north line of said Schacht property; thence eastwardly along said north line 10 feet, more or less, to the beginning. A temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as being over' all that part of said Schacht property bounded on the north and on the south by the north and south lines, respectively, of said Schacht property, on the east by the west right-of-way line of said Highway I-244 and on the west by a line parallel with and 50 feet westwardly from measured at right angles to, said west line of said Highway I-244; EXCEPTING THEREFROM that part thereof hereinabove described as a permanent easement. A permanent easement over property now or formerly of Kenneth M. Schaefer and wife, which easement is more particularly described as follows: A strip of land 10 feet wide in the North 1/2 of the Northeastern 1/4 of Section 3, Township 44 North, Range 5 East, St. Louis County, Missouri, traversing that property in 27 said Section 3 conveyed to Kenneth M. Schaefer and wife by deed recorded in Book 2814, page 595, St. Louis County Recorder's office, the centerline of which 10 foot wide strip of land is described as: Beginning in the west line of said Schaefer property distant North 01 degree 35 minutes East, 62.07 feet from the southeast corner of Lot 14 of HUE VISTA ADDITION NO. 2, a subdivision in St. Louis County, Missouri as per plat thereof recorded in Plat Book 55, page 15, St. Louis County Recorder's office; thence North 35 degrees 53 minutes 35 seconds East, 40.01 feet; thence North 29 degrees 27 minutes 50 seconds East, 143.90 feet;thence North 50 degrees 22 minutes 20 seconds East, 117.52 feet to its terminus in the north line of said Schaefer property distant South 88 degrees 20 minutes East, 178.25 feet therealong from the northwest corner thereof; said 10 foot wide strip of land being bounded southwestwardly and northeastwardly by the western and northern lines, respectively, of said Schaefer property. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20 feet in width on each side of, and immediately adjacent to, the hereinabove described 10 foot wide permanent easement, the southwestern and northeastern lines of which 20 foot wide temporary easements are coincident with the 28 northeastern and southwestern lines, respectively, of said 10 foot wide permanent easement; said 20 foot wide temporary easements being bounded on the southwest and on the northeast by the west and north lines, respectively, of said Schaefer property. A permanent easement, 10 feet wide, over property now or formerly of George A. Thurza and wife, which easement is more particularly described as follows: A strip of land 10 feet wide in the Southwestern 1/4 of the Northeastern 1/4 of Section 34, Township 45 North, Range 5 East, St. Louis County, Missouri, traversing that property in said Section 34 conveyed to George A. Thurza and wife by deed recorded in Book 5551, page 571, St. Louis County Recorder's office, the centerline of which 10 foot wide strip of land is described as: Beginning in the south line of said Thurza property distant therealong North 89 degrees 07 minutes West, 73.34 feet from the southeast corner thereof; thence North 28 degrees 04 minutes East, 39.24 feet; thence North 12 degrees 46 minutes West, 103.00 feet to its terminus in the north line of said Thurza property distant therealong North 89 degrees 07 minutes West, 79.53 feet from the northeast corner thereof; said 10 foot wide strip of land being bounded southwardly and northwardly by the south and north lines, respectively, of 29 said Thurza property. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20 feet in width on each side of, and adjacent to, the hereinabove described 10 foot wide permanent easement, the western and eastern lines of which 20 foot wide temporary easements are coincident with the eastern and western lines, respectively, of said 10 foot wide permanent easement; said 20 foot wide easements being bounded northwardly and southwardly by the north and south lines, respectively, of the aforesaid Thurza property. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase, if possible, subject to approval of the Board of Trustees, or to institute and prosecute an action in condemnation,as authorized by law, if necessary, to appropriate and acquire the aforesaid private property.
