AN ORDINANCE vacating portions of sewer easements in
St. Louis County, Missouri.
WHEREAS, the Owner of the subject property has
requested this District to vacate such portions of easements and
has granted this District satisfactory substitute easements,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The following described portions of sewer
easements are hereby vacated, to wit:
1. That easement ten (10) feet wide granted by American Better
Communities, Inc. by instrument dated June 19, 1963 and
recorded in Book 5134 page 526 of the St. Louis County
Records, excepting therefrom those portions thereof
coincident with easements granted by Cypress Village
Shopping Center, Inc. by easement plat dated August 24,
1967, and recorded in Plat Book 122 page 82 of the St.
Louis County Records.
2. That portion of the easement ten (10) feet wide granted by
American Better Communities, Inc. by instrument dated
December 10, 1962 and recorded in Book 4996 page 132 of
the St. Louis County Records, which portion is bounded
on the northwest by property now or formerly of the
Pattonville Consolidated School District R-3, and on
the northeast by the northwest extension of the
southwest line of Spring Avenue (40 feet wide),
excepting from such vacation those portions of such
easement coincident with easements granted by aforesaid
easement plat recorded in Plat Book 122 page 82.
3. The western ten (10) foot wide easement granted by American
Better Communities, Inc. by instrument dated September
5, 1963, and recorded in Book 5199 page 395 of the St.
Louis County Records.
4. That easement fifteen (15) feet wide granted by Edith
Maschmidt by instrument dated November 8, 1963 and
recorded in Book 5257 page 5 of the St. Louis County
Records, excepting therefrom the southeastern ten (10)
feet thereof, and also excepting therefrom those
portions thereof coincident with easements granted by
aforesaid easement plat recorded in Plat Book 122, page
82.
5. That easement ten (10) feet wide granted by Frank Himmelsbach
and Darline Himmelsbach, his wife, by instrument dated
November 12, 1963, and recorded in Book 5257 page 3 of
the St. Louis County Records.
6. That easement fifteen (15) feet wide granted by Glennon P.
Corcoran and Geraldine P. Corcoran, his wife, by
instrument dated December 3, 1963, and recorded in Book
5263, page 279 of the St. Louis County Records. The foregoing Ordinance was adopted November 22, 1967.
